Landscape Plan Modification Application
Cherry Blossom Place Subdivision

Dear Ms. Allen:
Please accept this letter as the narrative description of the proposed changes to the landscape plan approved for the
Cherry Blossom Subdivision. We are submitting the above referenced application on behalf of our client, Jayo
Development, Inc. Included with this submittal package you will find the recorded warranty deed, the Affidavit of Legal
Interest, the originally approved landscape plan and the proposed landscape plan.
The proposed changes to the landscape plan include modifying the fence type from "open" wrought iron fencing to
"closed" vinyl fencing along 1) the canal on the southern boundary of the property and 2) along the short pathway
extending from N. Parkshire Way to a pathway into the Midtown Square Subdivision. While the original plan shows
wrought iron fencing in these two areas the developer believes that the vinyl fence used elsewhere in the subdivision
is more appropriate than the wrought iron fence and is requesting this modification. The primary fencing type found in
the surrounding neighborhoods is solid wood fencing, a few homes have vinyl fencing.
A review of the Finding
of Facts and Conclusions of
Law for the project did not find
any reference to a public hearing
discussion of the fence
type or location. The fencing
section of the Subdivision Staff
Report says the following:
All fencing should comply with the standards listed in UDC 11-3A-68 and 11-3A-7. A mix of 6-foot tall open and
closed style fencing is depicted on the landscape plan; a detail of the proposed fencing type should be submitted with
the final plat application.
Section UDC 11-3A-6B references Piping of ditches and canals and is not applicable to fencing. Section 11-3A-6C
was not referenced in the staff report but does cover fencing along canals. This section indicates that fencing may not
be required if the ditches or canals are improved as part of the development and considered a water amenity. If
fencing is required, the fence should be a 6-foot open vision. The property developer is requesting an exception to the
open vision fence requirement since they were not specifically addressed during the public hearings and he would like
to provide the privacy fencing typically wanted by homebuyers. It should be noted that all other fencing planned for
this development as well as fencing in the surrounding neighborhoods are solid fence types and the wrought iron
fence is not appropriate for this in -fill project.

Section 11-3A-7 is the UDC Fence section, subsection 11-3A-7A.7b is the regulation for fencing along open spaces
and pathways which grants an exception to installing open vision fencing if the fence is fully visible from a public street
and is no longer than 250 feet. The fence section along the pathway in Cherry Blossom Place Subdivision is
approximately 108 feet long and is visible from Parkshire Way and therefore meets the requirements for an exception
to the open fence requirement.
In summary, we would like to request an exception to the requirement for open vision fencing along the ditch and the
pathway in the Cherry Blossom Place. We believe this change will not be detrimental to the neighborhood and will be
appreciated by the future homeowners of the subdivision. If you have any further questions or comments, please
