Development Agreement Modification
Project Name: The Tree Farm

Narrative
Interest in Original Development Agreement:
Treehaven, LLC is the developer of The Tree Farm, which has been approved by the City
Council for annexation and zoning of 362.65 acres located north of Chinden Boulevard,
directly west of Spurwing Country Club (AZ 06-004). The original Development
Agreement was approved by Meridian City Council on September 12, 2006 and recorded
with Ada County on September 21, 2006 (Instrument No. 106151218).
Purpose of Modification:
Upon submittal of the original application for the annexation and zoning of the
development property, it was understood that the land uses and designation of proposed
zoning was conceptual and subject to changes as necessary upon platting of the
development area. The zoning boundary lines were originally drawn to align with the
future roads in the development. The preliminary engineering work has been done and
there are various areas where the boundary lines do not exactly match. Applicant has
submitted its preliminary plat (PP-06-0058) and did receive approval from ACHD
(January 24, 2007) and Planning and Zoning Commission (February 1, 2007).
Therefore, at this time Applicant requests the necessary changes to the initial proposed
zoning boundaries and submits revisions to the legal descriptions at this time to reflect
the revised zoning boundary changes. The initial zoning areas as approved with the
concept plan and Development Agreement remain consistent. The requested boundary
changes are also consistent with Staff and City's legal council recommendations. Please
see Exhibit C2 (as attached) for exact location and clarification.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
