To Whom It May Concern:
We are pleased to submit, on behalf of our client, the enclosed application and supporting
materials for vacation of easements. The proposed Cabella Creek Subdivision is a
resubdivision of Lots 3, 4, 5 & 6 Block 1 of Kachina Estates Subdivision (a recorded
subdivision on file in Book 35 of Plats at pages 3016 and 3017, records of Ada County and
Instrument Number 905969) situated in a portion of the Southeast 1 /4 of Section 19,
Township 3 North, Range 1 East, Boise Meridian, City of Meridian, Ada County, Idaho,
more particularly located northeast of the intersection of Victory Road and Mesa Way. The
resubdivision will create 47 buildable lots on approximately 19 acres.
Prior to recordation of the final plat for Cabella Creek Subdivision, easements created on
Lots 3, 4, 5 & 6 Block 1 within the Kachina Estates Subdivision must first be vacated. The
easements requested to be vacated include 10-ft utility easements for public utilities,
irrigation and drainage, a 25-ft future road easement and a 15-ft farm access easement.
10-ft Utility Easements for Public Utilities, Irrigation and Drainage
10-ft utility easements for public utilities, irrigation and drainage were created adjacent to the
subdivision boundary, interior lot lines, public rights -of -way and easements on Lots 3, 4, 5 &
6 Block 1 as shown on the enclosed Kachina Estates plat and Exhibit `B". Please find
enclosed letters of relinquishment from Idaho Power Company, Qwest, Cable One,
Intermountain Gas and Nampa Meridian Irrigation District.
25-ft Future Road Easement
A 25-ft future road easements was created adjacent to the northern lot line of Lot 6 Block 1
as shown on the enclosed Kachina Estates plat and Exhibit `B". Please find enclosed a
letter of relinquishment from the property owner, ATM Development.
15-ft Farm Access Easement
A 15-ft farm access easements adjacent to the northerly easement line of the Ten Mile Creek
within Lots 3 & 4 Block 1 as shown on the enclosed Kachina Estates plat and Exhibit `B".
Please find enclosed a letter of relinquishment from the property owner, ATM
Development.

The proposed recent division of Lot 3, 4, 5 & 6 of Block 1 of Kachina Estates Subdivision is
being proposed as a re -subdivision which will create forty-seven (47) build able lots (on
approximately 19 acres) to be known as Cabella Creek. Nampa & Meridian Irrigation District
has no objections to this re -subdivision or the relinquishment of the easement as new
easements will be created within this new forty-seven (47) build able lot area..
Nampa & Meridian Irrigation District has a PUIS Contract in place with Kachina Estates
therefore all new and necessary easements have been granted to the District.

Partial Release of Easement
WHEREAS, by subdivision plat recorded in Plat Book 35, at Page 3016 through Page 3017 on
November 15, 1974, as Instrument Number 905969, in the records of Ada County, State of Idaho, Kachina
Estates Subdivision, granted to IDAHO POWER COMPANY an easement (the 'Basement,,) for the
constriction, operation and maintenance of certain power line facilities upon the following premises located in
Ada County, State of Idaho, to -wit:
Kachina Estates Subdivision — A parcel land generally located within a portion of the SE%, of Section
19, Township 3 North, Range 1 East, B.M., Ada County, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the Easement be
retained.
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY does hereby
release and abandon that certain portion of the Easement over the following described lands:
The 10, ft public utility easement on each side of the shared common lot line of Lots 3, 4, 5 and 6, Block
1, Katchina Estates. The 10 ft public utility easement on the east side of Lot 6, Block 1, Katchina Estates. And
the 10-ft public utility easement on the exterior boundary of Lots 5 and 6, Block 1, that run contigious with and
parallel to Mesa Way along the 10 ft public utility easement on the north boundary of Lot 6, Block 1 that runs
contiguous with and parallel to the future road easement. And also the 10 fl public utility easement on the south
exterior boundary of Lots 3, 4 and 5 Block 1 of Kachina Estates Subdivision that runs contiguous with and
parallel to Victory Road. All of those release and abandon rights are more clearly depicted in the attached
Exhibit `A ".
ALL RIGHTS and privileges under the above -described document in and to the remaining lands
covered by the Easement and any and all prescriptive or other rights the Grantee has acquired through
occupancy anti use over time of said remaining lands shall remain and continue in the Grantee and shall not be
affected in any way hereby.

Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
