Watertower Meridian, ID 83642 RE: Planned Sign Program Charles Story, In regards to our phone call on March 2nd I would like to give further information about the sign program as it relates to your property. Enclosed is the approved sign program for Cherry Crossing Shopping Center as submitted by Hawkins Companies the developer of the Cherry Crossing commercial subdivision. The planning department brought it to my attention that businesses located in your building have not applied for sign permits for their wall signs. The Primeamerica business has a wall sign preventing other businesses from posting their wall sign above their entrances. (See Photo) In order to comply with the Meridian Planned Sign program each of the businesses need to apply for a sign permit prior to construction. I am requesting you contact the Meridian Planning Department regarding the sign standards for your subdivision and follow their--ecommendations. The planners, Jennifer Veatch or Kristy Vigil are cognizant of your situation and can assist you in coming into compliance. They can be reached at phone number 884-5533. This letter outlines my review and approval notes of the Planned Sign Program. The number and types of approved signage are as follows: Center / Commercial Signs (the larger signs on Chevy Lane and N. Linder Road) • Total # of allowed Center/Commercial type signs = 2 (one on Cherry and one on Linder) • Golden West Advertising is applying for both (2) of these signs with the Planned Sign Permit and both are approved by P&Z. Single Building Signs (the smaller signs to identify each individual building in the proiecfl • Total # of allowed Single Building type signs = 4 • Golden West is only applying for two of these signs right now. The two remaining signs will require separate sign permit applications. • Each of the future signs must be in conformance with the design approved under this Planned Sign Program. Wall Signs • No wall signs have been applied for or are approved at this time. Sign Setbacks The setbacks for the Center Sign(s) are approved as shown on the Site Plan. The Chevy Crossing Center Sign(s) meets the minimum one foot setback on the front property line and five-foot setback on the side property fine. 0 Page 4 Cherry Crossing Shopping Center Sign Standards This criteria has been established for the mutual benefit for all tenants. Conformance will be strictly enforced and any non -conforming or unapproved signs must be removed or brought into conformance at expense of tenant. A. GENERAL APPROVAL REQUIEMENTS: 1. Tenant shall submit or cause to be submitted to the landlord for approval before fabrication, at least three copies of detailed colored drawings indicating Ideation, layout, design and color of. the proposed signs, including all lettering and/ of graphics with complete specifications and dimensions. 2. All permits for Tenant's signs and their installation shall be obtainedby the Tenant or his representative and shall conform to all local building and electrical codes as well as the criteria set forth hereafter. 3. All signs shall be designed, constructed and installed at Tenant's expense: 4. Tenant shall be required to fiilfiil. all the requirements bf these criteria. B. PAD SITES: 1. Trademarked logos will be exempted from sign standard height restrictions given that it still complies with city code and is approved by landlord C. No exposed conduit, brackets, fasteners or wiring of any type will be permitted. 4. Exterior signs shall be individual pan channel letters installed directly to wall. Sculptured channel cabinet signs will be allowed only upon written approval from landlord No raceways permitted. a. All illumination shall be UL approved and have sign company's identification amp load and UL sticker in legible view from ground. 5. Total sign length shall not exceed 75% of tenant's linear feet of leased frontage up to a letter height of 36". 6. , Total square footage of wail signs. not to exceed 9% of the wall elevation. D. MLSCELANEOUS REQUIREMENTS: 1. Tenant shall be responsible for the operations of Tenants sign contractors. Tenant and sign contractor will be liable for any actions committed during installation or service of signage. 2. Tenant or his representative shall be responsible foz cost of maintenance, service, repair or replacement of Tenant's sign, time clock or electrical wiring. b. Tenant shall be required to keep his sign.in working order and all surfaces shall be maintained in good condition. 3. Cherry Lane 100 Meridian ID 83642 Dear Mr. and Mrs. Todd Mendel, I have been contacted by the City of Meridian Code Enforcement concerning the signage at 1640 West Cherry Lane, Meridian, Idaho. They have indicated that all the current signs on the outside of the building have not been approved by the city. The companies which made and/or installed the signs know there is a permitting process and should have followed it. We could be required to remove the signage and/or relocate it. The city is now requiring a signage plan be approved immediately. If the firm that built and installed your signage did not get city approval for your sign you will need to contact them at start this process and get their approval. Ths will need to be handled ultimately as a approved signage plan for the complete building. If your company would be interested in doing so, please have them contact me. I received another call from Jennifer Veatch and this matter is still not settled. I will be contacting Golden West Advertising (or a professional sign company) which had the intial sign program approved for Cherry Crossing to get a approved sign plan for our building. It has come to my attention that no permits were taken out to place any signs on said building. In order to come within complicance with the City of Meridian said signs must be approved through the sign program I will explain to the sign company that I agreed to the signs in this order and design: 1. Evergreens signs were agreed and approved by me 2. Primerica was agreed and approved by me. 3. BIBS signage was never agreed upon at the time of lease signing. I have since paid for and had install the two electrical boxes (Cost of $1400) for signage to be installed which too was not approved by the City. Now I know why landlords stay away form getting involved with signage. Lesson learned. The final sign or signage shall have the approval of the building owner and city. G Do to the fact no signs have obtained any approval from the City they maybe all subject to change�� in order to come within complaince. We will be coming within complaince. I will have the sign representive contact you in the order previous outlined to get us within complaince. Any change or cost to come within complaince shall be the cost of the tenants. As per our lease agreement and verbal agreement : I or Stormer LLC didn't install and/ or obtaining any signs or approvals to put signs on said property from the City of Meridian. I have agreed to the signs and location of those signs in place for Evergreen Chiropractic and Primerica. As a property owner I feel that I have some right has to the location of those signs which are on the building now. I have three tenants Evergreen has 3250 sq. ft. and Primerica has 2500 sq. ft. and 750 sq. ft. for BIBS. This is also the order in which I Ieased and negotiate the signage as well with said tenants. BIBS was not to have any signage on the front of the building where Pimerica is now located, which they knew at the time of signing their lease. In the event Primerica can remain in their current location, I will work with BIBS for a sign just to the left of the center area. Primerica will come in and obtain sign permit. It has been submitted to the City of Meridian for approval. It should be approved within a couple of days. At that time Primerica will have to get their sign approved. Then and only then will I approve any other signs on the exterior of the building (BIBS). I'm sorry that the signs had not been approved by the City, but now they will have to be. I have attached the latest letter to the City of Meridian. Hopefully this will be the end of it. All signs must have my approval first before submitting to the City.
