October 12, 2007 Meridian City Planning Department 660 East Watertower, Suite 202 Meridian, ID 83642 Re: Development Agreement Modification — Bridgetower Crossing To Whom It May Concern: On behalf of Primeland Investment Group, LLC and Primeland Development Company, LLP; we are submitting this request to modify the development agreement governing the Bridgetower Crossing Subdivision. The details associated with this request are outlined below: Primeland Investment Group, LLC and Primeland Development Company, LLP are the current owners of the property which is being affected by the proposed modification. They are the successors to the original parties to the agreement. 2. The original development agreement was approved by the City of Meridian on November 2, 2001. 3. The original development agreement was recorded on November 8, 2001 as instrument number 101117652. We would like to modify the development agreement so that the area which was planned for office and commercial uses can be subdivided into smaller lots. We are not proposing to increase the office and commercial areas, but only proposing that smaller lots be authorized for these approved office and commercial areas. The development agreement allows for a total of 15 commercial lots and 8 office lots. The commercial areas are located on the east side of Ten Mile Road both north and south of McMillan Road. The office uses are along the east side of Ten Mile Road, south of the commercial uses and at the southwest corner of Linder and McMillan Roads. We are not proposing that any of these areas be altered for their originally -intended use. We would only like to subdivide these areas into lots that are smaller than the lots that were originally anticipated. All of the property was annexed in 2001 with the Planned Development (PD) application and is zoned R-4. Location The subject lots are located southwest of the McMillan Road and Linder Road intersection, Section 35, Township 4N, Range 1 W. The property consists of lots 15-17, block 36 of Bridgetower Crossing Sub. No. 11 and lots 43-45 block 32 of Bridgetower Crossing Sub. No. 12. Current Owners of Record There is one property owner of the lots within the boundariies of this plat. Primeland Investment Group, LLc is the owner of the property and has submitted the notarized consent for this application. Site Design The applicant is proposing twelve total lots on 10.21 acres. The property will be served by two proposed public roads, one off of McMillan Road and the other off of Linder Road. The public road off of McMillan Road will be 29 feet narrowing to 25 feet wide and will have curb and gutter. The road off of Linder Road will be 29 feet wide and will have curb, gutter and sidewalk. These public roads will be built to ACHD standards. There are existing water and sewer services to the proposs�d lots; therefore there will be no need for additional services at this time. Pressure irrigation currently runs around the property boundary. However, another pressure irrigation line will be constructed along the proposed road off of Linder Road to serve the ten foot landscape area along the proposed road. Overland Boise, ID 83705 RE: Groundwater information for Bridgetower #15 You called today and requested any information we had available for the approximately 20- acre Bridgetower Crossing #15 located at the southwest corner of McMillan Road and Linder Road. The parcel is the East '/2 of the Northeast '/4 of the Northeast '/4 of Section 35, Township 4 North, Range 1 West, Boise Meridian, Ada County, Idaho. A map is attached showing the approximate boundary of Phase 15 along with the location of three test holes located on or near this parcel. Groundwater monitor data was collected on three test holes near and on this site in 2002, 2003 and 2004. A copy of all water table measurement data is attached. The peak water table measurements for each of the three test holes are shown on the attached map. Depth to groundwater ranges from 80 to 122 inches at the three locations. The two years of data are quite similar and I would suggest you use the values shown on the map for design purposes. This portion of the Bridgetower Crossing project has always displayed deeper groundwater levels than those areas to the west and south.
