Dear City Staff,
This letter is in support of the attached Variance Application for Lot 1, Block 3 in the
Bear Creek Subdivision No. 1. Specifically, we are requesting a variance from the
determination the above lot does not meet the 80-foot frontage requirement in an R-4
zone. According to our professional surveyor, the City required the final plat indicate a
specific lot frontage direction. This requirement was apparently based on staff' s
interpretation that lot frontage should be measured to the mid-point of the comer chord.
As measured, the lot frontage is less than 80-feet-wide. Therefore, the City determined
the house should front on the opposite side. If measured at the setback, the lot width
exceeds the 80-foot minimum, thereby eliminating the need for a special lot designation
and allowing a standard house to be built on the lot (see attached plan).
In accordance with Variance application checklist, the following statements are provided:
5. We require a variance to the ordinance requiring 80 foot frontage, as measured by
staff, in an R-4 zone
6. The lot has the required frontage if measured at the building setback. If ordinance
compliance cannot be interpreted as such, a variance will be required.
7. As measured by staff, the lot frontage at the mid-point of the comer chord is 70
feet. At the endpoint of the corner chord, the width is 82 feet. If ordinance
compliance cannot be interpreted as such, a variance for 70 foot lot frontage will
be required.
8. The hardship is a non-standard entry will be required that is not in conformance
with other homes in the vicinity and is not desirable in the market.
9. We feel the ordinance is not clearly defined to permit a clear interpretation.
Based on a previous interpretation by Staff, the final plat was required to have a
notation that prevents the Building Department from issuing a permit for the
attached site plan.
10. The described lot is the only lot on the final plat with a debatable lot frontage
notation.
11. Staffs interpretation of this ordinance will deprive us the right to build a home
with a typical entry that meets all setback and other requirements.
12. Although the final plat was filed at our request with the debatable notation several
months ago, we feel the notation was erroneously required on the final plat. As
such, the variance is not a result of our action.
13. Granting of this application will not confer us any other special privileges that is
denied to other structures in the area. The structure will meet all setback
requirements in conformance with City ordinances.
14. Granting of this application will allow us to build a standard house with a
standard entry in conformance with other homes in the area and not cause an
undue market disadvantage to the builder.
15. The proposed variance is not in disagreement with the intent of the Meridian
Comprehensive Plan. The publics welfare and safety are not jeopardized by the
granting of this variance request.
