October 4, 2007 City of Meridian Planning and Zoning Commission and City Council c/o City of Meridian Planning Department 660 E Watertower Street Suite 202 Meridian, Idaho 83642 Re: Castle Rock Subdivision — Annexation, Preliminary Plat, and Planned Unit Development Applications Dear Commissioners and City Council Members: Providence Development Group, LLC is pleased to submit the accompanying annexation, preliminary plat, and planned unit development (PUD) applications for your review and approval. We respectfully request annexation of 224.26 acres to the R-2 and R-8 zones. We also request preliminary plat and planned unit development approval for 848 single family lots and 100 common lots. The development includes 41.3 acres of open space spread between a neighborhood park, village green, linear parks, numerous pocket parks and a major trail way system. This open space totals 22.7% of the propose development area. With the approval of the South East Comprehensive plan amendment last year, and the establishment of the El Dorado and Silverstone business campuses south of the interstate, this area is rapidly transitioning from rural to urban. The Castle Rock community will provide much needed housing to serve the growing business and commercial uses in the near vicinity. Castle Rock will also be connected to the proposed Neighborhood Center designated on the Comprehensive Plan at the corner of Locust Grove and Lake Hazel Roads less than a half mile away. This entire area when developed will contain jobs and housing and be a significant asset to the city of Meridian. Annexation Castle Rock Subdivision is located on the west side of Eagle Road approximately a half mile south of Amity Road. The subject property is within the area proposed to be a part of the City of Meridian's Area of impact and Urban Service Planning Area. The overall annexation area of 224.26 acres includes the 44 existing lots within the Blackrock Subdivision south of Castle Rock. These 44 lots are currently receiving city sewer and water services. The existing 44 lots along with seven additional lots totaling 45.14 acres are proposed with an R-2 zone. This R-2 area will have a gross density of 1.1 units per acre. The remainder of the land, totaling 179.16 acres is proposed to be zoned R-8 and will have a gross density of 4.7 units per acre. These zoning designations and densities are consistent with the most recent Comprehensive Plan designation for this land which is split between Low Density and Medium Density Residential. The density of the proposed preliminary plat is 4.66 units per acre. Special care was taken in the design to ensure that the least dense areas of the proposed preliminary plat were located adjacent to the existing 44 lots, in order to create a buffering between Blackrock and the higher density areas along the central and eastern portions of Castle Rock. The annexation area also includes an area which has been set aside for a city neighborhood park as indicated on the Comprehensive Plan. This neighborhood park was strategically located in the center of the development so that all residents of this community will have equal travel distance to the park. This park is envisioned be completed in the third phase of the development after approximately 400 building permits have been issued on the site. Open space will be provided in each phase to offset the need for the park until a larger number of homes are built in this area. A phasing plan has been included as part of the application package for your reference. Planned Unit Development Due to the innovative design techniques utilized in the Castle Rock community we are requesting that this project be processed as a Planned Unit Development (PUD). The Unified Development Code (UDC) requires PUD's to meet certain criteria to qualify for the flexibility that is allowed through a PUD. These criteria are: l . Preserves natural, scenic and historic features of major importance; 2. Allows for innovative design that creates visually pleasing and cohesive patterns of development (including but not limited to residential development at densities greater than eight (8) units per acre where design guidelines are in place for development and where garage doors are generally not fronting the street); and 3. Creates functionally integrated development that allows for a more efficient and cost effective provision of public services. Natural Features There are three major natural features within the Castle Rock community that will be preserved and enhanced as part of this development. Ten Mile Creek — The Ten Mile Creek runs along the north eastern border of this project. This waterway is listed in the UDC as one of the water features in Meridian that should be preserved and protected. Through this development the Ten Mile Creek will be preserved and enhanced by a regional pathway and generous landscaping to promote walking, biking, and other activities along this important corridor. The generous landscaping is designed to provide a strong landscape buffer to the neighbors to the northeast of the site. Beasley Lateral — The Beasley Lateral also traverses this site connecting from Eagle Road to the northern boundary. As part of this project we are proposing to reroute the Beasley Lateral and leave it uncovered and developed in a more natural state. The area around the water way will be improved with grasses and other forms of landscaping approved by the irrigation district. A pathway will also be provided in this area to allow for Castle Rock residents to walk and enjoy the linear park that will be created adjacent to this waterway. We have met with the irrigation district regarding this proposal and are committed to meeting all of the requirements they have regarding access to the Beasley Lateral. The Ride — Castle Rock Subdivision is located below the prominent ridge which crosses north and west across this section. Much of this neighborhood is located in the shadow of the ridge. This ridge will be improved with natural grasses and other native materials to enhance its aesthetic and strengthen its form. A pathway system will run along the base of the ridge to allow for residents to enjoy the natural habitat and riparian zone that will be created in this area. Innovative Design An entirely new design team was employed to create a unique and inventive layout that emphasizes open. space, interconnectivity, walk -ability, clustering and housing diversity on this site. To achieve this we used an innovative land design technique called "coving" which uses curved streets, varied front setbacks, and increased open space to break up straight rows of houses that are common in more standard subdivisions. To our knowledge this subdivision will be the first large scale example of coving design in the City of Meridian and the entire Treasure Valley. Along with coving we have also integrated an alley loaded traditional neighborhood, organized around a village green, in the design. This traditional neighborhood portion of the project was included to help deemphasize garages and increase the diversity of housing types in the overall development. Another main goal of the overall design was to connect the entire development with a system trails, pathways and open spaces. The trails network provides opportunities for recreation, hiking, biking and walking throughout the entire development linking the pocket parks, neighborhood park, village green and perimeter landscape areas together. Walk -ability within this community will help to promote healthy living and a more active lifestyle. Greater awareness of environment through trail ways will focus on conservation of natural resources, water quality protection, and promote improved air quality, encouraging health and wellness for the residents of the community. Cost Effectiveness and Integration The design techniques and densities described above also help to decrease the length of street required for each unit. This lowers ACHDs' maintenance costs for the roads and provides for more efficient delivery of sewer and water service in this area. All of these savings are passed along to the home buyer and help to make this a more sustainable development in the future. These concepts can be used as an example for the future development in this area which is outlined on the Comprehensive Plan Future Land Use map. Architecture and Dimensional Standards In addition to the new land plan we have carefully considered the input from neighbors and the Council regarding the exterior architecture of our product. After careful review we decided to upgrade our existing product line and create two entirely new product lines that have not been offered before in Meridian. In total three distinct product types will be offered in Castle Rock. The first of the new products is a line of patio homes. These homes were specifically designed so that the living space and entry are emphasized from the street view. In all cases the living space or porch extends to, or beyond, the front plane of the garage. This style of design helps to deemphasize the garage door and create a more pedestrian friendly environment. To further deemphasize the garages in this development we decided to revisit our current alley product and create additional single story units that would help to increase the diversity within our alley loaded neighborhood. The entire alley loaded product was designed with useable front porches and other architectural features that create a distinctive streetscape with a variety of character and setbacks and a unique pedestrian experience. Castle Rock combines architecture and land planning to create a development that is distinctive. In order to achieve this distinction some variation to the requested zoning dimensional standards are necessary. Due to the fact that the development has over 22 percent open space some we are requesting minor reductions in lot sizes and setbacks. These reductions are warranted because so many of the homes in Castle Rock are facing common open spaces. These common areas will provide space for outdoor recreation, walking and relaxation. In essence Castle Rock is an open space focused community with trails, natural areas, and pathways connecting the community together. All of the architectural guidelines and dimensional standards are elaborated upon in the Castle Rock Design Guidelines which accompany the application. The purpose of these Design Guidelines is to outline the overall look and feel of the Castle Rock community and provide the city and future residents with a clear picture of how the community will develop. Open Space and Amenities Open space is a major emphasis within the Castle Rock community. Over twenty-two percent of the total land area has been set aside for common open space areas. The centerpiece for open space is the large neighborhood park that will be donated to the City of Meridian. The other open space features are the linear park adjacent to the Beasley Lateral (which will be left open, and improved), and the village green embedded within the alley loaded product in the south portion of the development. Along with these large open spaces the coving concept also creates clusters of housing that adjoin common open space areas and pocket parks. These pocket parks help to define each cluster of housing as unique villages within the development and allow for each housing unit to be within walking distance of a useable open space linking the entire community. Various amenities such as tot lots, basketball courts, picnic tables, and gathering areas are spread through out the entire community to promote interaction and communication between neighbors and friends. Furthermore a generous landscape buffer is provided around the entire perimeter of the site to create a true sense of community. This landscape buffer will contain a trail system to encourage walking, biking and other pedestrian activities. In addition generous landscaping is provided on both sides of the spine road (Taconic Drive) to provide a landscape buffer to the homeowners adjacent to the spine as well as provide a boulevard appearance. The UDC requires a minimum of ten percent open space for all developments exceeding five acres. The UDC also requires one additional site amenity for each additional 20 acres of development area. Using that standard, Castle Rock is required to contain an additional eight amenities for a development of this size (182.08 acres). The amenities provided with this development greatly exceed the minimum requirements Streets and Intersections As part of the effort to enhance the development, and make it a more pedestrian friendly community, we are proposing various street sections and corner treatments that are not seen in standard subdivision. 24 Foot Paved Sections _We are proposing a 24 foot wide paved street within 42 feet of right-of-way in key locations through out the development. This street section disallows parking on both sides and is only used in areas with no homes fronting the street, in essence creating a boulevard look and feel. Bulb -Outs — In addition to the 24 foot streets we are also requesting ACHD and Fire Department approval for bulb -outs to be used at intersections throughout the development. These bulb -outs are designed to promote safe pedestrian crossings at intersections, provide for traffic calming, and help to prohibit cars from parking near corners. A minimum of 24 feet will be maintained between the bulb -out areas to ensure that emergency vehicles have enough space to maneuver through the development. Although the bulb outs are not drawn on the preliminary plat we have included a detailed bulb -out exhibit to be reviewed with this application. Alleys — Currently the proposed alley loaded product meets both ACHD and city standards for width and street frontage requirements. ACHD is currently reviewing its alley policies, and there is a high possibility that some changes will be made to the policy manual to allow for alley loaded lots to front open space. If these changes occur prior to the submittal of our final plat we request that any new policies in place be available for this project. Along with these unique streets we are providing several traffic solutions for this area of the city. These solutions include: • A future Valley Ride Transit stop to be located on Eagle Road within the first phases of the project; • A signalized intersection with dedicated turn lanes at the entrance to the project; • On site recreational opportunities to help reduce the vehicle trips per day generated by the development for their workforce who would reside at Castle Rock; • The possibility of a shuttle service operated by St. Luke's and other major employers in the near vicinity; • Commitment to work with ACHD on the construction of a signal at the intersection of Eagle and Amity Roads. (HOA), Blackrock, LLC, and The City of Meridian, Idaho (City), to establish a mutual understanding of the duties and responsibilities pertaining to the hookup to City's sewer and water system outside city limits at the Blackrock, LLC as located as shown in Figure 1. WHEREAS, Blackrock, LLC is the sole owner, in law and/or in equity of certain tract of land in the County of Ada, State of Idaho, generally depicted in Figure 1 and commonly known as the Blackrock Subdivision, hereinafter referred to as the Property; and WHEREAS, Idaho Code §50-323, provides and empowers cities to establish, create, develop, maintain and operate Sewer/Water systems; and WHEREAS, City operates and maintains and develops a Sewer/Water system; and WHEREAS, the City has enacted an ordinance governing its Sewer/Water system codified in Meridian City Code § 9-4-26 and 9-1-16; and WHEREAS, the Blackrock, LLC is the owner of the Property, which is presently located outside of the city limits of the City; and WHEREAS, the Blackrock, LLC is desirous of obtaining connection to the Sewer/Water to serve the Property and the City is willing to provide that connection to the Sewer/Water service to the Blackrock, LLC subject to the terms and conditions and consideration of this agreement, and it is specifically agreed that as a specific consideration of the City's willingness to enter into this agreement that the City's Ordinance and Policy/Regulations which govern its Sewer/Water system be included as Blackrock - 1 of 7 terms and conditions of this agreement and that the Blackrock, LLC provide perpetual consent to annexation of the Property in to the City. NOW, THEREFORE, the parties hereby agree as follows: Water Blackrock, LLC will extend a 12" water main from the CITY water system to Blackrock. Blackrock, LLC will be reimbursed according to Meridian Code 9-1-13 Reimbursement Agreements where applicable. The water will feed into a Booster Station building, constructed by Blackrock, LLC and is to meet CITY specifications and approval. The building will be designed and constructed to allow for a future CITY well, which will be constructed by the CITY. The booster station will have SCADA as approved by the CITY and provided by Blackrock, LLC. Additionally, Blackrock, LLC will construct a Pressure Reducing Valve (PRV) at this site, which will meet specifications and approved by the CITY. Blackrock, LLC may use the 2 booster pumps and variable - frequency -drive (VFD) located at Well 14, which are "as -is", provided they are adequate to provide the required flows. Blackrock, LLC is to donate the site to the CITY, which will have a minimum 125'x125' dimension located near the pressure boundary and approved by the CITY. Blackrock, LLC will provide an easement for a future waste line constructed by the CITY from this site to an appropriate drain ditch. Blackrock, LLC will sleeve all road crossings and other appropriate places to minimize future construction costs for the waste line. The Booster Station will have backup power with 24 hr tank capacity for both pumps as approved by the CITY. Blackrock, LLC will construct a water distribution system which will meet CITY standards and will be approved by CITY prior to construction. Blackrock - 2 of 7 CITY will operate the pumping facilities and distribution system. CITY will collect hookup fees and monthly fees for this service. Sewer Lift Station and Pressure Sewer Blackrock, LLC will construct a Lift Station and pressure sewer line which will connect into CITY sewer collection system. The lift station will be owned by the HOA and operated and maintained by Challenger Electric (or equivalent). The pressure sewer will be owned, by the City and the costs for maintenance shall be paid by the Homeowners Association. The lift station will be designed to pump "off peak" to minimize impact to the CITY sewer system. Storage capacity will be approved by CITY and will have odor reducing capability as directed by CITY. Additionally, the HOA and operator will add odor reducing chemicals if CITY determines this is required. The lift station and pressure sewer lines will meet CITY standards and will be approved by CITY prior to construction. Blackrock, LLC will provide bonding and/or other guaranties as required by CITY for future abandonment of the lift station and pressure sewer upon annexation. Blackrock, LLC will provide SCA©A to the WWTP as approved by the CITY. The HOA will pay for maintenance of the lift station and pressure sewer. Blackrock - 3 of 7 ... Sewer Lines Blackrock, LLC will construct the sewer collection system which will meet CITY standards and be approved by CITY prior to construction. CITY will operate the collection system and will collect hookup and maintenance fees. Inspection CITY will inspect construction of all utilities to ensure that they meet CITY specifications. Blackrock, LLC will pay for all overtime which may be required for this service. Annexation At such time as the property becomes legally eligible for annexation into the City, Blackrock, LLC or by any successor or successors agree to give consent to annexation, to pay the annexation application fee, apply for annexation, and diligently pursue annexation into the City. Agreement to Negotiate to Final Agreement The parties contemplate that further negotiations will take place regarding the subject matter of this agreement and that parties will execute a more detailed Final Agreement containing additional details and provisions.
