Broadway Avenue Meridian, Idaho 83642 RE: Narrative Letter Alternative Compliance Application, Cherry Blossom Place Subdivision, RZ, PP H-2018-0018 Dear Ms. Allen: Please accept this letter as the narrative description of the proposed changes to the landscape plan approved for the Cherry Blossom Subdivision. We are submitting the above referenced application on behalf of our client, Jayo Development, Inc. Included with this submittal package you will find the recorded warranty deed, the Affidavit of Legal Interest, a signed Development Review Application, the originally approved landscape plan and the proposed landscape plan. The proposed changes to the landscape plan include modifying the fence type from "open" wrought iron fencing to "closed" vinyl fencing along 1) the canal on the southern boundary of the property and 2) along the short pathway extending from N. Parkshire Way to a pathway into the Midtown Square Subdivision. While the original plan shows wrought iron fencing in these two areas the developer believes that the vinyl fence used elsewhere in the subdivision is more appropriate than the wrought iron fence shown in the approved plans and is requesting this modification. The primary fencing type found in the surrounding neighborhoods is solid wood fencing, a few homes have vinyl fencing. Section 11-3A-6C was not referenced in the staff report but does cover fencing along canals. This section indicates that if fencing is required, the fence should be a 6-foot open vision fence. The property developer is requesting an exception to the open vision fence requirement for the following reasons: 1) the concern of creating a hidden corridor that isn't visible from a public street is not valid for this canal corridor since there is little to no fencing on the other side of the canal and 2) the developer would like to provide the privacy fencing typically desired by homebuyers. The proposed 6-foot vinyl fencing will provide privacy for both residents of the development and the neighbors on the other side of the canal. Section 11-3A-7 is the UDC Fence section, subsection 11-3A-7A.7b is the regulation for fencing along open spaces and pathways which grants an exception to installing open vision fencing if the fence is fully visible from a public street and is no longer than 250 feet. The fence section along the pathway in Cherry Blossom Place Subdivision is approximately 108 feet long and is visible from Parkshire Way and therefore meets the requirements for an exception to the open fence requirement. In summary, we would like to request an exception to the requirement for open vision fencing along the ditch and the pathway in the Cherry Blossom Place.
