Hello, I would like to provide a written testimony for the City Council Meeting on April 12. This testimony is related to The Oaks Build to Rent LLC building the Oakwind Estates. I am part of the Oaks North subdivision and have many concerns with the Oakwind Estates. First off, Toll Brothers, who owns the Oaks North, never disclosed to homeowners that the houses in the Oakwind Estates would be rental properties or that these 70 houses would be part of our HOA and be entitled to access amenities that the Oak North residents pay for. The fact that this build is a joint venture is a major concern. Another developer is now inserting themselves into our HOA. As long as the properties are considered under development, the HOA will not be allowed to transfer to the homeowners. Currently the HOA is controlled by a company called AMI who have done a terrible job managing the Oaks HOA. They will not hear or let the residents voice their concerns. They have made it explicitly clear that the HOA will not allow residents on the board to represent the homeowners. Making Oakwind Estates part of the Oaks HOA is further extending the timeline of when the residents are able to take control of the HOA. The biggest issue we are facing is the fact that the renters do not have any stake in the better interest of the Oaks subdivision. They will be allowed access to all Oaks amenities (the pool, playground, fishing pond, etc.) that they are not paying for. The Oaks already is suffering from a capacity issue with the pools and playgrounds within the neighborhoods due to the sheer volume of houses and residents. Adding access to the rental properties will further press these capacity issues and take away access to actual home owning residents who pay for these amenities. It is well known that renters do not stay long term within rental properties and do not take the same care of special amenities that homeowning residents do. The home owning residents of the Oaks will then be taking the expenses upon themselves to fix any damage or issue that may arise caused by rental occupants. A separate pool/amenities need to be added to the Oakwind Estates for their own use and at their own expense. They also need to be removed from being part of the HOA of the Oak subdivision to allow for home owning residents to do what is best for the neighborhood and amenities we are paying for. It will also address major amenity capacity issues to provide the Oakwind Estates their own pool, playground, etc. If you look at the plans for Oakwind Estates there is ample room for the changes being requested by Oaks residents. Please address these concerns with the developers and vote to make them make changes to their planned development.
