Re: Design Review Application Denial APPEAL, for Commercial Tire Store & Fleet Service
Center, at 100 West Pennwood Street.
Dear Ms. Canning:
This letter is requesting a formal APPEAL, of your denial, of the Design Review Application for
Commercial Tire, at 100 W. Pennwood Street. As you know, since the project shares a side with
Meridian Road, it is required to have Design Review Approval, as Meridian Road is an entryway
corridor; however the project's main frontage is Pennwood Street.
Your denial is based on a single element of the project. It is clear that we comply with
requirements and intent of the Unified Development Code, including 11-13A-19, STRUCTURES
SUBJECT TO DESIGN STANDARDS.
Your denial reads: "The proposed east elevation depicts five roll -up doors (vehicle bays)
constructed of prefabricated steel panels and windows. UDC 11-3A-19C2 prohibits steel panels
except as materials." As you should know 11-13A 19C2 reads, "Color and materials: Exterior
building walls shall demonstrate the appearance of high -quality materials of stone, brick, wood or
other native materials. Acceptable materials include tinted or textured masonry block, textured
architectural coated concrete panels, tinted or textured masonry block, or stucco or stucco -like
synthetic materials. Smooth -faced concrete block, tilt -up concrete panels, or prefabricated steel
panels are prohibited except as accent materials".
We believe that we comply with the requirements and intent of the Unified Development Code,
including 11-13A-19, STRUCTURES SUBJECT TO DESIGN STANDARDS.
Your denial interprets the overhead doors in the project to be prefinished metal and therefore does
not meet the desired material standards for walls along Meridian Road. An OVERHEAD DOOR is
not an EXTERIOR BUILDING WALL, it is only a component of the building, and no notation in
the Unified Development Code states that overhead doors are prohibited. We have also offered to
modify the doors to be glass panels without metal infill panels.
Your denial letter further states: "The applicant has verbally proposed roll -up doors with all
windows to meet the required standard. However, I am concerned the doors will be up and open a
majority of the day and will not meet the intent of UDC 11-3A-19A7,"
As you know this UDC item reads as follows: "To create attractive and quality designed structures
reflecting the unique character of Meridian along the City's entryway corridors." This has nothing
to do with overhead doors and approved uses in the C-G District.
The Commercial Tire project is located in a C-G zone and is clearly an allowed use as are the
following:

• Vehicle repair, minor.
• Vehicle sales, rental and service
• Vehicle washing facilities
• Fuel sales facilities
• Building material, garden equipment and supplies
Each of these uses would include buildings with overhead doors. If it is the intent of the zone
regulations to not have overhead doors facing Meridian Road it seems that the individuals
responsible for adoption of the ordinance would have clearly stated that or at least not allowed uses
that would have overhead doors likely visible from the road.
Also note that under 11-4-3.38 Vehicle Repair, there is no item prohibiting overhead doors in
Design Review areas, including gateway corridors.
Our firm has been present at numerous meetings with the Planning Department regarding this
project including 2 pre -application meetings for the project. In both pre -application meetings, I
brought plans for the proposed tire store that clearly illustrated the use of the building and use of
overhead doors. You and your planning staff have had multiple opportunities to address this issue
and for whatever reason have decided now was the right time express your opinion by denying our
application. Our CZC Application was submitted in October and it took until January 10 to
determine that a Design Review Application was also required. This application was then
submitted 2 days later. It then took over 2 weeks for you to inform me that you were considering
denying the application. I then requested that we meet, which occurred yesterday. In the meeting,
we were able to resolve a couple of minor issues, related to the Meridian Street elevation. You
refused to approve the application due to our building having overhead doors facing Meridian
Road, which is a common building element on Meridian Road and Main Street.
In closing I think it important to note that Commercial Tire made a significant economic
commitment to the City of Meridian when they relocated their corporate headquarters and
warehouse to Meridian several years ago. It is disturbing that you would find personal
interpretations of your zoning ordinance to negatively impact a business committed to the
economic growth of your community.
We appreciate your consideration of our appeal request and look forward to a positive and
expedient resolution. Please contact our office at 338-1413 if you have any questions or need
