Mayor Simison and City Council members,
My Husband and I, as well as our daughter and son-in-law, are current residents of the Oaks North Sub. We moved in a
year ago this month and reside directly behind the park, pond and pool facilities on Rustic Oak Way.
When we signed on to build with Coleman Homes we were happy to be supporting a locally owned company and were
not told that the company had been purchased by an out of state (Pennsylvania) company named Toll Brothers. In fact
we feel that Coleman Homes and Toll Brothers have not been forthcoming with information that affects all of the Oaks
subdivision residents.
This month we had our yearly HOA meeting which is the first we have been able to attend. During this meeting we were
enlightened as to how many things have been mis-informed or left out completely to the residents of the Oaks subs.
*When purchasing our home we were told there would be a total of 500ish homes in the sub. In actuality there are
going to be well over 1200 "roofs" in the sub. The number we were told was just for the Oaks North, apparently.
*Toll Brothers, along with another company based in Arizona, are doing a joint venture of rental only residences in the
sub called Oak Wind. (Bill Stanton the VP for Toll Bros stated in the meeting it would be 98 town homes which city
records state as 91 town homes and 24 homes just in phase one. He never mentioned phase two which will be an
additional 70 homes)
* These rentals will have use of all of the amenities just behind my home.
* We do not have to legally be notified if there are any plan changes to our community such as these rentals. Mr Stanton
stated that it was our responsibility to keep an eye out for hearing notices and the like.
* We are not allowed to have any residents on the HOA board (currently managed by AMI) until the entire Oaks sub has
been finished. Estimated time frame on that is 3.5 years! Some of the Oaks residents have lived here for 5 years or
more!
Last week one resident, that lives only one block from us, received a notice in the mail which we did not receive, about
the hearing for the Oaks North Rezone on April 7 to change an R4 zone to R8 because they had need to recoup 5
building lots they lost in the final plat phase of the Oaks North. If anything we would request that you alter the plat to
include another pool for the rentals to use at their own expense and not the HOMEOWNERS facilities. Bill Stanton stated
that the two pools we have were plenty big for all of the residences and rentals to use. Currently there are roughly only
half of the final count of residences built and lived in and we already had crowding at the pool behind our home last
summer. We also had multiple vandalism instances at the pools last year which will undoubtedly go up if renters are
allowed to use these same facilities. There should not be rental facilities and homeowner facilities usage combined, if
not solely for the fees situation. Rentals should have their own facilities, management and fees. How can this be fixed? I
would like to see the land up for rezoning changed to be used not for building lots but for common area and facilities
solely for the rental units.

There was also an announcement in the paper today about a hearing with City Council in Meridian for Oaks Build to
Rent, LLC to get approval for 70 rental only homes in phase 2 of the aforesaid Oakwind Estates on April 12 at 4:30. When
we contacted the city about this meeting we were told it was already approved. How can we, as homeowners in this
sub, not be notified about usage changes like this and it gets approved? We should get some say in sharing our facilities
with almost 200 rental units!
Please, Mayor Simison and Council Members, consider having this land up for rezoning to be changed to common area
facilities and a pool just for use of the rental units! We are not alone in the concern this has for all of the residents of the
Oaks and the safety, enjoyment, and keeping the costs to the homeowners reasonable.
