Sorry for the delayed response, I was out of town last week.
I, also, saw that the City Code required the open vision fencing along the open space but Doug Jayo
had the impression that he could get approval for the vinyl fencing so I proceeded with the
application at his request. I sent your email below to Jayo Development as soon as I received it but
have not had an opportunity to have a follow up discussion. I will follow up with you regarding the
application soon. I am assuming that the application is on hold until we produce an alternative,
acceptable proposal OR until we withdraw the application. Is that correct?

Mary,
In looking at City Code a little closer in regard to your request for a modification to the LP for the
fencing along the southern boundary of the site, UDC 11-3A-7A.7b requires fencing abutting all
common open space lots not entirely visible from a public street to be an open vision or semi-private
fence up to 6’ in height to provide visibility from adjacent homes or buildings. If closed vision fencing
is used, it can’t exceed 4’ in height but may have an additional 2’ of open vision fencing on top. The
proposed fencing is adjacent to a 5’ wide common area that has an existing fence along the south
side.
This section of code is eligible for Alternative Compliance per UDC 11-5B-5. A request for such is only
allowed when one or more of the conditions noted in UDC 11-5B-5B.2 exist. The process for such is
described in UDC 11-5B-5C.
As-is the requested modification can’t be approved without an alternative compliance application
that addresses the above-noted items and provides a compelling reason why the code requirement
should be modified. The concern is that 6’ solid fencing will create a hidden corridor that isn’t visible
from a public street.
