December 15, 2006 Honorable Mayor and Meridian City Council City of Meridian 33 East Idaho Avenue „ Meridian, Idaho 83642 RE: Application for Conditional Use Permit and Preliminary Plat for Deklan LAND Subdivision - Letter of Intent PLANNING Dear Honorable Mayor and Council Members: �lr ( On behalf of my client, Wayne Stacy of Heritage Development, LLC, please from R-4 to R-8, a preliminary accept these applications for a rezoning request CIVIL plat for six patio homes on 1.6 acres, and a variance application. The above ENGINEERING applications have been submitted in accordance with the requirements of the City of Meridian's Zoning Ordinance; the City of Meridian's Subdivision Regulations and the City of Meridian's Comprehensive Plan. A variance for using pressurized irrigation will be sought. There is not a reliable source of water for pressurized irrigation; therefore, City water will be used for domestic and irrigation purposes. LANDSCAPE ARCHITECTURE The project site (tax parcel S 1212110500) is located approximately 850 feet south of Cherry Road on 4t' Street in Township 3N, Range 1W, Section 12. The approximately 1.6-acre project site is within the City of Meridian jurisdiction and is surrounded by developed property on three sides. The Church of Jesus Christ of Latter -Day Saints owns the large parcel north of the project site. The triplexes are adjacent to the project site's eastern PH 208/246.8300 boundary. The overall density of the Western Subdivision is 5.9 dwelling FX 208/246.8320 www,wrgdesign.com units per acre. The Western Subdivision is designated as Medium Density Residential and zoned R-4. ❖ South: The single-family homes of the Western Subdivision are located south of the project site. This portion of the Western subdivision is designated as High Density Residential and zoned R-4. ❖ West: The Midtown Square Subdivision is across 4th Street. This subdivision features single-family residences at 3.5 dwelling units per acre. It is designated as Medium Density Residential and is zoned R-8. VARIANCE REQUEST The site shows evidence of existing drainage, however; the water crossing the site is not reliable enough to provide pressurized irrigation to the proposed subdivision. This was confirmed on a site visit with Bill Henson from the Nampa Meridian Irrigation District. There are also no known pressurized irrigation systems in the project vicinity. Therefore, this application is requesting a variance from Meridian City Code Chapters 9-1-28: Pressurized Irrigation System and 11-313-6: Irrigation Standards which require new development to utilize pressurized irrigation. City water will be used as an irrigation source for the Deklan Subdivision. v x' PRELIMINARY PLAT APPLICATION FOR DEKLAN DEVELOPMENT Site Design The project site is a small infill parcel located at 4th Street and Maple Street, approximately 850 feet south of Cherry Lane. The applicant is proposing eight (8) total lots on 1.6 acres. Six (6) lots will be for single-family residences and the remaining two (2) lots will be common area. The lots range in size from 6,100 square feet to 9,300 square feet. The property will be served by one local road off of 411, Street and will terminate in a cul-de-sac. The two (2) common areas will frame both sides of the road providing a landscaped entrance. Open Space and Landscaping There are two common lot areas included within the Deklan Subdivision. These common lots are at the entrance of the property and will be used for landscaping. Approximately .13 acres or 8.1% will be set aside for common area landscaping. Landscaping will utilize a drip irrigation system to minimize the amount of water used for irrigation. Traffic The project will be served by one public street that takes access from 4th Street that terminates in a cul-de-sac. Deklan Court, within the Deklan subdivision will have a 42-foot right-of-way with 29 feet of pavement for a two lane road, curb, gutters, and a four -foot sidewalk. This is narrower than the typical 50-foot right-of-way for local roads as required by ACHD, but this development meets the exception requirements as presented in ACHD Policy Manual for a reduced right-of-way. According to Chapter 7204.4.1 the following conditions must be present to warrant a reduction of the right-of-way: 1) The street must be local; 2) Zoning in the area must be residential; 3) There is no possibility that the street will be extended in the future; and 4) Traffic volumes are not forecasted to exceed 200 ADT. Traffic generated by this project is estimated to be 60 trips per day. 4th Street is a local road that terminates north of the property. It does not connect to Cherry Lane to the north at this time and there are no current plans to extend it. D E S I G N I N C. — 3 Public Services and Utilities There are existing power, water and sewer lines within the 4th Street right-of-way. The power lines cross the entrance of the property. Power lines to serve this project will be placed underground. The developer will work with Idaho Power if it becomes necessary to move any of the existing power lines. Sewer and water lines will be extended down the Deklan Court right- of-way and onto the individual properties. The project site is within the Nampa Meridian Irrigation District. Although there are three drainage areas on -site, there is no reliable source of water running through any of the drainage areas to provide pressurized irrigation. The property will be served entirely by City water. Runoff created by the project will be drained into two seepage beds. One seepage bed will be located in Lot 1 which is common area and the second seepage bed will be within the street right-of-way. Drainage from off -site will be directed to the northern boundary of the property where there is an existing pipe that extends under the ball field on the church property. This design will maintain the historic drainage patterns of the site. Phasing This project will be completed in one phase. COMPREHENSIVE PLAN COMPLIANCE FOR DEKLAN DEVELOPMENT The current City of Meridian's Comprehensive Plan has the following policies and goals in which Deklan meets: Transportation: Goal II: Facilitate the movement of people and products to and from the Meridian Impact Ares. o Objective A: Enhance existing transportation systems to accommodate growth. The City of Meridian requires pedestrian paths and sidewalks in all new development to promote neighborhood connectivity. Response: The Deklan Subdivision will have sidewalks on both sides of the road and will connect into 4th Street to promote pedestrian activity. Land Use Goal I: Ensure a variety and balance of land uses to support the Meridian Impact Area. o Objective C: Maintain integrity of housing areas to preserve values and ambiance of areas. Development standards set forth by the City of Meridian regarding landscaping, signage, walls, and fencing are intended to protect and mitigate the impacts of new development on the existing development. Response: The Deklan Subdivision will follow all development standards regarding landscaping, signage, walls, and fencing. Fences along the eastern, D E S I G N I N C. 4 northern, and western boundaries will help to ensure the privacy of the existing homes. Goal V: Offer a diversity of housing types for a greater range of choice. o Objective A: Encourage quality housing projects for all economic levels in a variety of areas. The City of Meridian encourages the development of random vacant lots throughout its boundaries. These lots should be developed in a similar manner to the surrounding development. Response: The Deklan Subdivision is adjacent to residential development on three sides. The densities of the adjacent development range from three (3) to six (6) dwelling units per acre. The majority of the existing homes are single-family residences, but there are three (3) triplexes adjacent to the eastern boundary of the project site. The proposed development will have six patio homes on 1.6 acres for a gross density of 3.77 dwelling units per acre. This development will be in character with the existing homes in the area. 11 CONCLUSION The applicant is asking the City Council to review a rezoning and preliminary plat application for the Deklan Subdivision. It is located on 4th Street, approximately 850 feet south of Cherry Lane. The applicant is requesting a rezoning from R-4 to R-8. This is a single-family residential project and is a good fit with the area. Existing development is a mix of single- and multi -family (triplexes) development that ranges in density from 3.5 to 5.9 dwelling units per acre. As an infill project, the Deklan Subdivision will feature six (6) patio homes and at an overall density of 3.77 dwelling units per acre. All homes will be single -story and range in size from 1,500 to 1,700 square feet in size. This request is in compliance with the City of Meridian Comprehensive Plan and it will further the City's goals by developing vacant lots within City limits. The applicant met with the neighbors on December 6, 2006 at the Meridian Middle School. The neighbors present were curious to see the proposal and several were happy that it was a residential project. There were no major issues or concerns brought up at the meeting. The proposed building site is located at 1432 W. 4t' Street in Meridian, Idaho. The site is so located in the NE 1/4 of the NE 1/4, Section 12, Township 3N, Range 1 W, Boise Meridian, Ada County. A vicinity map showing the site location is included as Figure 1 in Appendix A. In general, the purposes of this investigation were to evaluate the subsurface conditions and to provide general soil conditions and groundwater depth relating to the proposed building structures, pavements, and general site preparation. The investigation included subsurface exploration, representative soil sampling, field testing, and preparation of this report. This report was prepared solely for geotechnical purposes, and does not address any environmental issues. The work performed for this report was authorized by Ashley Ford, Planning Project Manager at WRG Design, and was conducted in accordance with our original site investigation proposal dated November 9, 2006. 1.2 Project Description Based on information provided to American Geotechnics by WRG Design, we understand before the design can begin, groundwater information is needed for the property. Currently the proposed construction is in preliminary design stages and land -use, number of buildings, and building sizes are unknown. A plan configuration of the site is shown on Figure 2 in Appendix A. At the time of this investigation, the proposed site was undeveloped and vacant. The topography was generally flat with an overall slope to the North. The surface of the site was covered with grassy vegetation. American Geotechnics .., Stacey Infill Project Meridian, Idaho Project No. 06B-G 143 6 November 27, 2006 Page 3 2.0 METHODS OF STUDY 2.1 General Reconnaissance A M E R I C A N T E C H N I C S Data including a site plan provided by WRG Design was reviewed before starting the field program. The site was visited to mark the field exploration locations, coordinate a utilities clearance, and assess site access. Soil survey of Ada County area Idaho (Collet 1980) reports the site soils are Aeric Haplaquepts and Purdam Silt Loam. Other information reviewed includes Idaho Department of Water Resources (IDWR) Well logs for wells near the site and the IDWR Ground Water Level Database. 2.2 Field Explorations The subsurface soil conditions were explored by drilling one test boring on November 16, 2006, within the proposed site to depth of 12 feet below the existing site grade. The approximate location of the test boring is shown on Figure 2 in Appendix A. A log of the subsurface conditions, as encountered in the test boring, was recorded at the time of the field work by American Geotechnics, and is presented on the log of exploration contained in Appendix B. The soils were classified using ASTM D2488 — Classification of Soils for Engineering Purposes, as a guide. The drilling was accomplished with American Geotechnics' trailer mounted drill rig using hollow stem auger equipment. A 2" PVC pipe was installed in the boring for future measurements of groundwater levels, if desired. American Geotechnics Stacey Infill Project Meridian, Idaho Project No. 06B-G1436 November 27, 2006 Page 4 3.0 INTERPRETATION 3.1 Geology A M E R A T E C H N I C S Soil survey of Ada County area Idaho (Collet 1980), reports the site soils are Aeric Haplaquepts and Purdam Silt Loam which can be generally in the upper 6 feet of the subsurface profile. These are soil formed in loess or silty alluvium that is underlain by mixed alluvium in the drainage way of the alluvial terraces south of the Boise River. Collet reports these soils are characterized as being moderately deep to deep and somewhat poorly drained to well drained and may include a hardpan. The digging and trenching may be hampered by the hardpan and by seasonally high groundwater unless drainage is provided. The use of these soils as a septic tank absorption field is limited by the fluctuating groundwater table and depth to hardpan. If the septic absorption field discharges water into the groundwater, contamination of the nearby water supply can be a hazard. The hardpan typically restricts the downward movement of effluent. Typically the cemented hardpan can be penetrated by power equipment. 3.2 Subsurface Profile A generalized subsurface profile was developed for this project to provide a basis for discussion of soil conditions for the proposed facilities. This profile is based on the field test data and exploration testing program conducted by American Geotechnics. Generalized Subsurface Profile* Stratum Generalized Description I Sandy Lean Clay (CL) encountered from the existing ground surface to 4 feet below ground surface, stiff. A thin moderately cemented layer of fine to course sand (hardpan) was observed 2.5 feet below ground surface. II Silty Sand with Gravel (SM) encountered from 4 feet below ground surface to bottom of hole, medium dense. *See the logs of exploration (Appendix B) for detailed subsurface information. American Geotechnics Stacey Infill Project ..� Meridian, Idaho Proj ect No. 06B-G 143 6 November 27, 2006 Page 5 3.3 Groundwater A M E R I C A N C � L i1 J T E C H N I C S Groundwater was observed at the time of our field investigation at a depth of 8.4 feet below the existing ground surface. The log of exploration contains the water level measurement. The location of the test boring was selected because it appeared to be the lowest surface elevation on the lot. This investigation was performed after the irrigation season during which groundwater is typically at its seasonally high. Historical data published by the Idaho Department of Water Resources was reviewed to estimate groundwater fluctuation and seasonal high. Well Driller's reports (IDWR Summary Report) were reviewed. For available well logs within 1/2 mile of the site, it appears that the groundwater in the Northeast Quarter of Section 12 is typically deeper than 8 feet below ground surface. It also appears that peak groundwater in the surrounding 1/4 sections is typically deeper than 8 feet below ground surface except in areas near Five Mile Creek and Settlers Canal, which are north and northeast of the site, respectively. The Groundwater Level Database (IDWR On -Line Database) was reviewed for groundwater level fluctuation and peak groundwater highs for wells 03NO1W-03DDA1, 04NO1E-29CCCD1, and 04N 10 1 W-3 5AAA 1, which are the three wells nearest the site. Data for these wells recorded between October 1933 to May 2006 indicated the peak groundwater elevation ranged between from 8.2 feet to 11.5 feet below the site's approximate ground surface elevation . It should be noted that these measurements were taken from wells that were a half mile or more distance from the site. Soil survey of Ada County area Idaho (Collet 1980), reports that the typical groundwater for the Aeric Haplaquepts soil at the site can be as shallow as 18 inches during the summer months. The soil properties associated with this soil type are typically formed in mixed drainage ways. The site does not appear to be part of a drainage way. An irrigation conveyance was observed at the site, however, it appeared that this ditch has not been used for some time, and that the nearby property, which is not agricultural land used for row crops, is not using flood irrigation adjacent to the site. Monitoring of groundwater fluctuation was beyond the scope of this investigation. Based on our investigation and available data, it is our opinion that the seasonal high groundwater elevation may be approximately 7 feet below existing ground surface and the site is best suited for buildings not having a basement and connected to a municipal septic system. 4.0 CLOSURE 4.1 Limitations Recommendations contained in this report are based on our field explorations and review of readily available literature. The study was performed using a mutually agreed upon scope of work. It is our opinion that this study was a cost-effective method to determine site soils and general groundwater elevation conditions. More detailed, focused, and/or thorough investigations can be conducted. Further studies will tend to increase the level of assurance; however, such efforts will result in increased costs. If the Client wishes to reduce the uncertainties beyond the level associated with this study, American Geotechnics should be contacted for additional consultation. The soils data used in the preparation of this report were obtained from the field explorations made for this investigation. It is possible that variations in soils exist between the points explored. The nature and extent of soil variations may not be evident until construction occurs. If any soil conditions are encountered at this site that differ from those described in this report, our firm should be immediately notified so that we may make any necessary revisions to our recommendations. In addition, if the scope of the proposed project, locations of structures, or building loads change from the description given in this report, our firm should be notified. The observations made in this report are based on the assumption that an adequate geotechnical program including testing, observation, and engineering consultation will be made prior to and during construction to verify compliance with the report findings; prepare adequate geotechnical American Geotechnics Stacey Infill Project Meridian, Idaho Project No. 0613-G1436 November 27, 2006 Page 7 � M E R� A; T E C H N I C S field exploration, laboratory testing, engineering analyses, recommendations, and reporting; and identify appropriate construction conditions. The observation and testing of subsurface soils specific to building conditions are critical with regards to the conclusions and recommendations provided in this report. If and adequate geotechnical investigation and report are not performed prior to construction, then the Client agrees to assume American Geotechnics' responsibility for any potential claims that may arise during or after construction. The report has been prepared for specific application to this project in accordance with the generally accepted standards of practice at the time the report was written. No warranty, express or implied, is made. This report may be used only by the Client and for the purposes stated, within a reasonable time from its issuance. Land use, site conditions (both on- and off -site), or other factors including advances in man's understanding of applied science may change over time and could materially affect our findings. Therefore, this report should not be relied upon after 24 months from its issue. American Geotechnics should be notified if the project is delayed by more than 24 months from the date of this report so that a review of site conditions can be made, and recommendations revised, if appropriate. It is the CLIENT'S responsibility to see that all parties to the project, including the designer, contractor, subcontractors, etc., are made aware of this report in its entirety. The use of information contained in this report for bidding purposes should be done at the Contractor's option and risk. Any parry other than the Client who wishes to use this report shall notify American Geotechnics of such intended use by executing the "Application for Authorization to Use" which follows this document as an appendix. Based on the intended use of the report, American Geotechnics may require that additional work be performed and that an updated report be issued. Non-compliance with any of these requirements by the Client or anyone else will release American Geotechnics from any liability resulting from the use of this report by any unauthorized parry. LIM Date: American Geotechnics American Geotechnics, Inc More construction problems are caused by site subsurface conditions than any other factor. As troublesome as subsurface problems can be, their frequency and extent have been lessened considerably in recent years, due in large measure to programs and publications of ASFE/The Association of Engineering Firms Practicing in the Geosciences. The following suggestions and observations are offered to help you reduce the geotechnical-related delays, cost -overruns and other costly headaches that can occur during a construction project. A GEOTECHNICAL ENGINEERING REPORT IS BASED ON A UNIQUE SET OF PROJECT - SPECIFIC FACTORS A geotechnical engineering report is based on a subsurface exploration plan designed to incorporate a unique set of project -specific factors. These typically include: the general nature of the structure involved, its size and configuration; the location of the structure on the site and its orientation; physical concomitants such as access roads, parking lots, and underground utilities, and the level of additional risk which the client assumed by virtue of limitations imposed upon the exploratory program. To help avoid costly problems, consult the geotechnical engineer to determine how any factors which change subsequent to the date of the report may affect its recommendations. Unless your consulting geotechnical engineer indicates otherwise, your geotechnical engineering report should not be used: • When the nature of the proposed structure is changed, for example, if an office building will be erected instead of a parking garage, or if a refrigerated warehouse will be built instead of an unrefrigerated one; • When the size or configuration of the proposed structure is altered; • When the location or orientation of the proposed structure is modified; • When there is a change of ownership, or • For application to an adjacent site. Geotechnical engineers cannot accept responsibility for problems which may develop if they are not consulted after factors considered in their report's development have changed. MOST GEOTECHNICAL "FINDINGS" ARE PROFESSIONAL ESTIMATES Site exploration identifies actual subsurface conditions only at those points where samples are taken, when they are taken. Data derived through sampling and subsequent laboratory testing are extrapolated by geotechnical engineers who then render an opinion about overall subsurface conditions, their likely reaction to proposed construction activity, and appropriate foundation design. Even under optimal circumstances actual conditions may differ from those inferred to exist, because no geotechnical engineer, no matter how qualified, and no subsurface exploration program, no matter how comprehensive, can reveal what is hidden by earth, rock and time. The actual interface between materials may be far more gradual or abrupt than a report indicates. Actual conditions in areas not sampled may differ from predictions. Nothing can be done to prevent the unanticipated, but steps can be taken to help minimize their impact. For this reason, most experienced owners retain their geotechnical consultants through the construction stage, to identify variances, conduct additional tests which may be needed, and to recommend solutions to problems encountered on site. SUBSURFACE CONDITIONS CAN CHANGE Subsurface conditions may be modified by constantly -changing natural forces. Because a geotechnical engineering report is based on conditions which existed at the time of subsurface exploration, construction decisions should not be based on a geotechnical engineering report whose adequacy may have been affected by time. Speak with the geotechnical consultant to learn if additional tests are advisable before construction starts. Construction operations at or adjacent to the site and natural events such as floods, earthquakes or groundwater fluctuations may also affect subsurface conditions and, thus, the continuing adequacy of a geotechnical report. The geotechnical engineer should be kept apprised of any such events, and should be consulted to determine if additional tests are necessary. GEOTECHNICAL SERVICES ARE PERFORMED FOR SPECIFIC PURPOSES AND PERSONS Geotechnical engineers' reports are prepared to meet the specific needs of specific individuals. A report prepared for a consulting civil engineer may not be adequate for a construction contractor, or even some other consulting civil engineer. Unless indicated otherwise, this report was prepared expressly for the client involved and expressly for purposes indicated by the client. Use by any other persons for any purpose, or by the client for a different purpose, may result in problems. No individual other than the client should apply this report for its intended purpose without first conferring with the geotechnical engineers. No person should apply this report for any purpose other than that originally contemplated without first conferring with the geotechnical engineer. A GEOTECHNICAL ENGINEERING REPORT IS SUBJECT TO MISINTERPRETATION Costly problems can occur when other design professionals develop their plans based on misinterpretations of a geotechnical engineering report. To help avoid these problems, the geotechnical engineer should be retained to work with other appropriate design professionals to explain relevant geotechnical findings and to review the adequacy of their plans and specifications relative to geotechnical issues. BORING LOGS SHOULD NOT BE SEPARATED FROM THE ENGINEERING REPORT Final boring logs are developed by geotechnical engineers based upon their interpretation of field logs (assembled by site personnel) and laboratory evaluation of field samples. Only final boring logs customarily are included in geotechnical engineering reports. These logs should not under any circumstances be redrawn for inclusion in architectural or other design drawings, because drafters may commit error or omissions in the transfer process. Although photographic reproduction eliminates this problem, it does nothing to minimize the possibility of contractors misinterpreting the logs during bid preparation. When this occurs, delays, disputes and unanticipated costs are the all -too -frequent result. To minimize the likelihood of boring log misinterpretation, give contractors ready access to the complete geotechnical engineering report prepared or authorized for their use. Those who do not provide such access may proceed under the mistaken impression that simply disclaiming responsibility for the accuracy of subsurface information always insulates them from attendant liability. Providing the best available information to contractors helps prevent costly construction problems and the adversarial attitudes which aggravate them to disproportionate scale. READ RESPONSIBILITY CLAUSES CLOSELY Because geotechnical engineering is based extensively on judgment and opinion, it is far less exact than other design disciplines. This situation has resulted in wholly unwarranted claims being lodged against geotechnical consultants. To help prevent this problem, geotechnical engineers have developed model clauses for use in written transmittals. These are not exculpatory clauses designed to foist geotechnical engineers' liabilities onto someone else. Rather, they are definitive clauses which identify where geotechnical engineers' responsibilities begin and end. Their use helps all parties involved recognize their individual responsibilities and take appropriate action. Some of these definitive clauses are likely to appear in your geotechnical engineering report, and you are encouraged to read them closely. Your geotechnical engineer will be pleased to give full and frank answers to your questions. OTHER STEPS YOU CAN TAKE TO REDUCE RISK Your consulting geotechnical engineer will be pleased to discuss other techniques which can be employed to mitigate risk.
