The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department within fifteen (15) days after the written decision is issued, and include the information listed in UDC 11-5A-7B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. The property owner has the right to request a regulatory taking analysis under Idaho Code 67- 8003. Such request must be in wrng, and must be filed with the City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. A request for a regulatory takings analysis will toll the time period within which a Petition for Judicial Review may be filed. Thank you for contributing to the success of Meridian. APPLICATION SUMMARY >WIE R AN,,, IDAI'' The applicant, KGA Development, requests approval of a six (6) month time extension in order to obtain the City Engineer's signature on the final plat for the 43 North Subdivision (H-2017-0119). The plat consists of 21 building lots and 4 common lots on 1.81 acres of land in the R45 zoning district. The Applicant has received Final Acceptance from the City Engineer and has processed all required warranty surety agreements with the City of Meridian Land Development Department and Public Works Department, see Exhibit B. II. STAFF RECONiIYlI;NDATION Staff recommends approval of a six (6) month time extension as requested in order to obtain the City Engineer's signature on the final plat for 43 North Subdivision to expire on June 5, 2019. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located at 1318 NE 4th Street, in the NW '/4 of Section 7, Township 3 North, Range 1 East. B. HISTORY OF PREVIOUS ACTIONS • In 2000, the property was rezoned from R-8 and 1\.-15 to entirely R-15 (lkz-, -001, Ordinance #865). • On January 5"', 2016, a new preliminary plat (H-2016-0090) was approved consisting of 21 building lots and 4 common lots on 1.81 acres of land in the R-15 district. See Exhibit A.2. • On September Sty', 2017, a final plat (H-2017-0119) was approved consisting of 21 building lots and 4 common lots on 1.81 acres of land in the R-15 district. See Exhibit A.3. V. UNIFIED DEVELOPMENT CODE Per UDC 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on a final plat within two years of the approval of the preliminary plat. Upon written request and filing by the applicant prior to the termination of the allowed time period, the Director may authorize a single extension of time to obtain the City Engineer's signature on the final plat not to exceed two years. Additional time extensions up to two years as determined and approved by the City Council may be granted. With all extensions, the Director or City Council may require the plat to comply with current provisions of the UDC. VI. STAFF ANALYSIS This is the first time extension requested on the subject final plat. Approval of the subject time extension will allow the applicant to proceed with the platting process for this phase of development. If the subject time extension is not granted, the preliminary plat will expire and a new application will be required. Since the preliminary plat for this project was approved, there have not been any code changes that would necessitate new conditions being placed on this approval. Therefore, staff recommends approval of the applicant's request without any new conditions of approval; the applicant is still required to comply with all previous conditions of approval for this project. Daisy Creek Street Meridian, ID 83680 Meridian, ID 83642 RE Forty -Three North Subdivision -- Final Acceptance Dear Mr. Adams: Installation of this project's sanitary sewer andlor domestic water systems has been satisfactorily completed in accordance with the approved plans, These systems have passed the required testing in accordance with City of Meridian Standard Specifications and Drawings, and therefore are hereby accepted by the City for ownership and normal maintenance. Record drawings submitted to us for this project are also accepted and are being forwarded to the Idaho Department of Environmental Quality. The engineer of record is responsible for certification of the record drawings as to horizontal and vertical location of all public water and sewer facilities installed. In accordance with the City of Meridian's Unified Development Code §11-5C-3, and the City of Meridian's Supplemental Specifications and Drawings to the Idaho Standards for Public Works Construction, Current Edition, the installation and materials of the sewer and domestic water systems are to be warranted against defect by the owner for a period of two -years from the date of this letter.
