Dear Mr. Schwider:
This letter is to inform you of the Planning Director's decision to deny your alternative compliance (ALT
08-009) for the parking requirements of UDC 11-3C-6. Per your letter received May 1, 2008, you have
requested alternative compliance approval for the parking requirements related to the 130 and 132
Broadway Projects (CZC-08-018 and CZC-08-045). Your proposed alternative to the required on -site
parking is to use a portion of the former Idaho Truss lease site for shared parking.
Planning Staff was directed by City Council at the September 25, 2007 meeting to only allow the payment
of in -lieu fees as alternative compliance within the Downtown area. (I have attached the Council
resolution and minutes for your review.) Therefore, Staff cannot approve your request for alternative
compliance ALT 08-009 until such time as Council approves off -site, shared parking as an
appropriate alternative method of compliance.
Please let us know if you wish to make use of the available in -lieu fee option to provide the required
parking for CZC-08-018 and CZC-08-045. If you propose a timeline, we can hold the applications until
such time as you make arrangements for the required parking. If a timeline is not proposed within two
weeks, we will deny each CZC for failure to provide the required parking.
In accordance with UDC 11-5A-3F and UDC 11-5A-6, you have the option to appeal this decision to the
City Council. All City Council Reviews (appeals) shall be filed in writing with the Planning Department
within fifteen (15) days after the date of this letter. The appeal will be forwarded to the City Council to
conduct a public hearing. The appeal should specify the grounds upon which the appeal is filed. I have
attached the City Council Review application and checklist with this letter, should you decide to file an
appeal of the Director's determination.

If Council grants your request to NOT make use of the in -lieu fees for alternative compliance, please note
that there are other outstanding issues with your proposal:
1) You have only proposed to develop a portion of the former Idaho Truss lease site. We do not
accept applications for portions of a property; the proposed improvements must show the full
property development consistent with the Downtown Design Guidelines.
2) If the proposed off -site parking will only be available for the 130 and 132 Broadway projects, the
proposal does not meet the standards for shared parking. Instead, you are proposing a parking
facility on a separate property. Parking facilities within the Old Town zoning district require
conditional use approval.

y Application for Appeal to Council
On May 14, 2008, the City of Meridian Planning Director issued a denial of alternative
compliance ALT 08-009. We wish to appeal that decision to the Meridian City Council
per UDC Section 11-5A-6 and 11-5A-3F.
Meridian Exchange, LLC, proosed to develop the entire quarter -block on the northwest
corner of Broadway and E. 2° Streets, with required parking provided directly south
across Broadway on property that we also control. The Planning Director's denial cited
City of Meridian Resolution #07-583 which, in the Director's interpretation, limits
developer options for off -site parking under UDC Section 11-3C-7 to ONLY fees in lieu
of providing on -site parking.
The Meridian Development Corporation, when it considered in -lieu fees for parking,
clearly desired that the in -lieu fees provide an ADDITIONAL alternative for developers
in Downtown, rather than an exclusive alternative. Furthermore, consider the very first
preamble in the City of Meridian's Resolution #07-583 which adopted the MDC policy:
"WHEREAS, the Meridian Development Corporation has developed a policy for
Fees in Lieu of Parking, which outlines the desired goals of providing an
additional option (emphasis added) that may help Downtown developments
solve site parking issues..."
We believe the denial of ALT 08-009 presents an unjust burden on our fee simple
property and our leasehold property as well as burdening all surrounding properties
which our proposed shared parking could assist per the above referenced UDC section.
Indeed, allowing this interpretation to prevail prevents all Old Town property owners
from full enjoyment of the UDC when compared with other property owners in the City
of Meridian.
Our belief is the Old Town property owners should be allotted the same rights and
privileges the remainder of the city has and thus should have the right to avail themselves
of alternative. compliance options envisioned in section 11-3C-7 should they meet the
required standards inherent in that section.
We request, therefore, the Meridian City Council reverse the decision of the Planning
Director with respect to ALT 08-009 and direct the Planning. Director to. promptly
reconsider that application.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
