The Idaho Transpoliation Department (ITD) appreciates the opportunity to comment on the above
referenced application.
Per the City of Meridian's February 7,2006 Public Hearing notice (dated January 18, 2006),
regarding the variance application for the Meridian Gateway, a 7 -acre commercial development,
located at the southwest comer of SH-69 and Overland Road;ITD offers the following
comment(s):
. The White-Leasure Development Company has applied for a pennit from lID for two
approaches off of SH-69 into the subject development; one right-in/right-out approach and
one full access approach. At this time, the access permit application has not been approved
or denied by lTD.
. ITD would appreciate any comme~ts the City of Meridian may have regarding the variance
request. As part of lID's permitting process, we informed the developer that approval of the
access application from ITD is contingent upon receiving a variance to the access
restrictions as implemented by the City of Meridian Unified Development Code.

The Idaho Transportation Department has reviewed the application and detennined, that the
access to the development could be developed off of Overland Road and not of off State
Highway. This section of SH-69 has been designated a Principal Arterial Type N. ITD would
like the City of Meridian to help us preserve this conidor by recognizing the following condition.
The access to a Principal Arterial Type N will be on a limited basis. ITD would like County and
the City of Meridian to help us preserve thi~ conidor by recognizing the following conditions.
Building setbacks for future right of way widths will be, A: 120 feet each side of centerline (240
feet total) to include a ITontage road, or B: 70 feet each side of centerline (140 feet total) ifthe
developer provides an internal ITontage road type system to feeder roads.

Dear Mr. Huber,
I apologize for the confusion regarding the above referenced permit application for approaches to
State Highway 69 at the Southwest corner of SH 69 and Overland Road.
The letter sent to you by John Murray, dated September 14, 2005. misstated the status of the
approach permit. The approaches. applied for under permit application number 03-06-083, have not
been approved by the Idaho Transportation Department.
The permit application for the approaches at MP 9.16, 9.13 & 9.09 (dated August 24.2005), was
discussed at a district level permit committee meeting on August 30, 2005. The application was
denied because it did not meet ITD approach spacing policy and the City of Meridian Unified
Development Code (Article H, Development along Federal and State Highways).
In accordance with our procedure, the application has been forwarded to an executive level permit
committee for their action. The executive committee may approve or deny the applicat~on. or may
request more information. There is also a process to appeal the decision of the executive
committee, should you desire.

Thank you for meeting with us to discuss alternative access solutions to your
development on the southwest quadrant of the Meridian Rd. (SH 69) & Overland Rd.
intersection. This letter reiterates our position on your requested access points onto
Meridian Road (SH 69). As indicated during our meeting, we are agreeable to allowing
one interim full access point to be located towards the south end of your property and one
right-in only to the north; which would be in line with previous approach permits of similar
type. The interim full access will remain until such time that highway improvements
eliminate the ability to accommodate one, at which time the access will become right-
in/right-out only. This condition shall be included on the approved development plat.
Construction of right-turn lanes will be required on any approved approach permit to
accommodate right-turning. movements into your development.
At our meeting, you indicated a desire to pursue a right-in/right-out approach in addition to
the interim full access point and that you would provide a Transportation Impact Study
(TIS) analyzing the highway impacts associated with this. If this IS still the case, please
provide a copy of the TIS for our review when it is completed. Attached for your use are
the Departments TIS requirements.
The approval of any access point on SH 69 is contingent on receiving a variance to the
access restrictions in the City of Meridian Unified Development Code, Article H. -
Development along Federal and State Highways. .

Dear Kevin:
This letter shall serve as notice to you that White-Leasure Development Company (Lessee) and William
Howell and Mary Howell (Lessors) request an appeal of the district's decision to deny Permit No. 03-06-
083 SH69. The basis for our appeal is as follows:
A. On September 9, 1977 Mr. Howell applied for and was granted two (2) forty (40) foot approaches
on State Highway 69 (permit #3-77-178, attached hereto as Exhibit A). These approaches are the main
ingress and egress points for a convenience store with gasoline sales and numerous other businesses
including propane sales, produce market sales, overnight tractor trailer parking, sandwich and coffee
kiosks, and other appurtenant uses.
B. In July, 2005 White-Leasure Development Company met with Matt Ward and Kevin Sablan at
the District II offices. We discussed the development of approximately eight (8) acres located at the
southwest comer of Meridian Road SH69) and Overland Road. The property is located at a prime
commercial corner and as stated above has those permitted accesses on Meridian Road (SH69). At that
meeting with staff it was agreed the district would be in favor of the requested right-in right-out access
and two south full accesses as proposed with the understanding that when ITD placed a median barrier or
the access become a safety issue the full accesses would become right-in right-out only. On July 12,2005
White-Leasure Development received a letter clarifying the above (copy of letter is attached hereto as
Exhibit B).
C. On August 24, 2005 White-Leasure Development acting as a representative of William and Mary
Howell subßÙtted an application requesting the three (3) access points (see attached Exhibit C). On
September 6, 2005 White-Leasure Development received a letter (Exhibit D attached) from Kevin Sablan
stating the District would not consider White-Leasure Development's application, The reasongÏ\ren .at
that time ,was that White-Leasure's application ". . . would not meet the City of Meridian Unified
Development Code, Article H". Please note that when the District made the finding regarding Article H
the property was not under the jurisdiction of Meridian and Article H as referenced did not take effect
until September 15, 2005 (see attached Exhibit E).
D. On September 7,2005 White-Leasure Development wrote a letter (see Exhibit F attached) to the
District appealing the District's decision and pointing out that at the time of application the property was
not under the jurisdiction of Meridian and requested that the district process our application. On

September ,14, 2005 White-Leasure received a letter from the. District (see Exhibit G attached) approving
the accesses for construction and noting perffiit #03-06-083. Based on this letter White-Leasure
Development negotiated a major transaction with a national tenant to construct a retail facility on the
property. Any default on the part of White-Leasure Development could result in serious financial
consequences for White-Leasure Development and in turn, the Tenant.
E. On September 21, 2005 White-Leasure Development received a letter (Exhibit H attached) from
the District stating the September 14, 2005 letter approving the approaches misstated the status of the
pennit and the pennit was denied, as it did not meet ITD approach spacing policy and Meridian Unified
Development Code Article H. Again Article H did not become effective until September 15, 2005 and
ITD's letter of approval was dated September 14,2005.
E. There is a new development directly across Meridian Road (SH69) from this property called
Southern Springs and they have just constructed a new full service access onto Meridian Road (SH69).
White-Leasure does not understand why Southern Springs is allowed full access while White-Leasure is
denied full access. ..
White~Leasure Development Company requests the Idaho Transportation Department approve the
approaches as submitted and agreed to by the District.

After a pretiminary review of your proposal for access onto SH 69,-the Idaho
~ran~po~ation Department (at the district level) would be in favor of yo~r requested
nght-m/nght-out access. The fun access would be with the understanding that
when the lTO does a project on the highway placing a median barrier or the access
becomes a safety issue it would become right-in/right-out only.
At this time we have not format\y received a permit appticalion for the above

11-3H-1: PURPOSE: The regulations of this Article are intended to achieve
three purposes: 1) limit acCess points to state highways in order 10 maintain traffic
flow and provide better circulation and safety within the community and for the
traveling public, 2) to preserve right-of-way for future highway expansions, and 3)
design new residential development along state highways to mitigate noise~mpaçts
associated with such roadways.
11~3H-2: APPLICABILITY: The following standards shall apply to all
development along .state highways, including but not limited to state Highway 69.
State Highway 55. State Highway 20-26, and Interstate 84. The following standards
shall also apply to development along McDermott Road from Chinden Boule'Jard to
Interstate 84 as the City of Meridian's preferred location for a future highway right-
at-way for t~e State Highway 16 extension. If the Idaho Transportation Department
(ITD) determines an alternate location for the State Highway 16 extension. these
standards shall apply to the ITO determined location.
11-3H-3: PROCESS': Staff shall review all development applications for
compliance with these standards. The decision making body may consider-and
apply modifications to the standards of this section upõn specific recommendation
of the Idaho Transportation Department.
11-3H-4:
STANDARDS:
A.
Access to 1-84 and McDermott. Road (or future Highway 16 extension): no
access shall be allowed excep~ at specific interchange locations as
e~abli5hed by the Idaho Transportation Department.
Access to State HIghway 69, State Highway 55, and State. Highway 20-26:-
B.
1. Use of existing approaches shall be aJloWed to continue provided that all of
the following ~nditions are met:
a. The existing use is lawful and properly pennltted effective Sep1ember 15.

b. The nature of the use does not change (for example a residential use to
a commercial use). .
c. The intensity of the use does not increase (for example an increase in
the number of residential dwelling units or an increase In the square
footage of commerciöl space). . .
2. If an applicant-proposes- a' change or increase in totensity of use. the
owner shall develop or otherwise acquire access to a street other than the
state highway. The use of the .existing appreach shall cease and the
approach.shall ~e abandoned and removed.
a. No new approaches directly accessing a state highway ghat! be allowed.
b. Public street connections to the state highway shall only be allowed at
I. the section line road; and
it the half-mile mark between section line roads. These half-mile
connecting streets shall be collector roads.
3. The applicant shall construct a street, generally paraHeling the state high,
be designed to accommodate Mure connectivity and -accesS to a1l
properties fronting the state highway that Ue between the applicanfs .
property and the nearest' section line road ancfJor half mile collector road.
The intent is to provide for future connectivity and access to all properties
fronting the state highway thot lie between the applicant's property and the
nearest section line road and/or half-mile collector road. The street shall be
designed to collect and distribute traffic. .
a. The applicant shall be responsible to construct the segment of the street
within the applicant's property. This .standard is not Intended to require
off-site impro'/emen\s.
b. The street shall meet the road standards of the Ada County Highway
District.
c, The street shall connect to the section line road at a distance that Is no
closer than 660 (a::; measured from center line to center line) from the
intersection with the state highway.
d. ¡he street shall provIde buildable lots betWeen the highway and the
collector road. For the purposes of this Article, suc;h streets shall be
termed backage roads,

e. Frontage streets or private streets may be considered by the Council at
the time of property annexation or through the conditional use process.
Frontage streets and priwte sb"eets shall be limited to areas where there
is sufficien\ access to surrounding properties and a public street is not
desirable in that locati(:m.

Design and construction- standards for state highways:
1. The applicant shall have an approved permit from the Idaho Transportation
Department for construction of any access to the state highway and/or any
çonstruction done in the highway rigt¡t of way.
2. .The width of right-of-way reservations shall be as set forth by the lTD.
3. Along State Highway 55, the applicant shall be responsible for constructing
a 1el)-foot (10') multiuse pathway with a public use easement and installing
streetlights and landscaping consistent with the Eagle Road Corridor
Study.
4. Along Highway 69. the applicant shall be responsible for conswcting a
ten-foot (10') multi-use pathway with a public use easement.
D.
Noise abatement for residential uses along state highways:
1. The. applicant st\a\l provide tråffic noise abatement by constructing a berm
or a berm and wall combination appro)(jmate\y parallel to the state
highway. .
2. The top of the berm or berm and wall in combination shall be a minimum of
tan feet (10') higher than the elevation at the centerline of the state
hIghway.
3. If a wall is proposed. the wall shall meet the following standards:
3. Wall materials shall be. impervious concrete or stucco or other
appropriate sound attenuating material.
b. Intermittent breaks in the berm or berm and wall in combination will
degrade the function and shall not be allowed.
c. Th-e appliœntshall not construct a monotonous wall. In order to achi~ve
this standard. the appliCClnt may choose one or both of the following
variations:
i. The color and/or texture of the wall shall be varied every 300
linear feet. This could include murals or artwork.
