Nary, via email Members, via email City Attorney/Risk Manager, City of Meridian City of Meridian 33 E Broadway Ave 33 E Broadway Ave Meridian, ID 83642 Meridian, ID 83642 RE: Application - Centerville Subdivision AZ PP H-2021-0046 Dear Honorable City of Meridian Council Members, Planning and Zoning Commissioners, and Mayor, et al.: Engineering Solutions, LLP., on behalf of its client, filed an application for the annexation and zoning of the property located east of Hillsdale Elementary School and the South Meridian YMCA. The three parcels that make up the total project footprint are located on the south east corner of Amity Road and Hillsdale Avenue. The adjacent neighborhoods include Century Farm, Hillsdale Creek, Rockhampton and Shelburne. To provide background information, the planning of this development started over a year ago. The first neighborhood meeting with the applicant occurred June 11, 2020. A group of 90+ local residents showed up for that initial meeting to voice their concerns about this project, its impacts on traffic, parking, local schools (Hillsdale Elementary was at capacity), local infrastructure (water/sewer/police/fire), pedestrian safety, a lack of public transportation within walking distance, a lack of consistency with the design and appearance of adjacent neighborhoods and a perceived insufficiency in meeting the City of Meridian Comprehensive Plan’s definition of mixed-use designation (e.g. having only a few qualities out of the multiple examples of what could be included in mixed-use). The local residents flat out opposed the project’s high-density. Many residents were furious that such a proposal would exist. The purpose of this letter is to call to your attention what we believe to be material facts about the Centerville Subdivision, in its entirety, that are missing from a recent mailer, some neighbors received on July 15, 2021. We believe this notice produces an insufficient representation of the project from its outline on the project map, shows a diminished footprint and is confusing. The following describes our concerns regarding the notice in more detail: (The exhibits noted are attached at the end of this letter. All personal information was removed from the exhibits). Page 2 of 12 Exhibit A and Exhibit B are copies of the initial mailing. Exhibit C shows an interpretation of the area of development based upon the highlights of the map. Exhibit D shows the actual area of development per the plats found at the City of Meridian’s link to this application found here: https://weblink.meridiancity.org/WebLink/Browse.aspx?id=232417&dbid=0&repo=MeridianCity While the map appears to show only a single parcel of the project, the preliminary plat description on Exhibit A appears to describe the entire project which would fall within Exhibit D. While it clearly points out “1 Clubhouse,” it fails to adequately describe the twelve three-story apartment complexes clearly visible in the preliminary plat of Exhibit E. The location of the “1 Clubhouse” appears to fall outside of the highlighted parcel on Exhibit C when comparing Exhibits C and E. The preliminary plat is not part of the notice. The apartments total 168 dwelling units. A figure missing from the preliminary plat description on the notice. Some have commented on social media wondering if they reduced the twelve apartment buildings down to only two (presumably due to the language “2 multi-family lots”). We want to be clear. The high-density zoning of this proposal (apartments included) is the driving factor for our concerns listed above and voiced during the neighborhood meetings. Furthermore, a look at the attached vicinity map (Exhibit F) obtained from the “vicinity map” folder in the City’s online applicant file database shows the same box highlighted in Exhibit C. Exhibit G appears to show even more concerning information. As of July 18, 2021, this is the only file in the “Vicinity Map 500 Feet” folder in the City’s online applicant file database. We interpret the blue outlined lots and parcels, in Exhibit G, as those who should be receiving the mailer. What about those lots in the “red box” we added in Exhibit G? Do they not get mailers? They are bordering the entire proposed development. As of July 18, 2021, lots highlighted in blue on Exhibit G appear to be the only recipients of a mailer. At least one household whose backyard borders the southern end of the entire project (the three parcels) and whose lot is in the “red box” in Exhibit G has not received any mailer. Is this how the notification process works? This is an unfair notification process if such is the case. The “500 foot rule” should extend outwards from the borders of the entire project on the preliminary plat and not just from one of three parcels that will become the final project. A committee formed representing the surrounding neighborhoods after the initial neighborhood meeting in June 2020. This committee has been dormant for several months because we learned the project was put on hold. We are ordinary concerned residents without legal and development experience. We understand that this land will be developed. We are putting forth our best efforts to understand the Comprehensive Plan, City Codes and to look out for the well-being of our City, community and future residents of this development. We look forward to our opportunity for public testimony. We appreciate your public service and hard work to make our City great during these challenging times. As a measure of the concern of local residents, and despite that our specific concerns may have changed from the original petition, it is important to point out that a www.change.org petition regarding the opposition to this subdivision, published in June 2020 has over 1,400 signatures. The data was the original counts. Here is a link. www.change.org/hillsdalelanduse. See Exhibit H. We are not making accusations about the actions or intentions of the applicant or its client(s). We are simply pointing out a perceived insufficiency of this notice, its potential to cause confusion, and break public trust. ● Is this mailer process incomplete? ● Is City code violated? ● Are just the lots in blue getting mailers? ● Should the applicant be required to resend a mailer to the lots in red and to all land within 500 feet of the entire project? ● Should the applicant be required to resend the mailer with more complete detailed information (as noted)? ● Would an extension of public meetings be a good idea to provide appropriate information for surrounding residents if a revised mailer is needed? ● Would a revision of the City code notification rules be necessary? ● Would a revision of the City code requiring a clearer understanding of the project on the mailers be necessary? Thank you for bringing the noticing error to our attention. As you pointed out, parcels were indeed missing from the initial map received by my office, so the data retrieved from there was incorrect. I will address your questions below and lay out the next steps for you. ● Is this mailer process incomplete? Since the map was incorrect, mailing was not complete. Since postcards are mailed well in advance of what is required by City Code, we are able to correct this matter in time. However, due to The Meridian Press failing to post the hearing notice on 7-16 (they inadvertently reprinted the previous week’s page), we have scheduled a special meeting for 8/12/21. New postcards will be mailed with that date. We will also be updating the project folder with the correct maps and dates. ● Is City code violated? No. The error was caught in time for the hearing to proceed on 8/12/21. ● Are just the lots in blue getting mailers? Based on the original map, yes. However, all property owners as identified by the Ada County Assessor within 500 feet will receive a postcard. ● Should the applicant be required to resend a mailer to the lots in red and to all land within 500 feet of the entire project? The city, not the applicant, provides the notice. We are correcting this as noted above. ● Should the applicant be required to resend the mailer with more complete detailed information (as noted)? The mailer will have the information required by City Code. ● Would an extension of public meetings be a good idea to provide appropriate information for surrounding residents if a revised mailer is needed? August 12 is the new hearing date. ● Would a revision of the City code notification rules be necessary? A revision was made in 2019 to increase mailers from 300 feet to 500 feet. ● Would a revision of the City code requiring a clearer understanding of the project on the mailers be necessary? No. City Code requires noticing, however it is incumbent on the public to seek out more detailed information. The project folder is the source of information. In this case, it was incomplete due to a map error. We are correcting that error today. Postcards will go out today with the correct map, and to the correct list. The hearing folder will be updated, and the hearing will be scheduled for August 12, 2021. All noticing will be completed according to Meridian City Code Title 11, Chapter 5-A6-E : E. Mailing and publishing of the public hearing notice. 1. Legal notice. At least fifteen (15) days prior to the public hearing, the city shall publish a notice of the time and place and a summary of the application in the official newspaper of general circulation in Ada County. 2. Radius notice. a. Time of notice. At least fifteen (15) days prior to the public hearing, the city shall send a notice by first class mail of the time and place, and a summary of the application to property owners or purchasers of record (as listed in the current records of the Ada County Assessor) owning property within five hundred (500) feet of the property being considered. b. Notice extended. The noticing shall be extended to property owners within one thousand (1,000) feet of the external property boundaries for heavy industries and wireless communication facilities. c. Notice to properties farther from external boundaries. The director may determine, or other applications provided for in this title may require, that notices be sent to property owners or purchasers of record whose properties are farther from the external boundaries of the property than those listed herein. 1 d. Notice to other jurisdictions. The city shall send notice of the application to other jurisdictions with interest and/or authority over the application, including, but not limited to, the following: (1)Other jurisdictions with joint jurisdiction; (2)Appropriate utility companies, irrigation companies or districts and drainage districts; (3)Health and transportation authorities; and (4)School district.
