APPLICATION SUMMARY The Applicant, CS2, LLC, requests approval of a modification to the landscape plan approved by City Council with the final plat of Creason Creek No. 2. The proposed changes consist of incorporating more landscaping and walking paths into the boundary of phase 2 in order to receive City Engineer’s signature. II. SUMMARY RECOMMENDATION Staff recommends approval of the requested modifications to the final plat landscape plan in accord with the condition of approval in Exhibit D. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located near the southeast corner of N. Linder Road and W. Ustick Road, in the NW ¼ of Section 1, Township 3N., Range 1W. HISTORY OF PREVIOUS ACTIONS:  In October of 2015 the subject property received annexation and preliminary plat approval for fifty-one (51) Building Lots and eight (8) common lots on 15.75 Acres of land (AZ-15-009; PP- 15-014; ALT-15-020; and DA Instrument #2016-019362).  In 2016 Council approved the first phase (H-2016-0022) consisting of thirty-four (34) single- family residential building lots and 6 common lots on 8.72 acres of land in an R-8 zoning district and a modification to the development agreement that was denied on September 13, 2016 (H- 2016-0087) .  In June of 2018, the Council approved the final plat for the second phase, which included 13 single-family residential building lots and 2 common lots on 3.78 acres of land in the existing R-8 zoning district (H-2018-0037). Page 2  In January of 2020, the Council approved a modification to the final plat to increase the area of Lot 11, Block 1 and expand the subdivision boundary to include more open space and less buildable lots (H-2019-0139). V. STAFF ANALYSIS The applicant is proposing to modify the landscape plan approved with of Creason Creek No. 2 (yet to be recorded) to include additional landscaping and walking paths proposed with the development of Phase 3 as shown on Exhibit B. The modification is desired so the applicant can obtain City Engineer’s signature on Phase 2. In reviewing the previous approvals for this development, the recorded development agreement tied the development of this property to a specific amount of open space and site amenities. To ensure the site develops consistently with the recorded DA, staff recommended that the applicant incorporate the required open space and additional amenity into Phase 2 of the development. Staff notes that plat is not being modified at this time to include the open space as a common lot. In discussions with the applicant, he does plan on submitting a third phase which will include two more buildable lots and include the additional open space area as a common lot to be maintained by the Creason Creek HOA. In summary, Staff believes incorporating the additional open space and amenities in this boundary complies with the requirements of the recorded development agreement. To ensure the improvements are completed with Phase 2, the City has processed a surety which includes the additional open space and site amenity. Therefore, Staff is supportive of the proposed modifications to the landscape plan. VI. EXHIBITS A. Vicinity Map B. Landscape Plan Approved with Final Plat H-2018-0037 (dated: 4/2/18) C. Applicant shall comply with all previous conditions of approval associated with this development except as modified with this approval (AZ-15-009; PP-15-014; ALT-15-020; H-2016-00887; H- 2016-0022; DA Instrument #2016-019362; H-2018-0037; H-2019-0139). 2. With submittal of Phase 3, the applicant shall include the area labeled Phase 3 on the landscape plan as shown on Exhibit B to be included as a common lot to be owned and maintained by the Creason Creek HOA. 3. The landscape improvements for Phase 3 are required to be completed with Phase 2 as depicted on the landscape plan as shown on Exhibit B and maintained by the HOA.
