Per Ordinance Section I1-9-604-F, the Council approval of the Preliminary Development Plan shall become null and void if the applicant fails to submit the Final Development Plan within one (1) year of Council approval of the Preliminary Development Plan. Upon written request to the Council and filed by the applicant prior to the termination of the said one (1) year period as stated in Section 11-9-604-F.1 of this Ordinance, the Council may authorize a single extension of the approval of the Preliminary Development Plan for a period not to exceed one (1) year from the end of the said one (1) year period. The fee for an extension request is $100.00. In the event that the development of the preliminary plat is made in successive contiguous segments in an orderly and reasonable manner, and conforms substantially to the approved preliminary plat, such segments, if submitted within successive intervals of one (1) year, may be considered for final approval without resubmission for preliminary plat approval. (File# TE-05-014) We have reviewed this submittal and offer the following comments: APPLICATION SUMMARY The applicant, Landmark Engineering & Planning, Inc., has requested approval of an 18 month time extension to submit the final plat for Cairns Crossing Subdivision. The preliminary plat consisted of 11 commercial building lots on 9 acres in a proposed C-C zone. The preliminary plat (PP-04-072) was approved by City Council on November 23, 2004 and expired on November 23, 2005. As required by MCC 12-3-6B, the applicant submitted a request for a time extension prior to the expiration of the preliminary plat. The applicant states that the reason for the delay in submitting the final plat is that the anchor tenant that was originally planned for the development fell through and without a commitment from another tenant it was not financially feasible to move forward with the subdivision as planned. The applicant further states that negotiations with a prospective tenant are currently underway and they intend to submit the final plat within the next 18 months. For this reason, they are unable to meet the time requirements specified in Meridian City Code 12-3-6 under which the preliminary plat was approved. The City of Meridian's new Unified Development Code (UDC 11-6B-7C) allows the Director to authorize a single extension of time to record the final plat, not to exceed 18 months, when the applicant files a written request for an extension prior to the expiration of the plat, which the,applicanthas done. As mentioned above, the applicant is requesting an 18 month time extension. The City Council may consider additional time extensions up to 18 months through a public hearing process. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). Staff believes that there are no additional site specific conditions that should be added to those approved by the City Council with the preliminary plat for this subdivision. However, please note that the applicant was required to enter into a development agreement prior to rezoning the property. The applicant has not completed the development agreement nor has the property been rezoned. LOCATION The property is located on the south side of W. Cherry Lane approximately % mile east of N. Linder Road, in the NW '/4 of Section 12, T.3N., R 1 W. STAFF RECOMMENDATION Staff recommends approval of an 18 month time extension from the date of expiration to submit the final plat for Cairns Crossing Subdivision, to expire on May 23, 2007 with one condition as follows: Applicant shall have six months to execute the development agreement and rezone the property as required by RZ-04-011. Cairns Crossing received preliminary plat approval from the City of Meridian on November 23, 2004. The preliminary plat approval will expire November 24'h 2005. The project has been delayed because the anchor tenant originally planned for Cairns Crossing fell through several months ago. Exhibit A Item 4.13: The developer is generally in agreement with the recommended staff condition for inclusion in the Development Agreement. We request that the development agreement condition read: All Cherry Lane facing building elevations on Lots 1, 2, 3, 4, and 5, Block 1 (lots adjacent to Cherry Lane) shall have at least 40% glass and floors above the main floor shall have a minimum of 20% glass. Also, on the aforementioned lots, one or more of the following shall be incorporated into all building walls facing Cherry Lane: awnings, modulatedlarticulated walls, parapets, eave overhangs or similar design features. Exhibit B Item 14: The required emergency and pedestrian access is proposed with a twenty foot (20') wide access gate for emergency services and two (2) five foot (5') wide pedestrian openings (see attached conceptual exhibit). Due to the fact that the 13th Ave. street section is approximately 37 ft. wide (back of curb to back of curb), there will be segments of six foot (6') tall vinyl fencing on either side of the gate so that the pedestrian openings in the fencing align with the existing sidewalks. The conceptual exhibit could be attached to the development agreement to illustrate the proposed emergency and pedestrian access. The developer and I have discussed the design of the access with Meridian staff including Anna Canning, Brad Hawkins -Clark, Joe Silva, and Kenny Bowers on various occasions. In a meeting today between the developer and Planning Director Anna Powell, as well as phone conversation between me and Fire Chief Kenny Bowers, we understand that the proposed conceptual access plan is acceptable to Meridian staff. The exact design details will be coordinated with staff with the preparation of construction drawings for the project. Preliminary Plat Site Specific Condition No. 16 indicated that alternative compliance must be granted for the landscape buffers proposed in easements rather than common areas. The landscape buffer easements meet the landscape ordinance requirements for width. Further, the easements will be maintained by the business owners association for uniformity in maintenance. The landscape easements are requested due to the probability of a New Urbanism design concept for buildings located near Cherry Lane. Various buildings will likely be located adjacent to the landscape buffer with parking generally located south of these buildings. If the landscape area were in common lots, building code restrictions may not reasonably allow for the location of a building wall along the lot line adjoining the landscape common lot. However, with a landscape easement, then the building code restrictions are alleviated along the landscape buffer area. The proposed landscape buffer easements meet the ordinance requirements in all applications with the exception of being located in easements rather than common lots. The planner, Clinton E. Boyle and the developer, John Stubblefield have met with me regarding the proposal. The business park appears to be an acceptable use of the property; however there are issues with the proposed access points. Due to the extremely heavy traffic on Cherry Lane and the number of patrons using the center lane to access the library, the Library Board of Trustees is requesting that no access points to the business park be placed directly across from the library. However, if it is determined by Planning & Zoning and the Highway District that an access point is necessary in that area, the Board is requesting that it be lined up evenly with the east entrance of the library rather than off -set as in the current proposal.
