CH D Kent Goldthorpe, President I IL Dave McKinney,Vice-President Jim D. Hansen,Commissioner Mary May,Commissioner Alexis Pickering,Commissioner August 25, 2021 To: Tamara Thompson, via email The Land Group, Inc. 462 E. Shore Drive, Ste 100 Eagle, ID 83616 Subject: MER21-0077/ H-2021-0027 125 & 185 E Blue Heron Lane Heron Village (Phase 2) The applicant is requesting annexation of 1.4 acres with a rezone from R1 (Estate Residential) to R-40 (High Density Residential), a rezone of an existing portion of Phase1 of Heron Village Apartments from C-G to R-40 and a conditional use permit to allow for the addition of 36 units in two 3-story buildings with additional open space and parking on 1.4-acres. A. Findings of Fact 1. Blue Heron Lane a. Existing Conditions: Blue Heron Lane is improved with 2-travel lanes, 27-feet of pavement and no curb, gutter and sidewalk abutting the site. There is 48-feet of right-of-way for Blue Heron Lane (23-feet from centerline). West of the site, Blue Heron Lane is improved as a 36-foot wide local street section with curb, gutter and 5-foot wide attached concrete sidewalk. b. Policy: Local Roadway Policy: District Policy 7207.2.1 states that the developer is responsible for improving all local street frontages adjacent to the site regardless of whether or not access is taken to all of the adjacent streets. Street Section and Right-of-Way Policy: District Policy 7207.5 states that right- of-way widths for all local streets shall generally not be less than 47-feet wide and that the standard street section shall be 33-feet (back-of-curb to back-of-curb). Standard Urban Local Street-33-foot Street Section and Right-of-way Policy: District Policy 7207.5.2 states that the standard street section shall be 33-feet (back-of-curb to back-of-curb) for developments with any buildable lot that is less than 1 acre in size. This street section shall include curb, gutter, and minimum 5- foot wide concrete sidewalks on both sides and shall typically be constructed within 47-feet of right-of-way. Sidewalk Policy: District Policy 7207.5.7 states that five-foot wide concrete sidewalk is required on both sides of all local street, except those in rural developments with net densities of one dwelling unit per 1.0 acre or less, or in hillside conditions where there is no direct lot frontage, in which case a sidewalk shall be constructed along one side of the street. Some local jurisdictions may require wider sidewalks. Ada County Highway District•3775 Adams Street•Garden City,ID•83714• PH 2O8-387-6100• FX 345-7650•www.achdidaho.org The sidewalk may be placed next to the back-of-curb. Where feasible, a parkway strip at least 8-feet wide between the back-of-curb and the street edge of the sidewalk is recommended to provide increased safety and protection of pedestrians and to allow for the planting of trees in accordance with the District's Tree Planting Policy. If no trees are to be planted in the parkway strip, the applicant may submit a request to the District, with justification, to reduce the width of the parkway strip. Detached sidewalks are encouraged and should be parallel to the adjacent roadway. Meandering sidewalks are discouraged. A permanent right-of-way easement shall be provided if public sidewalks are placed outside of the dedicated right-of-way. The easement shall encompass the entire area between the right-of-way line and 2-feet behind the back edge of the sidewalk. Sidewalks shall either be located wholly within the public right-of-way or wholly within an easement. c. Applicant's Proposal: The applicant is proposing to construct curb, gutter and 5- foot wide attached concrete sidewalk on Blue Heron Lane abutting the site. d. Staff Comments/Recommendations: Consistent with the improvements constructed on Blue Heron Lane west of the site, the applicant should be required to complete Blue Heron Lane as a 36-foot wide street section to include pavement widening, curb, gutter and 5-foot wide attached concrete sidewalk to tie into the existing improvements west of the site. Dedicate right-of-way to 2-feet behind back of sidewalk. The applicant should be required to provide a permanent right-of-way easement for public sidewalks placed outside of the dedicated right-of-way. The easement shall encompass the entire area between the right-of-way line and 2-feet behind the back edge of the sidewalk. If street trees are desired, then provide an 8-foot wide planter strip. 2. Driveways-Blue Heron Lane a. Existing Conditions: There are 3 existing driveways from the site onto Blue Heron Lane. b. Policy: Driveway Location Policy: District policy 7207.4.1 requires driveways near intersections to be located a minimum of 75-feet (measured centerline-to- centerline)from the nearest local street intersection, and 150-feet from the nearest collector or arterial street intersection. Successive Driveways: District Policy 7207.4.1 states that successive driveways away from an intersection shall have no minimum spacing requirements for access points along a local street, but the District does encourage shared access points where appropriate. Driveway Width Policy: District policy 7207.4.3 states that where vertical curbs are required, residential driveways shall be restricted to a maximum width of 20- feet and may be constructed as curb-cut type driveways. Driveway Paving Policy: Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.4.3, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway. Ada County Highway District•3775 Adams Street•Garden City,ID•83714•PH 2O8-387-6100•FX 345-7650•www.achdidaho.org c. Applicant's Proposal: The applicant is proposing to close the 3 existing driveways onto Blue Heron Lane with curb, gutter and 5-foot wide attached concrete sidewalk. The applicant is proposing to construct a 28-foot wide curb return type driveway from the site onto Blue Heron Lane located approximately 547-feet east of Meridian Road. d. Staff Comments/Recommendations: The applicant's proposal to close the 3 existing driveways onto Blue Heron Lane meets District policy and should be approved, as proposed. The applicant's proposal to construct a 28-foot wide curb return type driveway onto Blue Heron Lane located 547-feet east of Meridian Road meets District policy and should be approved, as proposed. 3. Emergency Access a. Existing Conditions: East of the site, there is an existing 10-foot wide pedestrian pathway within 35-feet of right-of-way located at the terminus of Blue Heron Lane. b. Applicant's Proposal: The applicant is requesting to widen the existing 10-foot wide pathway to 12-feet to provide an emergency only access between the terminus of Blue Heron Lane and Eureka Avenue. 196•. i i'n.. 74¢l 2407 c 1 "I-.Hernn Un RomV _ _ PROPOSED EMERGENCY ,ACCESS LOCATIO c. Staff Comments/Recommendations: Due to the location of the existing canal located on the south side of the pathway, the applicant should be required to provide documentation, for additional review, that the widening of the existing 10- foot wide pedestrian pathway to 12-feet wide is feasible to provide an emergency only access between the terminus of Blue Heron Lane and Eureka Avenue. B. Site Specific Conditions of Approval 1. Complete Blue Heron Lane as a 36-foot wide street section to include pavement widening, curb, gutter and 5-foot wide attached concrete sidewalk to tie into the existing improvements west of the site. Dedicate right-of-way to 2-feet behind back of sidewalk. 2. Provide a permanent right-of-way easement for public sidewalks placed outside of the dedicated right-of-way. The easement shall encompass the entire area between the right- of-way line and 2-feet behind the back edge of the sidewalk. If street trees are desired, then provide an 8-foot wide planter strip. 3. Close the 3 existing driveways onto Blue Heron Lane with curb, gutter and 5-foot wide attached concrete sidewalk, as proposed. 4. Construct a 28-foot wide curb return type driveway onto Blue Heron Lane located 547-feet east of Meridian Road, as proposed. Ada County Highway District•3775 Adams Street•Garden City,ID•83714•PH 2O8-387-6100•FX 345-7650•www.achdidaho.org 5. Provide documentation, for additional review, that the widening of the existing 10-foot wide pedestrian pathway to 12-feet wide located east of the site at the terminus of Blue Heron Lane is feasible, due to the existing canal located south of the pathway, to provide an emergency only access between the terminus of Blue Heron Lane and Eureka Avenue. 6. A Traffic Impact Fee will be assessed by ACHD and will be due prior to issuance of a building permit. Please contact the ACHD Planner (see below) for information regarding impact fees. 7.
