Simison City Council Members: Treg Bernt Brad Hoaglun Joe Borton Jessica Perreault Luke Cavener Liz Strader This letter is to confirm the Director approved your request for alternative compliance to the standard Unified Development Code (UDC) 11-3C-6 requirement of 4 on -site parking spaces for 3-4 bedroom dwelling units for the subject property based on the required Findings listed in UDC 11-513-5E, as follows: 1. Strict adherence or application of the requirements are not feasible; or Adherence to the requirements to provide adequate parking is feasible. The applicant has the option of removing the number of bedrooms, or providing additional parking. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The applicant has provided a narrative and exhibit which indicates up to 32 lots within the Hills Century Farm North No 2 Subdivision could have more than 2 bedrooms. For houses with 3-4 bedrooms, UDC I1-3C-6 requires 4 parking spaces per dwelling unit; at least 2 in an enclosed garage, other spaces may be enclosed or a minimum 10 foot by 20 foot parking pad. However, the Hills Century Farm Planned Unit Development allows for garage setbacks of as little as 6 ft. in width, and houses of more than 2 bedrooms are proposed with only 2-car garages that do not include the required parking pad in front. Based on exhibits provided by the applicant, the private streets surrounding these lots allow for parking on one side of the street. Staff estimates at least 100 parking spaces could be provided on -street. As these are private streets that would be policed by the homeowners and the HOA, and the applicant has provided CC&Rs which reflect this community is targeted towards age 55+, staff believes the alternative provides an equal or superior means for meeting the requirements. The lots proposed for the parking reduction are within the center of the Hills Century Farms North Subdivision, and adequate on -street parking is provided along the surrounding roads. Also, the applicant has provided a parking study of Paramount Cadence, a similar community with reduced parking requirements, which reflects there has been sufficient parking during different dates and times, including Superbowl Sunday. Staff finds the alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before March 15, 2022, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application.
