RE: Gardner-Ahlquist Gateway Subdivision — Landscaping Variance
Dear Planner:
Gardner-Ahlquist Development, represented by Pamela Hall with Timberline Surveying, is
requesting variance approval for a landscaping exception to utilize the Idaho Transportation
Department's (ITD) surplus right-of-way (ROW) along Eagle Road (between Franklin Road and
the proposed extension of Louise Drive) to satisfy the City of Meridian's 35-foot landscaping
buffer requirement.
On September 11, 2007, the Meridian City Council heard the applicant's request for final plat. At
that time, the Council became aware of the applicant's intent to utilize the ITD's right-of-way for
landscaping. The Council then modified a plat condition of approval to require the applicant to
submit for a variance to allow as such.
Therefore, we are pleased to provide to you the justifications for the Gardner-Ahlquist Gateway
Subdivision variance request, as required by the City of Meridian. Per City Code, the applicant
shall find adequate evidence showing that the use at the proposed location:
A. The variance shall not grant a right or special privilege that is not otherwise allowed in
the district; OR
We believe that the City's desire is to provide and appealing 35-foot landscape buffer
along entryway corridors such as Eagle Road / SH 55. As our landscape plan shows, we
propose meeting and exceeding this requirement.
We recognize that the Council will want assurances that the ITD will never expand Eagle
Road, thereby reducing the landscape area. The Council should note that, as Eagle Road
was improved at the Eagle / Franklin intersection just two years ago, further
improvements are not slated to occur at least within the next five years, per the STIP
(Statewide Transportation Improvement Program).

Additionally, per City Code, Meridian requires that surplus right-of-way be landscaped
via a licensing agreement with the ITD if road expansion is not scheduled within the
STIP. As previously mentioned, it is not scheduled. Therefore, because ITD is willing to
enter into such an agreement with the developer to landscape their right-of-way and
because road improvements are not planned, we believe that we should be allowed to
utilize the surplus ROW for our buffer.
B. The variance relieves an undue hardship because of characteristics of the site, and
As apparent in the attached Exhibit, the ITD owns surplus property beyond their ultimate
ROW. Rather than selling this property via auction, the IDT has elected to keep this
property and encouraged the applicant to enter into a license agreement with Gardner-
Ahlquist Development to allow landscaping within said surplus property.
Requiring the full 35-foot buffer to be constructed on the Ahlquist property would create
an unsightly landscape along Eagle Road, as the buffer would jog awkwardly at varying
distances between 40 feet and 100+ feet from the ultimate ITD ROW line.
C. The variance shall not be detrimental to the public health, safety, or welfare.
We believe that granting the variance will not be detrimental to the public. We believe it
will be a benefit to the community in assuring that the surplus ROW will be attractively
landscaped and maintained by Gardner-Ahlquist Development, LLC, and not dependent
upon ITD to be maintained.
We believe that the Gardner-Ahlquist Gateway Subdivision will be a great addition to the SH 55
corridor. Thank you for your consideration in this matter and we look forward to answering any

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment

RE: Vacation of Utility, Drainage, & Irrigation Easements
Dear Planner:
Please accept the enclosed application and supporting materials for vacation of easements. The
proposed Gardner-Ahlquist Gateway development is a re -subdivision of the majority of the
Montvue Park Subdivision (a recorded subdivision on file in Book 17 of Plats, Pages 1107 —
1108, Records of Ada County). The development is located southeast of the intersection of Eagle
Road and Franklin Road. The re -subdivision will create 13 buildable lots and 4 other (common,
access, etc.) lots.
Prior to recordation of the final plat for Gardner-Ahlquist Gateway No.I Subdivision and
Gardner-Ahlquist Gateway South Subdivision, easements created on Lots 1-5 & 8-9, Block 1;
Lot 1, Block 2; Lots 1-2, Block 3; Lots 1-3, Block 4; and Lots 1 & 3-10, Block 5, must first be
vacated. The easements requested to be vacated include 6-foot easements for public utilities at all
side and rear lot lines, and at 25-foot irrigation and drainage easement (see attachment and
Montvue Park plat for clarification).
Please find enclosed letters of relinquishment from Idaho Power, Qwest, Cable One,
Intermountain Gas, and the Nampa & Meridian Irrigation District. We look forward to meeting
with the Meridian City Council to discuss this vacation application. If you have any questions, or

Qwest currently has two privately granted easements within the above subdivision that will require

that will need to be covered by new grants to Qwest from the owner of record of the new development.

Dear Ms. Hall:
Ada County Highway District recently contacted me regarding your firm's petition to
vacate Montvue Drive in exchange for a relocated roadway on the above mentioned
subdivision site. You contacted me about the possibility of releasing utility rights that
affect the above -mentioned subdivision. It is my understanding your client has purchased
all of lots within the Montvue Park Subdivision. As you know, Idaho Power Company
(IPC) has for many years provided electrical service into all of those houses built within
the Montvue Park subdivision.
I do understand your firm is seeking approval of two preliminary plans for mixed
commercial uses on your client's property. I believe these two planned commercial
subdivisions are tentatively called Gateway Subdivision No. 1 and No. 2.
I think there has been at least one meeting with IPC's Distribution Designers to discuss
the removal of electrical devices. However, I don't believe there has been any meeting(s)
set to discuss the possible electrical load for these proposed commercial development.
Since IPC does not have enough specific information about the proposed new

statements below are general and may or may not affect the new construction at the
above -mentioned site.
1. IPC still has electrical service into the Montvue Park Subdivision; IPC can not
disconnect service to existing customers except under certain circumstances, such
as line removal, relocation (for a limited time) or non-payment of account, etc.
2. IPC does not want to discourage nor hinder these potentially new subdivision(s).
You may use this Letter of Intent as confirmation that I shall work with your firm
to remove platted utility rights, release easement(s) rights and/or vacate roadways.
However, IPC needs to protect its rights to those existing electrical facilities until
those devices are actually removed, relocated or more clearly defined. It may
necessary to release those utility rights in incremental steps over a period of time.

3. It is also possible that some of IPC's electrical devises may remain in place or it
may be necessary to rerouted the electrical service, then much later on, reconnect
the service back through these potential subdivisions.
4. Most of those electrical facilities that affect your client's property are overhead
poles, aerial lines and electrical devices. Most of these poles, aerial lines, devices
and/or street lights run parallel with and contiguous to the public rights of way of
Montvue Drive. IPC' needs to maintain continuity of electrical service for its
customers in that area. IPC expects to work cooperatively with the professionals
at Timberline Surveying, or any other professional(s) firm(s), contractors and/or
subcontractors in order to accomplish your client's development plans.
5. Assuming those preliminary plans are approved, then Owner and/or its appointed
agent(s) will need to set up a meeting with one of IPC's Distribution Designers to
begin the design review phase of these proposed subdivision(s).
6. All work performed by IPC to provide new service or relocate existing service
and facilities will be performed in accordance with the filed tariff s, specifically
Rule "H", which governs new service attachments, line installations and
alterations for distribution lines.
7. Only IPC or its' contractors may construct, install, remove and/or relocate all or
portion of IPC's electrical facilities regardless if those facilities are located within
the public right of way corridor and/or within the proposed commercial
development site.
8. If necessary, IPC may expect or ask Timberline Surveying or any other firm
representing the property owner to provide IPC with the preliminary plat and/or
specific work products such as legal description Exhibit(s). All Exhibit(s) must
bear the engineer's seal and signature. The expenses associated with those work
products are borne by your client.

COMMITMENT OF PROPERTY POSTING
