APPLICATION SUMMARY The Applicant, Breckon Land Design, Inc., requests approval of a modification to the landscape plan approved by City Council with the final plat for this project (H-2019-0064). The proposed modification consists of a change to the fencing type along the southern boundary of the buildable lots adjacent to the southern boundary of the subdivision and adjacent to the pathway on Lot 17, Block 2, from 6-foot tall wrought iron to 6-foot tall vinyl. II. SUMMARY RECOMMENDATION For the reasons noted below in Section IV, Staff recommends the Director approve the request for a modification as proposed with the condition of approval listed in Exhibit D. Applicant: Same as Owner D. Representative: Mary Wall, Breckon Land Design, Inc. – 6661 N. Glenwood St., Garden City, ID 83714 E. Applicant's Statement/Justification: See applicant’s narrative for this information. IV. STAFF ANALYSIS Because the fencing along the southern boundary of buildable lots adjacent to the southern boundary of the subdivision is not directly adjacent to an open waterway, the proposed closed vision fencing meets UDC standards; there is an existing fence that is directly adjacent to a user’s ditch on adjacent residential properties to the south that is proposed to remain. A 5-foot wide common lot lies between the two fences for the purpose of preserving a corridor for maintenance of the user ditch that provides irrigation water to the adjacent properties to the south. Because the entire length of the pathway on Lot 17, Block 2 is visible from a public street, the proposed 6-foot tall closed vision fencing meets the standards in UDC 11-3A-7. Therefore, Staff is supportive of the Applicant’s request for a modification to the approved landscape plan as proposed. Page 2 VII. EXHIBITS A. Vicinity Map B.
