For the consideration of the sum of Ten and 00/100 Dollars ($10.00) and other valuable
consideration, Treasure Valley Investments, LLC, an Idaho limited liability company ("Grantor"),
does hereby grant, sell and convey unto DWT Investments LLC, an Idaho limited liability
company, as to an undivided 33.33% interest, SCS Investments LLC, an Idaho limited liability
company, as to an undivided 33.34% interest and BVB Ten Mile Crossing Annex LLC, an Idaho
limited liability company, as to an undivided 33.33% interest, as tenants in common, ("collectively
Grantee"), whose address is 2929 W. Navigator Dr., Suite 400, Meridian, ID 83642-7553, and its
successors and assigns forever, the following described real property located in Ada County,
Meridian, Idaho, as described in Exhibit A attached hereto and incorporated by this reference (the
"Property").
TOGETHER WITH all and singular the tenements, hereditaments, easements, rights and
appurtenances thereunto belonging or in any way appertaining, the reversion and reversions,
remainder and remainders, rents, issues, and profits thereof; and all estate, right, and interest in
and to the Property, as well in law as in equity.
Grantor does hereby covenant to and with the said Grantee, that the Grantor is the owner in fee
simple of said Property; that the Property is free from all encumbrances EXCEPT those to which
this conveyance is expressly made subject and those made, suffered or done by the Grantee;
and subject to all existing patent reservations, easements, rights of way, protective covenants,
zoning ordinances, and applicable building codes, laws and regulations, general taxes and
assessments, including irrigation and utility assessments (if any) for the current year, which are
not due and payable, and that Grantor will warrant and defend the same from all lawful claims
whatsoever. Whenever the context so requires, the singular number includes the plural.
