Hello, my name is Russ Spearman and I was the President (term expired in June 2021) of the Lansbury Lane Subdivision. Our subdivision, which is off Meridian Road before Ustick consists of 41 residential homes and has been in place since 1995. The subdivision consists of one street that dead ends with a culdesac. I write on behalf of our Association to oppose the change in ordinance that would allow a recreational vehicle to be parked on the street in front of a residents home. Of the 41 homes only 3 have 2 car garages with the rest consisting of three car garages. Many of the homeowners in this subdivision have extended the 8-10 foot property right next to the driveway to allow for additional parking. Our street is wide allowing for buses to pick up schoolchildren and to turn around when exiting from the culdesac. The majority of the time (except for large family gatherings) our street is clear of vehicles. We have reinforced this behavior of keeping the street clear with our homeowners and it has been effective and well received. The fact the majority of homes have 3 car garages allows for the potential of at least 6 or more vehicles to be garaged/located on any given property. Allowing any type of recreational vehicle to be parked in front of a home has the potential to impede mail and/or trash pick up and delivery, is less safe for children playing in the neighborhood, is visually unappealing, and poses a potential safety hazard, especially in winter. Our convenants do not address the issue of parking in the street and I believe a City ordinance would trump a subdivision's CCR's even if a subdivision had language in place to prevent this. I would ask that the City to please refrain from passing this ordinance thereby allowing vehicles to be parked in the street. The overwhelming majority of residents in this subdivision are against this change. Thank you for your consideration Sincerely, Russell C. This section of code is referencing the real property of the parcel and is not modifying parking regulations of public roadways. When the survey referenced the “front” of the property it was referring the “street yard” which is most commonly referred to as a driveway. Meridian City Code 7-2-5(A)(1) allows for vehicle, recreational vehicles included, to park on any public road for 72 hours at a time; this code section is not being modified. The modifications to UDC 11-3C-4 would allow for one recreational or one other described vehicle to park on the street yard (driveway) of a property, partially to address your stated concern of roadway safety by clearing these large vehicles from the public roadway. Subdivision CC & R’s are allowed to be more restrictive than City Code but, on the other hand, should not allow something that is otherwise regulated city code. If what you are currently doing within your subdivision is working, it is already working for your desired results although there is a city code currently in effect allowing public street parking.
