Fairview Avenue - (ZV-2021-0053) Dear Mrs. Buhlig: In response to your request for zoning verification for the property located at 1570 & 1580 E. Fairview Avenue, please note the following: • This property is located within the corporate boundaries of the City of Meridian and is currently zoned C-G (general retail and service commercial district). • The abutting zoning designations for the address listed above are L-O (limited office) to the north, C-G to the south, east, and west. • A retail store with a drive-through establishment within 300-feet of a residential district requires a conditional use in the C-G zoning district. The definition of a retail store and drive through are: Retail Store: The use of a site that offers merchandise to the public for monetary compensation. The use includes, but is not limited to, convenience stores; food stores; apparel and accessories stores; book, computer, and music stores; electronics and appliances; florists; furniture and home furnishings; general merchandise stores; health and personal care stores; hobby, office supplies, stationery and gift stores; specialty stores; sporting goods; and used merchandise stores. Drive-through establishment: The use of a portion of a structure where business is transacted, or is capable of being transacted, directly with customers located in a motor vehicle. The term drive-through establishment shall include, but not be limited to, providing food or beverage service, bank service, and/or film processing. Broadway Avenue, Ste. 201, Meridian, ID 83642 Phone: 208-884-5533 Fax: 208-888-6854 www.meridiancity.org • File: CUP-99-034 – In September 2000, a Conational Use Permit for a Walgreens with a drive-through window was approved. • File: CZC-00-015 – In March 2000, a Certificate of Zoning Compliance was approved for the Walgreens. • The site was not approved as a Planned Unit Development and is not located in any special, restrictive, or overlay district. • The proposed use is considered a conforming use and complies with the applicable zoning regulations. • In the event of a casualty, an approved Conditional Use Permit, Certificate of Zoning Compliance, and Design Review are required to rebuild the structure in its current form. • To the best of my knowledge the site does not have any legal non-conforming issues, nor any building or zoning violations. • Documents regarding the subject property are available through a records request at the Meridian City Clerk’s Office. Staff’s failure to cite specific provisions of the Unified Development Code, or existing conditions of approval associated with the subject property, does not relieve the Applicant of responsibility for compliance.
