Dear City Council:
After reviewing the White Peterson Findings of Fact Conclusions of Law and Decision and Order
and after receiving a modified approval t?om the Highway District I have the following statements
regard~_g our position:
(Summary)
We feel there are four items which feel should be clarified as part of the Findings of Fact
Conclusions of Law and Decision and Order for Tuscany Lakes Development.
[First] In all three applications there is the same Order which should be clarified:

16. Construct Rome Drive as a 33-foot street section within 50-feet of fight-of-way with two
11-foot travel lanes and two 4-foot bike lanes with vertical curb, gutter and 5-foot
concrete sidewalk. Parking shall be restricted on both sides of these roadways, as
proposed." Construct Dartmoor Drive to be constructed as a 33-foot street section within
50-feet of right-of-way with two 11-foot travel lanes and two 4-foot bike lanes with
vertical curb and gutter on both sides of the roadway and a 1 O-foot asphalt pathway on the
north side of the roadway and a pathway along the northside of Lot 11, Block
3(contingent upon the fact that the applicant will construct and maintain the pathway as a
part of the homeowners association).

[Second] In all three applications there is the same Order which should be clarified:
17~ Unless otherwise approved, the applicant shall be required to construct all public roads
within the subdivision as 36-foot street sections with curb, gutter, and 5-foot wide
concrete sidewalks within 50-feet of right-of-way. If the sidewalk is outside of the right-
of-way, the applicant shall provide an easement.
[Third]
(Preliminary Plat PP-02-006)Item 17; page 7:
"17.The Applicant shall be required to build single-story homes on Block 1, Lots 32, 33
and 34 of said plat, and the applicant has supplied a revised plan which depicts the
restriction. For clarification, the height of the buildings for Lots 32, 33 and 34 of Block 1
shall be limited to 20 feet in hell!hr from zero grade, with a 6/12 maximum roof pitch, and
there shall be no windows above the first floor."
[Fourth]
(Preliminary Plat PP-02-006)Item 2a. 1; page 4:
Staff and the developer have come to the following decision:
New mains shall be extended from the current point of terminus in Eagle Road just north
of the McDonald Lateral, to Victory Road thc subdivision's southcrly boundary line
extended in Eagle Road, and in Victory Road from Eagle to the Ridenbaugh Canal, and in
Locust Grove from Sherbrook Hollows to the southerly boundary line extended.
Modeling results indicate that there will be problems providing adequate fire flows and
pressures to the elementary school site without the addition of water supply. The City of
Meridian currently owns land for a new well on the Eagle Road frontage near the
Ridenbaugh Canal, however with the addition of our new well within the Silverstone
project, approximately ~ mile north, this site is not the best location for additional supply
in the area. The applicant has prodded land for a new well along the project's north
boundary adjacent to Victory Road and the Ridenbaugh Canal. Main sizing and routing to
be coordinated with the Public Works Department. Applicant shall be responsible to
construct the sewer and water mains to and through this proposed development.
