AZ-06-012 and PP-06-010 Honorable Mayor de Weerd and Council Members: Vision First, LLC, is the Managing Member of Kingsbridge Properties, LLC, developer the subject Property. Kingsbridge Properties, LLC has purchased 7.35 acres from Mr. Don Hendriksen. Mr. Hendriksen retained ownership of 2.08 acres (Lot 10, Block 2). The purpose of this letter is to document our request for one item not mentioned in the Staff Report, to oppose three items within Exhibit B Conditions of Approval, and to highlight the revised comments within Exhibit B Conditions of Approval. Staff Report Section 10.1 (page 9) lists items for the Development Agreement. An allowance for continued livestock on Lot 10, Block 2 (existing house & outbuildings to remain) is requested in accordance with Section 11-8-1D of the Meridian City Code as summarized on the City website FAQ. •---W-V-_ re opposed to tht- lan'iiiiig &'Zoning Commission imposed building height restriction on Block 3. We will discuss this at length during the public hearing. We are opposed to fencing the south boundary of Lot 10, Block 2 .from its southwest corner to the Proposed gate at the westerly terminus of the shared driveway (see attached). We will also the this during the public hearing. Also attached are the pertinent portions of the Planning and Zoning minutes. We are opposed to Exhibit D.2.6 which requests additional improvements to the Ten Mile Feeder Canal. The canal is not a ".., natural, scenic feature..." but a man-made irrigation canal. Boise Project Board of Control has already requested that said canal remain open during the adjacent Kingsbridge Subdivision approval process. The Ten Mile Feeder Canal is located outside the boundaries of Hendriksen Subdivision on a separate parcel per Ada County records. City of Meridian Mayor de Weerd and City Council May 15, 2006 Staff Report Section 10.2 (pages 9 to 11) appears to contradict Exhibit B Conditions of Approval in several areas. The Conditions of Approval within Exhibit B reflect the Planning & Zoning Commissioners recommendations. The clarifications below are intended to avoid confusion at the public hearing and in the future. 1. Exhibit B 1.1.1 now references the Preliminary Plat dated May 5, 2006 as approved. Several lots within Block 2 were revised to address staff concerns with the previous preliminary plat. Planning and Zoning reviewed and approved the Block 2 layout as depicted on said May 5, 2006 preliminary plat. This should sufficiently address Staff Report Section 10.2 requirements for redesign on page 9. 2. Exhibit B 1.1.2 requested redesign has been completed and approved by the Planning and Zoning Commission (see #1 above). 3. Exhibit B 1.1.4 has been deleted to reflect Planning and Zoning approval of the redesigned park on Lot 5, Block 2. Thus, Staff Report Section 10 Landscaping requirement to move the park (page 10) has been made moot. 4. Exhibit B 1.1.11 allows for the existing house (on Lot 10, Block 2) to enjoy continued access to Bott Lane. Lot 10, Block 2 shall enjoy dual access to both Hendriksen Ave. and Bott Lane. A gate at the end of the shared driveway, secured by the owners of Lot 10, Block 2, shall block public access to the existing Bott Lane access within Lot 10, Block 2. Staff Report Section 10 Access requirement for fencing across the legal access (page 10) isn't necessary. 5. Exhibit B 4.1 documents the Planning and Zoning Commissioners' approval of the redesigned park. Staff Report Section 10 Landscaping requirement to move the park (page 10) is no longer needed. 6. Exhibit B 7.1.2 documents the Planning and Zoning Commissioners' approval to replace the north stub street with an emergency access to Selatir Place if approved by ACHD. Said access would be gated to prevent public access to Selatir Place. Staff Report Section 6.1(page 5) incorrectly indicates a connection to Selatir Place via the adjacent 6 acre lot to the north. To date, Mr. Dan Johnson, owner of said parcel, has not proposed to connect the Hendriksen Subdivision north stub street to Selatir Place. Nor has he secured ACHD consent to eliminate the north stub street. In summary, we ask the City Council to reconsider Planning & Zoning imposed height restrictions on Block 3; grant a fence waiver on a portion of the south boundary of Lot 10, Block 2; strike Exhibit D.2.6 reference to Ten Mile Feeder Canal; grant an allowance for the north stub street to be replaced by an emergency vehicle access lane contingent upon ACHD approval; avid approve the annexation, R-2 Zoning, and preliminary plat. —Thank you for your conside'ration.
