Watertower, Ste 202 Meridian, Idaho 83642 Re: Paramount Phase 13 Setback Vacation Application Dear Ms. Canning: This letter fulfills the requirement of a narrative fully describing the proposed change to this Paramount planned unit development approved the reduced setback on the Paramount #13's Final Plat and reason for this Vacation Application and submittal. The CUP for loadedts. loall o The City's PWD increased requirement of the 20' setback is in direct conflict with Paaded to s approved CUP. We understand that this setback distance is in response to DEQ's best management practices (BMPs). If drainage or high water tables were a problem in Paramount we would understand the BMP being imposed as a requirement, but the water table in Paramount is very deep and there exists free drainage strata to percolate surface and ground water. We have not experienced raised water tables in and around ACHD storm drain facilities and seepage beds. Therefore, to impose a BMP as a requirement is unnecessary. The implications of the City's PWD imposed 20' setback requirements on the alley loaded residential lots of Phase 13 from seepage beds to building foundations placed in the rear of the lots has no direct implication to the buildable area and future building layouts due to the already 20' garage setback. However, implications of the imposed 20' setback to fronts of the lots 4 — 7 and 11 — 13, block 34 defeats the alley loaded residential concept for these lots. This phase of the development is carefully planned and scripted. House plans have already been designed around the setbacks approved in the CUP. Requiring a 20' setback in the front would have a devastating impact on the aesthetics and the viability of the plat. We are asking the City to vacate the depicted 20' setback on the front of lots 4 — 7 and 11 —13 of block 34 on the P#13 final plat and remove foot note 12 striking through the wording "THE FRONT OF LOTS 4 — 7 AND 11 — 13, BLOCK 34" as depicted on the attached final plat showing the proposed modifications.
