SUBJECT: Notice to BCI of Meridian Planning & Zoning and City Council Meetings
BCI has no record of receiving notice of the May 17, 2007 meeting of the Meridian
Planning and Zoning Commission. at which the application filed by Stanley Consultants
regarding annexation, zoning and preliminary plat approval requests for Pinebridge were
originally scheduled to be heard but were continued.
BCI did not receive notice for any of the following meetings of the Meridian Panning and
Zoning Commission including the meetings on:
a) June 21, 2007
b) July 19, 2007
c) August 16, 2007 (at which the committee recommended approval of the
application )
BCI first learned of the August 16, 2007 Planning and Zoning meeting and the fact that
the Planning and Zoning Commission had considered and approved Stanley Consultant's
application regarding Pinebridge when we received the mailed notice of the September
18, 2007 meeting of the Meridian City Council for purposes of reviewing and considering
the application by Stanley Consultants. (NOTE: This notice was received on August 28,
2007 but was not opened until September 4 because of the intervening holiday weekend).
BCI acted promptly in taking the following actions when, on August 28, 2007, we first
received actual notice that Meridian Planning and Zoning had met and approved the
Pinebridge application:
a) September 6 --- BCI staff with Dennis Baker (Pinebridge Owner) and
DanTorfin (Project manager). At this meeting it was agreed that Dennis
Baker would request a continuance of the City Council hearing until October
2, 2007 (even though BCI stated that additional time would be necessary for
us to complete our work in preparation for the hearing).
b) September 12 --- Dan Torfin asked that Meridian City Council continue the
September 18 hearing until October 2, 2007. (This extension was confirmed
on September 17). (NOTE: At some point this was continued until October
16, but my notes don't indicate when or at whose request this was done.)

c) September 24 --- BCI staff (and outside legal counsel) met with Meridian
Planning and Zoning staff regarding the Pinebridge project.
d) September 24 --- BCI staff and counsel also met with representatives the Ada
County Highway District.
e) October 5 --- ACHD agreed to have its Traffic Department engineers prepare
some drawings with options acceptable to ACHD and to submit the drawings
to BCI for input and revision. (NOTE: We have not yet received these
drawings).
f) October 10 --- BCI staff met again with Dennis Baker, Dan Torfin, Pat Doby
(traffic engineer), Scott Wonders (Stanley Consultants) and Aaron Charrier
(attorney). At this meeting, and again by phone on October 11, BCI asked
that the Meridian City Council hearing be continued to allow us time to
complete our work with ACHD and others prior to the Meridian City
Council hearing.
g) On October 19, 2007 we delivered a letter to the Meridian Mayor and City
Council members and Dave Gratton testified on our behalf at the Meridian
City Council hearing which was ultimately held on October 23, 2007.
