This is in response to your phone call regarding a letter received from Jim Jewett today reportedly about
the sewer situation on Southridge. On behalf of RMR Consulting and Shepherd's Creek LLC, we are
not privy to the letter nor do we know or represent the positions that may or may not be stated in the
letter. We submitted the Proposed Cooperative Construction and Reimbursement Agreement on June 21
as a means to get the 55 lots of Shepherd Creek moving forward in a timely fashion. In that process,
RMR Consulting prepared bid documents, administered the bid opening, compiled the reimbursement
numbers in accordance with your ordinance, and communicated with you, Jim Jewett, and Greg Johnson
to craft a proposal that all parties might support and take forward to City Council for their concurrence.
We understand your concurrence was not yet obtained for moving forward to City Council and a date
for a hearing not yet set, but we were hopeful that it would come soon after your talking to the City
Council liason as you communicated in our last e-mail. However, according to your phone call this
afternoon, a letter from Mr. Jim Jewett's counsel today regarding the 21" sewer line, a line not relating to
the serviceability of Shepherd Creek, but included in the Oversizing Request at Mr. Jewett's request, was
received today that would require all future communication to go through the City Attorney. (see CC on
Mr. Nary)
In our opinion, our proposal for construction and reimbursement of these facilities could still be looked
on favorably by Council, however, we are not confident that it will get resolved in a timely fashion that
was the intent of our efforts this last 30 days to get the Shepherd Creek project moving forward with
onsite construction by now. I hope you agree that when the final plat condition last fall on Shepherd
Creek for bypassing the Bear Creek Lift Station was put in the conditions of approval, it was everyone's
belief and hope that the trunk line would be built by now, and that it was never intended that Shepherd
Creek LLC go to these lengths to facilitate the construction, and certainly not be put in the precarious
position of the apparent legal negotiations on a sewer line not directly related to our project. We remain
committed to doing everything we can to facilitate the timely construction and serviceability of
Shepherd Creek. We believe our current proposal will be a win -win in terms of getting a very expensive
master -planned sewer facility installed soon with the best possible price for all parties involved.
Please let us know when and if Council will let us present our proposal to them soon. Thanks
