SPACE ABOVE THIS LINE FOR RECORDER'S USE ONLY
GRANTOR, Hill & Hill Properties LP, an Idaho limited partnership, does hereby
REMISE, RELEASE and forever CONVEY, unto GRANTEE Martin L. Hill, an unmarried
individual, whose current address is 3625 E Amity Road, Meridian, Idaho 83642, and to
Grantees' successors and assigns, all of Grantors' right, title and interest in and to the
real property situated in Ada County, Idaho, more particularly described as follows:
SEE SCHEDULE I attached hereto and incorporated herein.
TOGETHER with all mineral, oil, natural gas, water and other rights running with
the land, as well as all rights, tenements, hereditaments and appurtenances there unto
belonging.
SUBJECT to all encumbrances, easements, reservations of oil, gas, and
minerals, all present and subsequent years' taxes, levies and assessments, all rights
reserved in federal patents and state deeds or in acts authorizing the issuance thereof,
all building and zoning regulations and ordinances of any governmental unit, and all
encroachments, overlaps, boundary line disputes, and any other matters which would
be disclosed by an accurate survey or inspection of the premises including, but not
limited to, insufficient or impaired access or matters contradictory to any survey plat
shown by the public records, and other matters of record running with said land.
And Grantor and his successors and assigns shall and will warrant and by these
presents forever defend the premises in the quiet and peaceable possession of
Grantees, Grantees' successors and assigns, against Grantor and his successors and
assigns and against all and every person or persons whomsoever, lawfully claiming the
same. However, the foregoing warranties and obligations to defend are limited to the

extent Grantor has title insurance coverage or is entitled to claim coverage by any
predecessor in interest of Grantor, if any, and to the extent such claims and expenses
are covered by such title insurance or are actually recovered from such predecessor in
interest, net of any costs of recovery, including attorney fees and costs. In no event
shall Grantor incur any liability to Grantees, or Grantees' successors or assigns, for
liabilities, costs or expenses not covered by title insurance, if any, for amounts which
exceed any such title insurance coverage, if any, or are actually recovered from any
predecessor in interest, net of any costs of recovery, including attorney fees and costs.

North, Range 1 East, Boise Meridian, Ada County, Idaho, and being more particularly described as

Commencing at a found aluminum cap monument marking the Northwest corner of said Section 33,
which bears N89015'22"W a distance of 2,660.62 feet from a found brass cap marking the North 1/4
corner of said Section 33, thence following the westerly line of said Section 33, S00'13'13"W a distance
of 591.38 feet to a point being the POINT OF BEGINNING.
Thence leaving said westerly line, 589'46470E a distance of 31.99 feet to a found 5/8-inch rebar on the
easterly right-of-way line of S. Eagle Road;
Thence following said easterly right-of-way line the following courses:
