ORDER OF CONDITIONAL
APPROVAL OF FINAL PLAT
This matter coming before the City Council for Final Plat approval
pursuant to Meridian City Code § 12-3-7 on January 2, 2001, and tabled to January 16,
2001, and the Council finding that the Administrative Review is complete which has
included certain comments and conditions as stated in a letter to the Mayor and Council
from Bruce Frecldeton, Engineering Technician III, and Shari Stiles, Planning and
Zoning Administrator, listing ! 1 General Comments and 24 Site Specific Comments,
which are herein found fair and reasonable, and at the January 16, 2001 meeting, Shari
Stiles, Planning and Zoning Administrator, commented at the hearing, and Becl~
Bowcutt, Becky Bowcutt Planning Services, testified on behalf of the Applicant, and
Frank Varrialle, appeared and testified, and the Council having considered the
requirements of the preliminary plat the Council takes the following action:

IT IS HEREBY ORDERED THAT:
1. The Plat of "BRIDGETOWER SUBDIVISION NO. 1" as evidenced in Plat
bearing "PLAT OF BRIDGETOWER SUBDIVISION NO. 1, A PORTION OF THE
SOUTH 1/2 OF SECTION 35, T. RN., R. 1W., B.M., ADA COUNTY, IDAHO 2000,
SHEET 1 OF 2,/0601 \0601-PLT.DWG BKB 11/01/00, STAMPED NOV 01 2000, By:
BRIGGS ENGINEERING, INC., and PRIMELAND DEVELOPMENT CO., LLP,
Developer", is Conditionally Approved subject to those conditions of Staff comments as
set forth in the Memorandum to the Mayor and City Council from Bruce Frecldeton,
Engineering Technician III, and Shaft Stiles, Planning and Zoning Administrator, dated
December 28, 2.000, listing 11 General Comments and 24 Site Specific Comments, and
Applicant's response letter by and through Becky Bowcutt Planning Services, dated
December 29, 2000, true and correct copies of which are attached hereto marked Exhibit
"A", and consisting of eight pages, and by this reference incorporated herein, with the
additional requirements that:
1.1 Additionally, at the City Council meeting on January ! 6, 2001,
action taken by the Council consisted of the following pertaining to
the tiling of the ditch:
The City of Meridian will waive the requirement for tiling of the
Creason Lateral Ditch for a portion of the property. The portion
waived is on the North side of the applicant's parcel that is also
contiguous to property owned by Leonard Huskey. In lieu of tiling
this section of ditch, the applicant will construct a six foot perimeter
fence on that boundary. Additionally, the applicant will have to
obtain the Nampa & Meridian Irrigation District's approval for the
fence.

On the western boundary, the applicant has to post a bond or a
letter of credit for a three (3) year time period, and which may be
renewed for additional three (3) year periods for an amount of
estimated costs of construction or tiling of one-half (%) of the
Creason Lateral along the western boundary of the property.
1.2
The Central District Health Department requires after written
approval from the appropriate entities are submitted, they can
approve this proposal for central sewage and central water; that plans
must be submitted to and approved by the Idaho Department of
Health and Welfare, Division of Environmental Quality for central
sewage and central water; that run-off is not to create a mosquito
breeding problem; and it is suggested that stormwater be pretreated
through a grassy swale prior to discharge to the subsurface to prevent
impact to groundwater and surface water quality; that engineers and
architects should obtain current best management practices for
stormwater disposal and design a stormwater management system
that is preventing groundwater and surface water degradation.

The final plat upon which there is contained the Certification and signature
of the City Clerk and the City Engineer verifying that the plat meets the City's
requirements shall be signed only at such time as:
a. The Plat dimensions are approved by the City Engineer; and
b. The City Engineer has verified that all off-site improvements are
completed and/or the appropriate letter of credit or cash has been

issued guaranteeing the completion of off-site and required on-site
day of
improvements.
By action of the City Council at its regular meeting held on the
