Boise, ID 83709 RE: Cherry Blossom —Alternative Compliance (A-2020-0 l 87) Dear Mr. Jayo: Mayor Robert E. Simison City Council Members: Treg Bernt Brad Hoaglun Joe Borton Jessica Perreault Luke Cavener Liz Strader This letter is to confirm the Director approved your request for alternative compliance to Unified Development Code (UDC) 11-3A-7A.7 for the fencing adjacent to Common Lot 2, Block 2, based on the required Findings listed in UDC 11-5B-5E, as follows: 1. Strict adherence or application of the requirements are not feasible; or The Director finds strict adherence to the requirements listed in UDC 11-3A. 7A. 7 is feasible but would require removal of the existing 6 foot tall closed vision fence constructed by the Developer adjacent to the common area on Lot 2, Block 2. 2. ides an equal or superior means for meeting the The alternative compliance prov requirements; alld The Director finds the alternative means of compliance (i. e. a 6-foot tall closed vision fence) provides an equal means fof° meeting the equiement as the neighbors pefe a closed vision rather than an open vision fence for privacy and much of the area is open to the south of the common area for visibility of the area. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. The Director finds the alternative means will not be materially detrimental to the public welfare o impair the residential uses and chaacte of suounding p^opeNties as the proposed closed vision fence provides desired privacy to adjacent residential properties while much of the area is still visible from adjacent properties. The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before October 23, 2020, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-6B.
