Variance Application
Dear Ms. Canning:
This project is located at the southwest corner of Ustick and Eagle Road. The
preliminary plat for this project was approved on July 18, 2006. We are currently
preparing construction documents for our on- and off -site improvements, and our final
plat for submittal. In laying out the details of the off -site widening on Eagle Road, it has
been determined that the Idaho Transportation Department (ITD) has up to 26' of surplus
right-of-way (ROW). ITD has stated that their long-term plans do not call for utilizing
the surplus ROW.
We respectfully request a variance to landscape this surplus right-of-way and to decrease
our on -site landscape setback along Eagle Road from 35' to 20'. This will clean up the
gravel and weeds in the ITD ROW and will enhance the roadway and the entrance to our
shopping center.
The requested variance shall not grant a special right or privilege since the project on the
northwest corner of this intersection was granted the exact same landscape variance on
June 22, 2006. Additionally, the 35' landscape buffer which the City requires, except in
some areas of deceleration lanes, will be provided.
The variance relieves an undue hardship of having to maintain the surplus ROW in
addition to the project on -site landscaping.
The proposed accesses will not be detrimental to the public health, safety, and welfare.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing

1.5. No Payments of Individual Obligations: The Members shall use the Company's credit and assets
solely for the benefit of the Company. No asset of the Company shall be transferred or encumbered
for or in payment of any individual obligation of a Member.
1.6. Title to Property: All real and personal property owned by the Company shall be owned by the
Company as an entity and no Member shall have any ownership interest in such property in the
Member's individual name or right, and each Member's interest in the Company shall be personal
property for all purposes.
1.7. Term: The term of the Company shall commence on the Effective Date and shall have perpetual
existence or exist until such time as the winding up and liquidation of the Company and its
business is completed following a Liquidating Event, as provided below, whichever occurs first.

2.1. List of Members; Initial Capital Contributions: The names, addresses, membership interest and
initial Capital Contributions, of each of the Initial Members are set forth in Exhibit A to this

current Member. The Members, upon execution of this Agreement, shall make Capital
Contributions in the amount listed on Exhibit A. The dollar amount noted in Exhibit A as the
contributing Member's contribution constitutes the value, which all Members agree and
acknowledge to be the fair market value of the contributed properties or property interest as of the
date of contribution.
