APPROVAL OF FINAL PLAT
This matter coming before the City Council for Final Plat approval
pursuant to Meridian City Code § 12-3-7 on January 16, 2001, and the Council finding
that the Administrative Review is complete which has included certain comments and
conditions as stated in a letter to the Mayor and Council from Bruce Frecldeton,
Engineering Technician III, and Shaft Stiles, Planning and Zoning Administrator, listing
10 General Comments and 15 Site Specific Comments, which are herein found fair and
reasonable, and at the January 16, 2001 meeting, Shari Stiles, Planning and Zoning
Administrator, commented at the heating, and Clint Boyle of Pinnacle Engineers, Inc.
testified on beh01f of the Applicant, and no one appeared in opposition, and the Council
having considered the requirements of the preliminary plat the Council takes the
following action:

IT IS HEREBY ORDERED THAT:
1. The Plat of "TUMBLE CREEK NO. 5 SUBDIVISION" as evidenced in
Plat bearing the "PLAT SHOWING TUMBLE CREEK NO. 5 SUBDIVISION, A
PORTION OF GOVERNMENT LOT 1 OF SECTION 2, TOWNSHIP 3 NORTH,
RANGE 1 WEST, BOISE MERIDIAN, CITY OF MERIDIAN, ADA COUNTY, IDAHO
2000, File name: P:XA_CIVIL\COO625 l\dwg\COO625 i_FP, Handwritten date of: 20

Company, Developer", is Conditionally Approved subject to those conditions of Staff
comments as set forth in the Memorandum to the Mayor and City Council from Bruce
Frecldeton, Engineering Technician III, and Shaft Stiles, Planning and Zoning
Administrator, dated January 12, 2001, listing 10 General Comments and 15 Site
Specific Comments, and a copy of a response letter from Pinnacle Engineers, Inc., dated
January 15, 2001, of which true and correct copies are attached hereto marked Exhibit
"A", and consisting of five pages, and by this reference incorporated herein, with the
additional requirements that:
1.1 Additionally, at the City Council meeting on January 16, 2001,
action taken by the Council consisted of the following revisions to
the Staff comments of January 12, 2001, as follows:
That in Site Specific Comments, number 14, the additional changes
are addressed within the Public Work Director, Gary Smith's memo
to the Mayor and City Council, dated 01/15/01, and shall be
incorporated herein as part of the conditions for the Final Plat, and
such memo is attached hereto as Exhibit "B", and consists of two
pages.

Additionally, in Site Specific Comment number 11, the ACHD does
not allow FEMA Flood Plains to be shown on the Plat, and therefore,
the applicant must supply the City with a separate Plat map showing
the FEMA Flood Plain for the City of Meridian's purposes.
The final plat upon which there is contained the Certification and signature
of the City Clerk and the City Engineer verifying that the plat meets the City's
requirements shall be signed only at such time as:
a. The Plat dimensions are approved by the City Engineer; and
b. The City Engineer has verified that all off-site improvements are
completed and/or the appropriate letter of credit or cash has been
issued guaranteeing the completion of off-site and required on-site
improvements.
By action of the City Council at its regular meeting held on the

We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shah be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:

The property is generally located on the south side of Ustick Road and west of Linder Road.

SITE SPECIFIC COMMENTS
1. Applicant is to meet all terms of the approved preliminary plat.

Gross density and net density calculation on plat application is incorrect. Provide updated
information for inclusion in file.
Street sign~q are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, fencing installed, and road base approved by the Ada
County Highway District prior to applying for building permits. All development
improvements shall be installed and approved prior to obtaining certificates of occupancy. A
letter of credit or cash surety in the mount of 110% will be required for all fencing,
landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final
plat.

4. Change the year of platting to 2001.

Water and sanitary sewer service to this site is proposed via extensions from adjacent
developments. Applicant will be respons~le to construct the sewer and water mains to and
through this proposed development. Subdivision designer to coordinate main si~ing and
routing with the Public Works Department. Sewer manholes are to be provided to keep the
sewer lines on the south and west sides of the centerline.
Some lots appear to be less than the minimum required square footage of 8,000 square feet
(e.g., Lots 10 and 11, Block 1). Provide lot closure information for all lots to verify minimum
lot square footages of 8,000 square feet.
The developer, as a condition of the plat must construct a 20-foot wide minimum landscape
buffer, beyond the required ACI-ID right-of-way along Ustick Road. Fencing shall not
encroach upon this buffer.
The landscaping and fencing plan submitted with the final plat application and dated 12/11/00
is approved, with the exception that the Indian Summer Crabs and Gallery Pears adjacent to
Linder Road are to be a minimum of 2" caliper. Fencing adjacent to Five Mile Creek must be
permanent, non-sight-obscuring and located on the easement line. Fencing adjacent to the
entry may not exceed a height of three feet within 20 feet of the right-of-way. A letter of credit
or cash surety will be required for the landscaping and fencing improvements prior to City
signature on the Final Plat. Fencing is to be constructed prior to applying for building permits.
All landscaping is to be complete prior to obtaining Certificates of Occupancy.

Lot 16, Block 15, and Lot 11, Block 15, do not meet the minimum frontage requirement of 80
feet. Revise plat to conform.
11.
Indicate on the final plat map any FEMA Flood Plains affecting the area being platted, and
detail plans for reducing or e~ting the boundary. Any structures proposed within the 100-
year floodplain will require approval through the conditional use permit process.
12.
Place an arrow symbol on Lot 13, Block 3, toward N. Blue Springs Avenue; and on Lots 13
and 14, Block 15, and Lot 27, Block 5, toward W. Tumble Creek Drive. These lots only meet
frontage requirements with a specific orientation. Lot 27, Block 5, should be adjusted so it can
meet the 80-foot frontage requirement on N. 'Blue Springs Avenue, as the median in the
roadway will preclude any driveway access.
13. Execute the Certificate of Owners and accompanying Acknowledgement.

Due to the absence of Brace Freckleton, additional changes may be required once he has had an
opportunity to review this final plat.
15.
Staff's failure to cite specific ordinance provisions or terms of the approved preliminary plat
does not relieve Applicant of responsibility for compliance.
GENERAL REQUIREMENTS
All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing
or lying adjacent and comiguous to the area being subdivided shall be tiled per City Ordinance
12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or
lateral users association, with written confirmation of said approval submitted to the Public
Works Department.
Any existing domestic wells and/or septic systems within this project will have to be removed
fi:om their domestic service per City Ordinance Section 9-1-4 and 94-8. Wells may be used
for non-domestic purposes such as landscape irrigation.
Two-hundred-fifty- and 100-watt, high-pressure sodium streetlights will be required at
locations designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final
design locations and quantity are determined after Idaho Power Company completes power
designs. Street light contractor to obtain design and permit fi:om the Public Works Department
prior commencing installations.
Compaction test results must be submitted to the Meridian Building Department for all lots
receiving engineered backfill_
Submit "Final" letter fi:om the Ada County Street Name Committee, approving the subdivision
and street names. Make any corrections necessary to conform.
6. Sewer and water mains shall be extended to and through the proposed development.
Applicant's engineer will be required to submit a signed, stamped statement certifying that all
street finish centerline elevations are set a minimum of three feet above the highest established
normal groundwater elevation.
8. Coordinate fire hydrant placement with the City of Meridiaffs Water Works Superintendent.
Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K.
Sidewalks are to provide a clear five-foot-wide walkway pathway without encroachment of
mailbox structures.
10.
Submit three copies of the revised Final Plat Map to the Public Works Department for
Compliance review prior to development plan approval.

property owner. ,

Re= Final Plat Review- Tumble Creek No.5 Subdivision.
Mayor & Council: in Bruce Fmckleton's absence I have conducted a review of this
final plat submitted to you for your review and approval by Pinnacle Engineers for
Stubblefield Development. In regards to that review, I have the following comments:
Plat Sheet No. 1:
1. The date of the plat needs to show 2001.
2. The slreet names Springtime Way and Linder Road need to be prefaced with
North.
The plat lie distance shown from the northeast comer of Section 2 to its north
comer needs to be labeled as W. Ustick Road and the distance is slightly different
than the distance of record shown on No.4 subdivision.
4. The distances shown along the northerly boundary of Lot 24, Block 5 need to be
revised to equal the exterior boundary distance shown along this IoL
The distance along the west boundary of Lot 32, Block 3 and the diagonal
distance across W. Whitestone CL is slighl~y different from the distance of record
from Tumble Creek Subdivision. The record distances need to be shown.

Lots 11, 16 - Block 15 and Lot 24 - Block 5 do not have
80 foot frontages.

7. The island in W. Tumble Creek Dr. needs to be labeled as Lot I - Block 17.
The front of Lots 13, 14-Block 15 and Lot 27-Block 5 needs to be shown toward
W. Tumble Creek Dr. The front of Lot 27-Block 5 as revised will be a problem
because of the island. The garage entrance will need to face N. Blue Springs
Ave.
Plat Sheet No.Z
Owner needs to sign, with notary.
In the Cerfi§cate of Owners, the first call-out after reference to Tumble Creek
No.1 Subdivision needs to be moved ahead of the reference to the recorded
subdivision. The references to Tumble Creek No. 1 need to be amended to
remove the No.1 designation and to list as Tumble Creek Subdivision, as
recorded. The two exterior boundary distances, previously discussed in Item
No.5 above, need to be revised to record distances or the record distances need
to be shown in parenthesis.
