If ACHD already has an easement for sidewalk in the area referenced (additional ROW needed to set back the ped
crossing for an intersecting roadway), then my earlier comment would apply. Per the drawing Aaron sent, I didn't note
that as part of the official ROW.
To reiterate: Any multi -use pathway located within an ACHD ROW is covered, in my estimation. No additional pathway
easement required.

Thinking out loud ... if ACHD has been granted the easement for the sidewalk already, and it is permanent, would
Meridian still need an easement for the same facility? I would view this the same as ROW.

Thanks for asking. To be absolutely correct in terms of preserving access, I think we would need easements for these
areas.
I know we've had to secure similar easements in the past for our sidewalk -widening [retrofit] projects.
I doubt there's any real threat to long-term access if they aren't provided, but we don't want to have multi -use
pathways on private property without formal permission. And I don't have any kind of authority to override this.

On a second thought, I want to make sure that we are clear. Below is a screenshot of the sidewalk easement that we
provided for ACHD. The bulk of the sidewalk falls in the dedicated r-o-w. There are a few areas where the sidewalk

Kim,
I know you are out today. But I have a quick question for you regarding the need for pathway easements. As you know,
ACHD is now requiring Arterials be constructed with a 10 foot sidewalk / pathway on both sides. This is the case with
our Pinnacle project. We have a requirement for APEX SE No. 1 to write a pathway easement for Meridian. The
sidewalk / pathway will be completely within ACHD's ROW. Is this still needed since a 10-foot sidewalk / pathway is now
an ACHD requirement?
Call me or email me at your earliest. We are getting down the wire and need to know if we have to submit this to you,
or if it is no longer needed for the reasons stated above. Thanks.
