As representative for Pole Creek Properties, Inc. and the Belhaven Subdivision (AZ-07-011 & PP-07-016), please
accept the following comments regarding the staff report for the December 20, 2007 public hearing. The
applicant has been working with your staff since the October 4th hearing, and we believe that most of the issues
have been resolved. With the exception of the two items listed below, the applicant is in agreement with the
proposed content within the staff report, including conditions of approval. Since the main issues associated with
the tabling were in reference to the existing septic system drain field and the existing trees on the tree farm,
please consider the following:
1. For clarification, the applicant has a separate contract with the neighboring property owners (Poorman's)
that includes the Poorman's retaining ownership of all existing trees on the subject property, and the
applicants commitment to connecting the Poorman's to City Services, when necessary. This may or may
not occur prior to final platting, however, as conditioned, the existing drain field located on the subject
property will be removed prior to final plat.
2. Staff has included Condition 1.2.2 of Exhibit B regarding the retention of 4 mature trees on Lots 1-3 Block 2
and Lots 1-4 Block 1. As stated above, as well as in past discussions, the mature trees are owned by the
neighboring property owner. While the applicant is in complete agreement to preserve as many mature
trees as possible throughout the property, please understand that the ultimate decision on the trees is that
of the Poorman's, and the applicant does not want to be held to a condition that is out of his control. The
applicant will agree that if the 4 mature trees are not retained, he will mitigate those 4 trees with a
reasonable replacement. A suggested replacement could be six (6) 2" caliper trees per each of the four
mature tree removed.
