Subject: Request for an Alternative Compliance for the fence on the south side of
Cherry Blossom Place
I am asking to keep the solid six-foot vinyl fence presently installed. I believe condition
applies to my request.
• This five-foot common lot behind the fence was created so that a fence could be
erected on the five-foot setback. Parts of the property line are actually in the ditch.
It wasn't practical to move the open ditch off my property. The neighbors abutting
the ditch have tiled part of the ditch as well as built sheds etc. that encroached onto
my property. It was easier for everyone involved to create a five-foot common lot
and move the fence five feet from the property line.
• The neighbors wanted me to put a six-foot solid fence in to protect their privacy.
• The neighbors do not want an open fence that can be seen through for obvious
privacy concerns. The neighbors all irrigate out of the ditch and want the ditch on
their side of the property left open for accessibility.
• This is an infill project, because this is an infill there are neighbors that have been
there for many years and unfortunately, as in my case, encroached onto my
property. I'm trying as a developer to work with the neighbors and not create
conflict. This is the reason I created the common lot.
• Approval of the fence will keep the neighbors happy and also make the new owners
in Cherry Blossom Place better neighbors with a full privacy fence.
• The common lot is not open to a public area and therefore I am asking you to
approve this request.
