Leaning Tower Ave Thank you for your comments Nicole. The applicant’s narrative in the online file states they will pick up and deliver the children AND take them to school. Based on your comments, I did a site visit on a weekday afternoon. There were only two cars parked on S. Leaning Tower, both in front of the subject house. The only issue I did notice was a group of children in the street in the vicinity of E. Pantanella Dr and S. Murlo Ave, but not near the in-home daycare. Given there are only three Associate Planners and a LOT of projects, we are limited in the number of site visits we can do for any given project. The staff report does mention the citizens have expressed concerns with traffic and parking. I am presently researching how many parking complaints have been filed, and whether the majority of the complaints were filed before or after the neighborhood meeting. The timing of when the calls were received is significant. For example, has this been an ongoing issue under the existing daycare, or was this issue expressed after the neighbors were informed the applicant proposed to expand to allow an additional 6 children? IF this were approved, and there were ongoing issues associated with this residential in-home daycare that are verified by zoning enforcement, this use can be shut down. The applicant has stated outdoor play is limited to one hour after 9am and one hour after 1pm. If the use were approved with this limitation and this was not respected, this is also a zoning enforcement issue which can affect whether their use continues to operate. If outdoor activity is limited to two hours a day, this is a very minimal impact on the adjacent residences. Is this impact greater than impacts from properties in the neighborhood that do not have a limitation on outdoor activities? What about constantly barking dogs in a back yard? We do not believe there are inaccuracies in the staff report, and we do not revise our staff reports based on opposition from citizens. We review the proposal, and make a recommendation to the Planning Commission, who makes the decision. I appreciate you are adamantly opposed to this proposal, and that you feel the staff report is not written strongly enough against the proposal. It is common for neighbors opposed to zoning proposals to submit their own reasons why they do not think the project should be approved. This does not embarrass us, it is the reality of our job. You will have 3 minutes to do that at the public meeting. This email correspondence will go into the public folder so the public and decision makers will see it. Leaning Tower Ave External Sender - Please use caution with links or attachments. Hi again Alan, I just read your report online. On page 4, you state that she provides transportation. Based on the letter she sent to everyone and what neighbors confirm, she provides transportation mainly to and from school. Not to and from the daycare. She even explains in the letter she sent us that she tries to stagger drop off and pick up, so that should really be made clearer in your report. She isn't going to all of the family's homes to get the kids and return them. When I almost hit a child, it appeared to be at pick-up in the afternoon. You also state that there is a large driveway, but there are 5-6 cars that are associated with people who live there which are there a lot during drop off and pick up times. Not in the middle of the workday when people are at work when the city checked. They appear to never park inside the garage so they are always parked in the driveway and on the road. (Perhaps the garage is used for the daycare or is just full.) Another neighbor will send the clerk several photos showing all of the cars that are usually parked connected with the home and the dates. When you state that they will be playing in the backyard, I really think you should be including the measurements since this is an incredibly small yard for 12 children to play in. I think it's also important to note how close this home is to the other homes. They are only five feet apart from neighbors on both sides and there have already been noise complaints as I shared with you from my tenant. This is certainly not in harmony with the neighborhood. Can you please re-look at your report and make sure any inaccuracies are addressed, as well as noting that parking enforcement has had to be called due to cars associated with the home partially blocking neighbor's driveways and also illegally parking the wrong direction once you have all the information on that? Otherwise I truly don't want to have to testify at the public hearing about the flaws in your report. If you prefer to put this email in public comments, that is fine too, but I do not want in any way for this to come across as embarrassing to you. I regularly partner with cities and the state in my line of work and highly value government work. If you can't update the report, I am also happy to put this in a different format if you need me to. I could just do a letter with bullet points expressing concerns on the report and not include this last bit. Thanks for the work you do for our citizens!
