QUITCLAIM DEED — TENANTS IN COMMON
Quitclaim deed made this -3A day of July, 2009, between Timothy J. Johans and Kathlyn
M. Johans, City of Boise, County of Ada, State of Idaho, Grantors, and Michael V. Hajjar and
Kelli J. Hajjar, City of Boise, County of Ada, State of Idaho, Grantees.
Grantors, for and in consideration of the sum of One Dollar ($1.00) and other consideration
paid by Grantees, receipt of which is acknowledged, does by these presents release and forever
quitclaim to Grantees as tenants in common with Grantors, and to their successors, heirs and assigns,
all the right, title, interest, estate, claim, and demand, both at law and in equity, of Grantors, of, in,
and to an undivided thirty two and one-half percent (32.5%) interest in the real property situated in
the County of Ada, State of Idaho, described as follows,
Parcel C of Record of Survey Number 7123 recorded November 10, 2005, as Ada County Instrument
No. 105170551, being
A parcel of land situate in the Northeast quarter of Section 21, Township 3 North, Range 1 East, Boise Meridian,
Meridian City, Ada County, Idaho, being all of Lot 6 and a portion of Lot 5, Block 2, Silverstone Campus
Subdivision, as shown on the official Plat thereof in the office of the Ada County, Idaho Recorder, and being more
particularly described as
Commencing at the Northwest corner of said Lot 5; thence
South 00' 13' 16" West, 75.86 feet along the Westerly border of said Lot 5 to the REAL
POINT OF BEGINNING; thence
South 89' 13'46" East, 358.84 feet along a line parallel to the Southerly boundary of said
Lot 5 to the Easterly boundary of said Lot 5; thence
South 00' 46' 14" West, 210.14 feet along the Easterly boundary of said Lots 5 and
6 to the Southwest corner of said Lot 6; thence
North 89' 13'46" West, 367.35 feet along the Southerly boundary of said Lot 6; thence
North 41 ° 41'40" West, 77.35 feet along the boundary of said Lot 6 to the most Westerly
corner of said Lot 6; thence
North 47° 15'42" East, 29.72 feet along the boundary of said Lot 6 to a point of curvature;
Thence 104.27 feet along a tangent curve deflecting to the left, with a radius of 127.00
Feet, a central angle of 47' 02'26" a long chord of 101.36 feet and a chord bearing of
North 23°44'29" East along the boundaries of said Lots 6 and 5 to a point of tangency;

North 00' 13' 16" East, 39.30 feet along the Westerly boundary of said Lot 5 to the REAL POINT OF
BEGINNING.
together with all the improvements, ways, easements, rights, privileges, and appurtenances held or
owned by or of Grantors in the above -described real property.

Rules and Regulations, and CC&Rs of the Association. Buyers are further aware that the
property may be subject to assessments levied by the Association, and that such assessments, for
the prior year, were approximately six thousand dollars ($6,000.00) annually .
8. Costs incurred in the execution of this purchase and sale transaction have been borne
by the Sellers.
9. This transaction shall close on or before the close of business on July , 2009.
The parties agree that no closing agency has been chosen for this transaction and that it shall be
deemed closed on payment of good funds from Buyers to Sellers, and execution of a Quitclaim
Deed and this Agreement.
10. This Agreement contains the entire agreement of the parties respecting the matters set
forth herein, and it supersedes all prior agreements, whether oral or written, between the parties
respecting all such matters as are addressed. No warranties, including, without limitation, any
warranty of habitability, agreements, or representations not expressly set forth herein shall be
binding upon either party. Idaho law shall control the enforcement, interpretation and all other
aspects of this Agreement. The parties shall execute any other agreements reasonably necessary
to carry out the intentions of this agreement, including those necessary to establish accounts for
the tenants in common_

To have and to hold said undivided thirty two and one-half percent (32.5%) tenancy in
common interest in and to the above -described real property, together with the appurtenances
belonging to such property, to Grantees, their heirs and assigns forever.
In witness whereof, Grantors have executed and delivered this quitclaim deed at Boise,
Idaho, the date first written above.
