We are submitting an annexation and rezone application for a 1.46 acre parcel on the north
side of Us tick approximately y,. mile west of Eagle. We are further requesting that the
existing development agreement for the adjoining Blue Marlin parcel be amended to
include this lot.
As background infonnation, Winston H. Moore owns 58 acres at the northwest comer of
Ustick and Eagle. In early 2004, Mr. Moore submitted an application to annex and rezone
the entire 58 acres to C-G zoning. This parcel is refelTed to as Blue Marlin. At that time
we did not have any specific plans for the project, but felt it would be a commercial
development based on strong interest from the retail sector. However, interested major
retailers would not enter into serious discussions until the land was annexed and zoned for
their use.
. Given the uncertainty of how the project would be developed, but the need to get the land
annexed and rezoned, we agreed to a development agreement with the condition that "A
conceptual master plan will be submitted with the planned development application or if
the project is phased, a site specific plan will be submitted". The site specific plan would
require aCU applicatIon. .
Subsequent to the approved annexation and rezone, Mr. Moore purchased the adjoining
1.46 acre parcel with no plans for development. He simply purchased the lot to square of
the Blue Marlin parcel and avoid conflicts with the owner of this residential lot.

At the pre-application meeting, I mentioned we had no development plans for the subject
parcel, but because this land would become part of the larger 58 acre development, it made
sense to incorporate it into the city limits. To address the City's concern with no concept
plan, we proposed attaching the conditions contained in the Blue Marking DA to this
parcel. Based on our discussion, staff agreed as noted in the meeting notes. Therefore,
we ask that the subject parcel be annexed, rezoned to general commercial and the
development agreement for Blue Marlin be amended to include this parcel.
Administrative issues
On November 18th we sent notices out to all land owners within 300 feet of the project in
accordance with the UDC. This list was provided by the Planning & Zoning Department.
The meeting notice is attached.
On Monday, November 28t\ we had a neighborhood meeting at Meridian City Hall. The
sign-in list is included with this application. Three home owners attended the meeting and
no one expressed opposition to the project. It was apparent they were seeking infonnation
on the project.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) l1-SA.SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shaH submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shaH be removed no later than three (3) days after the end ofthe public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC II-5A-5.
