Gramercy Townhome Subdivision
Project Narrative
Tuscany Development, Inc., hereby applies for the following:
REZONE FROM R-15 TO TN-R
The applicant is requesting a rezone of 3.66 acres from R-15 to TN-R. The rezone
will accommodate minimum lot sizes of 2,375 square feet and single-family lots
proposed as "live -work" units, uses not permitted outright in the property's current
R-15 zone. A total of 38 units, designed as "live-work"units, would allow residents
to utilize approx. 400-500 square feet on the first floor as an office or studio. In
general, the intended allowable uses will be restricted to professional office (i.e.,
architect, attorney, accountant), studio (i.e., photographer, artist), and specialty retail
(i.e., jeweler, crafts). Uses within the workspace will be restricted by the Covenants,
Conditions & Restrictions (CC&R's) for the development.
PRELIMINARY PLAT
The preliminary plat for Gramercy Townhome Subdivision includes the 38 single-
family "live -work" lots described above. These 38 single-family brownstone units
will be attached, with a minimum lot size of 2,375 square feet and an average lot size
of 3,234.
CONDITIONAL USE PERMIT
The conditional use permit request is for design approval of a total of 69 residential
units on 5.74 acres. Thirty-eight (38) of the units are those contained in the rezone
and preliminary plat mentioned above. The other 31 units will be platted in the
future as condominium units. Elevations and floor plans of both the condominium
and brownstone units are included with these applications. Construction materials
include stucco with brick or stone accents.
The gross and net density of the project is 12.02 dwelling units per acre (all street
right-of-way has been/will be platted in Gramercy Subdivision No. 1, which should
be recorded before the first public hearing of these applications at the Planning &
Zoning Commission). Amenities were provided as part of the original approval of
the project. Those amenities include:
• Donation of Lot 8, Block 3, to the City of Meridian;
• Participation in improving Kiwanis pocket park (Lot 2, Block 4), which will
include an interactive water feature and dog park;
• Multi -use pathways located on the south and west sides of the property; and
• Picnic/bench areas within development (Lot 1, Block 6).
DEVELOPMENT AGREEMENT MODIFICATION
As the current owner/developer of Kenai Subdivision (Gramercy Subdivision),
Tuscany Development would like to request a modification to the original
development agreement of August 14, 2006, recorded on August 14, 2006 as
instrument number 106141056. After discussion with the City of Meridian
Planning Department, it was decided that the original development agreement
should be modified to clarify permitted home occupation uses in the Live/Work
Brownstone units currently proposed for the Gramercy site, as well as to tie the
submitted elevations for the Brownstones and Townhomes to the project.
A zoning classification of TN-R is being requested for the Live/Work Brownstone
units, which are intended to provide space for owner -occupied home occupations
on the first floor level. These homes are intended to conform to section 11-4-3.21
of the City of Meridian Unified Development Code, which outlines requirements
of home occupations. Tuscany Development would like the original development
agreement modified to reflect the intent that these units include owner -occupied
home occupation spaces, as well as clarification of allowable home occupation
uses and uses that are not allowed. The allowed and intended uses will be restricted
to professional office (i.e. architect, attorney, accountant), studio (i.e.
photographer, artist), and specialty retail created on site (i.e., jewelry and/or crafts).
Uses that require special modification of plumbing or mechanical systems in the
home to ensure proper function of the use are not specifically allowed as a "home
occupation".
Due to Gramercy's nature as a mixed -use community, and the fact that a retail
development is a short walk away from the residential portion, heavier uses that
would be more traditionally found in retail developments are not allowed in the
Live/Work Brownstones. Examples of these uses include, but are not limited to,
restaurants or other businesses that require food preparation, beauty salons,
medical office, standard retail, and uses that create high levels of traffic and
customer visits. Future home owners would be required to submit a "Statement of
Compliance For Home Occupation" to the Planning Department to ensure the
intended and allowed use restrictions are met.
The property can be adequately served by essential public facilities and services.
Road improvements will be made in accordance with Ada County Highway
District standards, and impact fees will be paid to Ada County Highway District
with each building lot.
