Application for Preliminary Plat
Settlers -Square Subdivision — Narrative
This application is for a Preliminary Plat for a 9.35 +/- acre parcel located on the northwest corner of Venable
and Ustick (870 W. Ustick Rd) in Meridian Idaho. The proposed name of this subdivision is "Settler's -Square
Subdivision". This subdivision name has been approved and is on hold through the County Surveyor's office.
The current land use includes a home on the easterly -most portion (1.33 acres) with the rest as vacant land
(8.37 acres). The property is identified in the City of Meridians Comprehensive Plan as a Commercial
Neighborhood Center.
An Annexation Application for this property is also being submitted to the City of Meridian. Prior to annexation
the property was zoned as Rural -Urban Transition Zone (RUT -Ada County designation). The
annexation/rezone designation request is to Commercial/Community business district (C-C).
Settlers -Square Subdivision is intended to be a gathering place providing pedestrian -friendly neighborhood
commercial services. Settlers -Square Subdivision, when fully developed will contain a mix of retail stores,
financial services, restaurants, general offices, medical offices, day care and related service uses.
The project will be tied together through common architectural building design, landscaping, street fixtures,
architectural highlights and pathways. On -street parking has been added for pedestrian convenience and to
promote a casual neighborhood atmosphere.
Each building will be united through common sidewalks, areas for outdoor seating and landscaping (21 % of
the site). None of these buildings will exceed the 20,000 sq. ft. maximum as shown below in Table 1, and will
comply with all local and state codes and standards including, but not limited to: fire, signage, height, setback,
spacing, landscaping, illumination, irrigation, traffic, storm water integration and maximum background area.
All necessary permits will be obtained prior to commencement of work and total build -out is estimated at
90,000 SF.

The landscaping for this project will be of professional design and quality. A landscaped median is planned
for the entrance of West Ustick Roan and street lighting is planned to enhance the visual appeal and address
safety. We will be requesting an alternative compliance for the landscaping. Please see the Alternative
Compliance Application for details.
Access points for this subdivision will be on the east (Venable Lane) and south (Ustick Road) sides of the
subdivision. These are both public streets. The Ustick access will line up with the access across the street in
the Crossfield Subdivision. All streets will be public and the names will be determined at a later date. A stub
street will be provided on the north side of the property for future access and connectivity.
Amenities will include stamped decorative concrete and professionally landscaped islands to provide a high
quality, visually appealing surrounding for the clients and customers.
Notices were sent out on July 5, 2007 for a neighborhood meeting which was held on July 19th 2007 from
5:30 — 6:30 on site (copy enclosed). The mailing list was obtained from public records from the Assessors
Office (copy enclosed).
The purpose of this neighborhood meeting was to discuss and listen to any feedback or concerns from the
surrounding property owners. Representatives for Settler's Square were on site for the entire hour. However,
no residents showed up with any comments or concerns. Therefore, no sign in sheet is available but a copy
of the notification letter and the notification -area list is included in this application.
Water for Settlers -Square Subdivision will be serviced by the city water system. Irrigation will be provided by
a pressurized irrigation system. Storm -water runoff will be retained on site.

The specific requirements that are proposed to be modified in the Alternative Compliance Agreement include
the following:
1. Instead of the 10' street landscape buffer we propose to place 5' of landscaping from the right-of-way
to the back of the curb. Based on the fact that there will be on -street parking the need for additional
sidewalks to provide interconnectivity is not needed.
2. Additional landscaping will be provided in common lots.
3. Landscaping will also be provided in islands within the parking lot and along certain drive isle to
provide shade and an aesthetic quality and help to direct and guide the flow of traffic.
4. The placement of the landscaping in this manner will serve to provide a more pedestrian friendly
environment and provide shade for the cars using the on -street parking.
5. Street trees — the parameter of the property will meet the minimum required density of one tree per 35
linear feet.

NOTE: Just prior to submission of this application we noticed an irregularity in the measurement of the linear
foot measurement on the landscape plan. The Landscape Architect company was notified, however, the
architect who prepared the plan is out of town. We will work with him upon his return to provide the City of
Meridian an amended and accurate plan as soon as possible.

SETTLERS SQUARE - PROJECT DESCRIPTION
The proposed development will be named Settlers Square. Settlers Square is comprised
of approximately 9.35 acres of undeveloped property located on the Northwest Corner
of West Ustick Road and Venable Lane. The property is currently divided into two tax
parcels; one parcel has an old farm house with pasture and the other parcel is unused.
The property is identified in the City of Meridians Comprehensive Plan as a Commercial
Neighborhood Center. It is the applicants request to be annexed into the City of
Meridian, to have the zoning changed from RUT to Commercial (C-C) and to subdivide
the property into 11 separate tax lots tied together with common covenants, conditions
and restrictions. Total build -out is estimated at 90,000 SF. The property will be
serviced by city water and sewer.

Central to the development of Settlers Square is the creation of a "sense of place". The
commercial center's mix of tenants is intended to compliment the lifestyles of the
surrounding neighborhoods and support the recreational activities associated with the
newly completed Settlers Park. In addition to providing much needed local commercial
services; Settlers Square will become a meeting place throughout the day and into the
night as people stop by for a bite to eat, purchase necessary items or find other local
services in a convenient and friendly place. Ustick Road will act as the main connector
to Settlers Square assuring local businesses steady stream of consumer traffic at a
relaxed and managed pace.
The tenant makeup will consist of traditional retail services, specialty shops, boutique
business, restaurants, day care and small professional offices. The targeted tenants will
match the local market demands. The entire project is intended to compliment the
neighborhood, provide a local gathering place and a quality professional atmosphere for
businesses to succeed.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) I1-5A-5D, the applicant for all applications requiring a • public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall. post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC I 1-5A-5.

RE: Projected groundwater levels on Settler's Square site
You requested information on groundwater levels that might be expected on the
above referenced property. Your parcel is the Southeast %4 of the Southeast 1/4
of the Southwest 1/4 of Section 36, Township 4 North, Range 1 West, Boise
Meridian, Ada County, Idaho. Associated Earth Sciences has groundwater
monitor data that was collected in 2004 through 2006 on a series of test holes
just across Ustick Road south of this property. A map is attached showing the
relative location of your 10 acres to those test holes.
On the map you will note that test holes 1-04, 6-04, 7-05 and 8-05 are in the
closest proximity to the Settler's Square property. Peak measured groundwater
levels from the 2005 and 2006 data for those four locations are shown in the
following table as groundwater elevations.

At this point in the development of your project I suggest you utilize an
assumed peak groundwater elevation of 2572 to 2573 feet. Irrigation on or
around your parcel could have an impact on groundwater levels. Irrigation and
Settler's Square groundwa*-N level —page 2
drain ditches on the property may also influence water tables. As you move
forward with the investigative process you will need to excavate and evaluate
test holes on the site to determine soil layers present. You will also want to
conduct groundwater monitoring to collect site specific data.
