Final Plat
Dear Anna:
We are requesting final plat approval for three (3) commercial lots on approximately 4.52 acres. The site
is located on the North West corner of the McMillan Road and Locust Grove Intersection. The Ada
County Assessor parcel numbers for the site are S0529336205 and 50529336175.
Final Plat
The property has been approved for a preliminary plat for 4 commercial lots, annexed and zoned with a
zoning designation of C-N. At this time the developer is interested in pursuing three (3) buildable lots.
The developer has been contacted by tenants interested in bringing business to this site. Once tenants are
interested in the future unplatted phase, he will follow up by platting the future phase. Due to having
interested clients only in these three (3) lots it is unfeasible to construct the future phase.
The final plat is in accordance with the Preliminary Plat and meets requirements and conditions from the
City. The file numbers for the previous entitlements are CPA-07-014, AZ-07-014, and PP-07-019.
A development agreement has been entered as part of developing these properties. The proposed final
plat complies with the development agreement conditions. Further, any future development for these
resulting lots will comply with the development agreement and Meridian's Unified Development code
and provisions. Further, the final plat complies with all the general conditions of the preliminary plat.
The final plat also is in conformance with acceptable engineering, architectural, and surveying practices.
Items required within the specific conditions of approval are as follows:
Meridian City Council Conditions of Approval
1.2 Place a note on the face of the final plat prohibiting direct lot access to McMillan Road and
Locust Grove Road, except for the full -access driveway to Locust Grove Road located
approximately 360-feet north of McMillan Road.
The note has been placed on the face of the final plat.
1.3 A cross-access/cross-parking easement/agreement shall be recorded for all lots within the
subdivision. All lots within the subdivision shall have access to the access points approved in this
application. This agreement shall be recorded and a copy of said agreement submitted to the City
prior to the City Engineer's signature on the final plat OR a note shall be added to the face of
the final plat granting said cross -access.
Across access and cross parking easement is noted on the face of the final plat and will be
provided to all buildable lots for the property.
1.4 Prior to the City Engineer's signature on the final plat, all existing structures shall be
removed.
1.5 The landscape plan prepared by Harvest Design, P.C., dated 10-29-07, labeled Sheet LS-1
(attached in Exhibit B), is approved with the following notes/changes:
• Provide a minimum 25-foot wide landscape buffer along Locust Grove Road, a 10-foot
wide landscape buffer along Beethoven Avenue, and a 38-foot wide buffer along
McMillan Road as shown on the landscape plan and in accordance with the standards
listed in UDC 11 -3B-7, Landscape Buffers along Streets. NOTE: Add some low-lying
shrubs to the landscape buffers, including within the future Settlers Canal easement
along McMillan Road (as allowed by, Settlers irrigation District. Planting in the canal
easement (other than grass) can be deferred until the Settlers' Canal is relocated.)
• Construct a minimum 20-foot wide land use buffer along the north and east property
lines (not adjacent to Beethoven Avenue). All landscape material shall be installed in
accordance with UDC 1 1-3B-9, Landscape Buffers to Adjoining Uses, and create a
barrier where the trees touch at the time of maturity.
• Per UDC 11-3B-10, the Applicant shall work with the City Arborist, Elroy Huff, on
designing, adopting, and implementing a protection and mitigation plan for the existing
trees on site.
• A written certificate of completion should be prepared by the landscape architect,
designer, or qualified nurseryman responsible for the landscape plan. All standards of
installation should apply as listed in UDC 1 1-3B-14.
Submit revised landscape plans to the Planning Department with the submittal of the final plat
application.
A revised landscape plan has been submitted with the revised changes.
1.6 This subdivision lies within the Settlers' irrigation District. The City of Meridian requires that
pressurized irrigation systems be supplied by a year-round source of water. If a creek or well
source is not available, a single -point connection to the domestic water system shall be required.
If a single -point connection is utilized, the developer shall be responsible for the payment of
assessments for the irrigable landscape areas prior to signature on the final plat by the
Meridian City Engineer.
Pressurized Irrigation will be provided from an existing pump station which utilizes surface
water from Settlers Irrigation District. Meridian City pressurized irrigation will be used as a
secondary source.
1.7 Per UDC 11-3A-6 all irrigation ditches, laterals or canals, exclusive of the relocated Settlers
Canal, that intersect, cross or lie within the area being subdivided shall be covered. Plans will
need to be approved by the appropriate irrigation/drainage district, or lateral users association
(ditch owners), with written approval or non -approval submitted to the Public Works
Department prior to construction plan approval. If lateral users association approval can not be
obtained, alternate plans will be reviewed and approved by the City Engineer.
1.8 All development improvements including water, sewer, fencing, landscaping and pressurized
irrigation shall be installed and approved prior to obtaining Certificates of Occupancy.
1.9 A letter of credit or cash surety in the amount of 110% will be required for all required fencing,
pressurized irrigation, landscaping, sanitary sewer, water, etc., prior to signature of the final plat.
1.10 Applicant shall be required to pay Public Works development plan review and construction
inspection fees, as determined during the plan review process, prior to signature on the final plat
per Resolution 02-3 74.
1.11 Construct a 6-foot tall vinyl fence along the north and east property lines.
The submitted fence plan complies with this condition
All other requests from other approving departments/agencies have been addressed in the Final Plat
and/or construction drawings.
The amenities included with the Final Plat of Woodland Springs are landscaped buffers along the
roadways, street corridors and entryways. A detailed landscape plan attached shows the amenities to this
commercial destination.

Upon consideration of the Petition for Summary Administration of Estate in W
Surviving Spouse is Sole Beneficiary filed by Norma J. Enlow on September hich

Court finds that:
1. The facts set forth in the petition are true.
2. The required notice has been given or waived.
3. The decedent, Charles A. Enlow, died on September 14, 1997, domiciled in Ada
County, Idaho.
4. Venue is proper.
5. The decedent and Norma J. Enlow were duly married on October 26, 1947, at Boise,
Idaho, and remained married until the date of decedent's death.
6. The surviving spouse, Norma J. Enlow, is the sole heir or devisee of the decedent.
7. The decedent died testate, leaving a Will dated December 9, 1993. The Will was validly
executed and is the last Will of the decedent.

8. The schedule of property attached to this Decree is a full and complete inventory of the

1, Norma J. Enlow is the surviving spouse of the decedent and is the sole heir or devisee
of the decedent.
2. The property of the decedent described on the schedule attached to this Decree is
hereby vested in and distributed to Norma J. Enlow free and clear of all right, title, claim,
or demand of any person or persons claiming or attempting to claim under the estate of the
decedent as heir, devisee, or otherwise, except as a proper creditor.
3. The surviving spouse shall assume and be liable for any and all indebtedness that might
