I. DECISION
The Director approved the applicant's request for a two-year time extension until November 6,
2023 to obtain the City Engineer’s signature on the final plat.
II. STAFF ANALYSIS
The combined preliminary/final plat (PFP H-2019-0086) consisting of four (4) residential
building lots and four (4) common lots on 1.4 acres of land in the R-4 zoning district for Nick
Estates Subdivision was approved by City Council on November 6, 2019.
The Applicant requests approval of a two-year time extension in order to obtain the City
Engineer’s signature on the final plat. The applicant needs more time to complete the required
development improvements prior to obtaining the City Engineer’s signature on the final plat.
With all extensions, the Director may require the final plat to comply with current provisions of
this title. Staff is not recommending any additional conditions of approval for this extension and
recommends approval of the proposed two-year time extension on the combined preliminary/final
plat set to expire on November 6, 2023.
III. CONDITIONS OF APPROVAL
A. Applicant shall meet all terms of the approved combined preliminary/final plat PFP
H-2019-0086) approved for this site.
B. The applicant shall obtain the City Engineer’s signature on the final plat by
November 6, 2023 in accord with UDC 11-6B-7 in order for the combined
preliminary/final plat to remain valid; or another time extension may be requested.
IV. CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director.
All requests for review shall be filed in writing with the Planning Division on or before
November 27, 2021, within fifteen (15) days after the written decision is issued, and include the
information listed in UDC 11-5A-7B. If City Council review of the decision is not requested, the
action of the Director represents a final decision on a land use application.

The property owner has the right to request a regulatory taking analysis under Idaho Code 67-
8003. Such request must be in writing, and must be filed with the City Clerk not more than
twenty-eight (28) days after the final decision concerning the matter at issue. A request for a
regulatory takings analysis will toll the time period within which a Petition for Judicial Review
may be filed.
