DESCRIPTION: FINAL PLAT MODIFICATION AND REVISIONS TO
CURRENT CONDITIONS OF APPROVAL.
JAYO CONSTRUCTION INC. IS REQUESTING FINAL PLAT
MODIFICATION AND REVISIONS TO CURRENT CONDITIONS OF
APPROVAL FOR HACIENDA SUBDIVISION, MERIDIAN, IDAHO.
THE CURRENT CONDITIONS OF APPROVAL REQUIRE THAT ALL
FENCING ON THE APPROVED LANDSCAPE AND FENCE PLAN BE
INSTALLED PRIOR TO ANY OCCUPANCIES BEING ISSUED.
JAYO CONSTRUCTIONS IS REQUESTING THAT THIS BE CHANGED
BECAUSE OF CURRENT MARKET CONDITIONS AND BECAUSE OF
BUILDING CONSTRUCTION CONFLICTS WITH THE FENCING IN SOME
LOCATIONS.
JAYO CONSTRUCTION PROPOSES PHASING THE FENCING TO A
PERCENTAGE OF OCCUPANCIES TO GENERATE SOME INCOME TO
FINISH ALL THE DEVELOPMENTS BORDERING FENCING, THE HOUSING
MARKET IS SLOW NOW AND THERE ARE A LOT OF DEVELOPMENTS IN
TROUBLE THROUGH OUT THE STATE, MANY COUNTIES AND CITES ARE
WORKING WITH DEVELOPERS DURING THESE TIMES SO EVERYONE
CAN GET THROUGH THIS AND WE ARE CONFIDENT MERIDIAN CITY
WOULD BE OPEN TO OPTIONS ALSO.
YOU WILL SEE BY STUDYING THE HIGHLIGHTED FENCE PLAN THAT
ALMOST 1/3RD OF THE FENCING HAS BEEN INSTALLED TO DATE. JAYO
CURRENTLY HAS IN PLACE A BOND FOR THE FENCING IN THE AMOUNT
OF $ 150,007.79 THAT ASSURES MERIDIAN CITY ALL FENCING WILL BE
INSTALLED UNDER ANY CIRCUMSTANCES, WE WOULD LIKE TO NOTE
THAT THE BOND HAS NOT BEEN REDUCED EVEN THOUGH ALMOST
1/3RD OF THE FENCING HAS BEEN INSTALLED. JAYO CONST. WOULD
ALSO LIKE TO REQUEST A BOND REDUCTION ACCORDINGLY AFTER
50% OF THE FENCE HAS BEEN INSTALLED AT A FUTURE DATE.
PLEASE REVIEW THE HIGHLIGHTED FENCE PLAN WE HAVE PROVIDED:
• GREEN - PROPOSED NEW FENCING INSTALLED UPON APPROVAL
OF NEW FENCE PLAN, THIS FENCE SHOULD HELP DIVIDE
HACIENDA SUB. FROM THE NEIGHBORING CHURCH PROPERTY
AT THE W. END OF THE SUB. AND AT THE MERIDIAN RD.
FRONTAGE. THE FENCE WILL ALSO SCREEN THE NEW HOUSE
JUST COMPLETED IN HACIENDA LOT 2 BLK 2.
• ORANGE - EXISTING FENCE INSTALLED BY THE NEIGHBORING
DEVELOPMENT.
• PINK - NEW FENCE INSTALLED TO DATE.
• YELLOW - PROPOSED FENCING TO BE INSTALLED AFTER 20
OCCUPANCIES HAVE BEEN ISSUED IN THE DEVELOPMENT THAT
WILL GENERATE INCOME TO FUND FENCE INSTALLATION.
• BLUE - PROPOSED FENCES TO BE INSTALLED AFTER THE
BUILDING HAS BEEN CONSTRUCTED ON THE ADJACENT LOT TO
THE FENCE. NOTE THE 4 AND 6 PLEXES HAVE A ZERO LOT LINE
SIDE SET BACK WHICH OBVIOUSLY WOULD MAKE
CONSTRUCTION IMPOSSIBLE, THE FENCES WOULD NEED TO BE
TAKEN DOWN AND THEN PUT BACK UP AGAIN AFTER
CONSTRUCTION WAS COMPLETED. THE SINGLE FAMILY LOTS
WITH BORDERING SIDE YARD / LOT LINE FENCES SHOULD ALSO
HAVE THE FENCES INSTALLED AFTER CONSTRUCTION IS
COMPLETED BECAUSE THERE IS A VERY HIGH PROBABILITY
THAT THE FENCES WILL BE DAMAGED DURING CONSTRUCTION.
JAYO CONSTRUCTION WOULD LIKE TO THANK YOU IN ADVANCE

Thank you for keeping me in the loop regarding Jayo Developers
request to install the permanent fence on our south border in
phases.
For the record!
It is our understanding that the entire stretch of fence on our south
border was to be permanently installed before any occupancy
permits were issued for any homes built on that border. It is also
our understanding that the temporary construction barrier was to
be maintained throughout until the permanent fence was installed.
As you know there has been an occupancy permit issued for the
home already built and the construction barrier only exists in a few
short stretches now. It has never been maintained as an effective
barrier for anything. Therefore any request to abandon the original
agreement seems unreasonable. The approach seems to be a little
like the cart before the horse.
We understand the housing market is not as strong as it was, but
that is the business they are in. There are no guarantees for
anyone. That being said it seems like it boils down to what would
be the fair thing to do. We feel that a portion of the permanent
fence could be installed from Meridian Rd. up to and including the
structure that is being framed now. From that point a maintained
construction barrier would be acceptable. If another home is
started further down the line then the permanent fence should be
installed up to and including that site. This approach would be a
fair compromise to the situation. It would lessen the financial
burden of installing the entire fence at one time which is what the
developer is requesting.
