I have testified multiple times in opposition in various forums and am frustrated that legislative duties that: 1. The situation continues to arise after multiple denials, and 2. Legislative duties preclude me from being able to testify again in person this evening. The last time I sat in on a Meridian P&Z hearing the dialogue centered around what I believe to be somewhat frivolous issues, like the materials the houses would be made of. Please allow me to clearly point out... again... what I believe as the REAL SERIOUS issues: THIS DEVELOPMENT DOES NOT FIT IN THE AREA FOR WHICH IT IS PROPOSED. This is a rural area. The proposed development is DENSE housing. THE INFRASTRUCTURE IS NOT IN PLACE TO ACCOMMODATE THIS DEVELOPMENT. You may also recall that I pointed out at a previous meeting the conflict in Idaho code (50-222 vs. 67-6526) regarding annexation outside areas of impact. As of this writing this issue is NOT resolved. However, I am sponsoring HB545 which would eliminate this conflict in code effective July 1, 2008. This bill has passed the House and awaits a hearing in the Senate. It is my belief that if and until this bill (or one similar) passes, you STILL have a legal issue at hand. I am trying to help you with eliminating the conflict in code. On behalf of myself and family (which are neighboring landowners) and myle ask you to implement wise planning, which would dicttateaNOT ereccommendingconstitusthisthis typeaofa I density in such a rural area. Please communicate this message to your fellow P & Z members. Thank you for your consideration. Russ Fulcher State Senator 1
