We have been fighting a simple process now for months. We have complied with all requests of Planning and Zoning, have completed all the required due diligence and work required per the application. We have actively contacted the Applicants on either side of our parcel and have worked out cross access with them. However. this being said, we have been repeatedly tabled/continued for several reasons out of our conn-o!. We have been wlfortunately linked to ACHD's parcel as well as the parcel to the West. On January 19,2006 our application was heard bllt the decision was made to continue the application to a later date because ACHD did not post their site properly. Our project was continued because the Commission wanted to see all the projects on that comer together. At which time they approved all the projects but the Gateway Market Place project located on the comer of Eagle and Ustick. City Council continued us, to our underst.andjn~ because ACHD was bcing continued until they worked out the sewer. landscape buffer and the irrigation issues with the neighbors to the East. Also, it appeared that the future ownership of the remaining parcel after the split was a factor in the unfavorable decision to continue. Our Client has customers waiting to have buildings built so they can mOve in, and due to these delays, rclationslùps are being sttessed and have even resulted in the loss of a major customer who was committed in relocating his business to our project site. I am not an expert at how the City Council meetings work. Last week at the City Cmmcil meeting I was acknowledged as being there as the applicant. I stated that we agreed with the staff report findings and requests. It was opened for pubUc comment of which there was Done. When the pllblic comment time was closed. you discussed amongst yourselves this project and your opinions. There was information that you were stating/discussing that was incorrect and had no bearing on our project, which I believe was one of the major factors in this project beÏng continued. I was disappointed that 1 was not given the chance to address your comments to clarify the misconceptions which were being discussed. I made direct eye contact with Councih:nan Borton, raised my hand to indicate I would like to address the issues, and was not acknowledged. The issoes that were brought Up. that I would like to clarify, are: (1) the cross access betWeen all properties from Eagle Road to ACHD's property and (2) the strip ofland remalcing after ACHD splits their property. We have had meetings with ACHD and the applicant of the property to the West. Through that meeting we have resolved the cross access issue with two points of access directly across our property and half a road section on the southern portion of our property to the future Alley Way road. Reference was made to the strip ofland which will be split off by ACHD, which the Cotlncil indicated was an issue concerIÜng how the road and landscape buffer would relate to ACHD's neighbors to the East. This small piece of land has absolutely nothing to do with our project. Once ACHD has split their parcel, the remamder will be auctioned off to the lúghest bidder. Una Mas. LLC may bid on the propertY. However, there is no guarantee that they will be the successful bidder. It was stated more than a couple of times that it was basically a doDe deal which is an incorrect statement and I felt it led the Council to an unfavorable decision to continue our project that night. Time is of the essence with our development and at this time there is no schedule for engineering of AJley Way or the propeny being auctioned offby ACHD. In conclusion and with all due respect, we request that the CoùIlCil approve our annexation application tonight.
