Other: The applicant is not proposing any land use, development or subdivision at this time. Instead, the
applicant is proposing to amend the existing development agreement for the adjoining Blue Marlin parcel
to include this lot (see MI-OS-O17)

Key Issues of Discussion by Commission: Setbacks and land use buffers between the subject property and
the property to the west.
Key Commission Changes to Staff Recommendation: Required the applicant to submit an Alternative
Compliance application to reduce the landscape buffer to the west.
The UDC requires a 2S-foot wide landscape buffer between C-G zoned property and residential
uses/zones. Since the Planning & Zoning Commission hearing, the applicant has submitted an application
for Alternative Compliance to reduce the landscape buffer width along the west property line of both the
Blue Marlin and Nesmith properties to lO-feet in exchange for limiting trash compactors and loading
docks along the west elevations of buildings along the west property line. Staff is recommending
approval of the applicant's request.
Outstanding Issue(s) for City Council: applicant is in agreement with conditions, but has recommended a
clarification to the Sth bu1leted item in the DA provisions.
"In exchange for the reduced buffer width (10), with respect to buildings which are located on
those lots which border the west boundary of the subject site (defined as the 58 acre Blue Marlin
and 1.5 acre Nesmith parcel). and which take advantage of the reduced buffer. trash compactors
and loading docks along the west side of future buildings are prohibited."
Findings: Yes-for approval. If Council desires to include the applicant's clarification, the findings are
still good; you will just need to direct that his request be incOIporated into the DA.
